SAN DIEGO (KGTV) - Across the state of California, there were more than 10,000 sexual harassment offenses, as defined by California education code that resulted in suspension, expulsion or disciplinary diversion.A San Diego mother says her daughter was bullied and sexually harassed at school.“She said that he would take her pencils from her,” said Myiesha Jackson. “If she tried to get them back he would stick them down his pants."Jackson claims the male student didn’t stop there. She claims he took Play-Doh, made it into the shape of a penis and rubbed it on her daughter while making inappropriate sounds."I consider that sexual harassment,” said Jackson. An investigation report Jackson gave to Team 10 says the accused student admitted to rolling up the Play-Doh and holding it up while singing an inappropriate song that was sexual in nature, and the Play-Doh represented a male genitalia part, but the other student denied touching her with it.At the end of the report, it lists an action play, basically separating both students at all points of the day so they wouldn’t come into contact with each other.Jackson says that’s not what happened."The very day I brought her back she was in lunch, the line to get lunch, and they let him out of the office apparently, and he went and stood directly behind her,” she said.Magnolia Science Academy- San Diego denied 10News’ request for an interview.In an emailed statement an attorney for Magnolia Public Schools wrote:“State and federal student confidentiality laws and our organization's policy prohibit MSA-SD from commenting on specific students or incidents in which they may be involved. MSA-SD is committed to the social, emotional and academic well-being of all its students. Any incidents that impact the well-being of a student are reviewed, investigated and responded to with the utmost urgency and thoroughness and addressed according to our internal policies protocols and legal requirements.” 1985

SAN DIEGO (KGTV) - Amid Coronavirus c oncerns a Holland America cruise ship took off Saturday from the Port of San Diego on a 7-day trip to Mexico.Passengers boarding the cruise said for the most part they weren't concerned.Some added Holland America had been emailing them updates on precautions the cruise line is taking and what passengers should do to stay healthy.Holland America sent this list of precautions to 10News:Guests who have traveled from or through mainland China, Hong Kong, or Macau, or had contact with a suspected or confirmed case of novel coronavirus (2019-nCoV) or a person who is under monitoring for coronavirus in the last 14 days prior to sailing will not be permitted to board the ship. Pre-Boarding medical evaluations, including temperature checks, for persons whom, for any reason, appear or identify as symptomatic (respiratory or fever symptoms); and For all guests, our standard pre-boarding health reporting advising of their reporting obligations for any illness or symptoms of an illness.Medical screening for Coronavirus on all guests who visit our onboard Medical Center with symptoms of any respiratory illness.Reporting to local and national health authorities of all cases of fever and respiratory illness, and any patients with suspected Coronavirus infection. Crew members from mainland China will be delayed from joining any ship until further notice. Crew members from other regions of the world who may have been scheduled to connect on flights through China have been rerouted.Additional environmental disinfection on board will be performed in addition to our regular stringent cleaning and sanitation protocols.Saturday 10News did not see or hear about any passengers having their temperature taken.10News reached out to the cruise line working to confirm these precautions are being taken. 1850

SAN DIEGO (KGTV) — A Scripps Ranch woman did a double take when she found a mailbox post knocked down, the biggest shock came two days later.Last Thursday afternoon, Elizabeth Spelce came out of her along Cypress Valley Drive and saw it: A wooden post with her mailbox and three others was lying on its side, split apart just above the concrete."Disbelief. Stood there for a good minute and stared," said Spelce.At first she thought the culprit was the wet, windy weather. Two days later, she took a closer look and realized the wood was not rotted and wasn't so sure about her wind theory. She then assumed it might have been some bad driver or teen driver, so she decided to look at her Ring doorbell video."It was a little shocking," said Spelce.In the video, a mail truck is seen pulling alongside the curb, before running right into the post and toppling the mailboxes. The postal carrier backs up the truck, pulls forward, and soon after, reaches down and delivers the mail. The truck then drives off, apparently resuming its route."There was no note. No nothing. Just a big mystery," said Spelce.Spelce says the postal carrier added to the mystery when she talked to a neighbor. "She says, 'by the way, your mailboxes are knocked over ... Gosh, I can't imagine how it happened,'" said Spelce.Remember how she continued to deliver the mail after the mailboxes were knocked over? "She was pretending she delivered the mail and then it happened ... It's very disappointing," said Spelce.Her toppled post has since been replaced by her HOA. Spelce filed a complaint with the Postal Service. She's doesn't want the mail carrier to lose her job, but hopes she'll finally take responsibility. SAN DIEGO (KGTV) - An Uber driver helped a Lyft driver after a crash on Interstate 8 in Mission Valley Monday.The Uber driver told 10News he was exiting eastbound I-8 at Mission Gorge Rd. at 1:45 a.m. when he saw an SUV on its side, blocking the road.The man turned on his hazard lights and used his Uber car to block the road while he ran to help, he said.The Lyft driver was trapped and screaming for help, according to the man.The Uber driver said he kicked the windshield until he formed a hole the Lyft driver could climb through.Paramedics took the Lyft driver to the hospital with cuts and bruises.CHP officers are investigating the cause of the crash.The Lyft driver was not arrested but told the CHP his 'mind wasn't working', according to Officer Jim Bettencourt. 806

  

SAN DIEGO (KGTV) — A Scripps Ranch woman who contacted Team 10 about problems with her Samsung refrigerator is now receiving a full refund after Team 10’s story aired.Stephanie Nivinskus bought her Samsung french door refrigerator in December 2014. It cost her nearly ,000. She said she had issues roughly six months after she bought it. "It's been a headache since the beginning," Nivinskus told Team 10 in September.The first problem was the ice maker does not function properly, according to Nivinskus."The ice just gathers and collects up there. It makes it so it doesn't work," Nivinskus said.She also has issues with the temperature of the refrigerator. The FDA says a safe temperature inside a refrigerator is 40 degrees or below. During the initial interview with Team 10, the thermometer inside of Nivinskus' refrigerator read about 56 degrees."Having spoiled food is a real problem," she said. RELATED: Samsung customers upset over broken ice makers and high temperatures on fridgesNivinskus said a Samsung representative called her after Team 10’s first story. Shortly after, a full refund for her refrigerator was processed.“Thank you so much for helping us because fighting by myself, I was getting a whole lot of nowhere,” Nivinskus said.Samsung is currently facing a class-action lawsuit regarding the broken ice makers. There are also more than 5,400 people in a Facebook group demanding a recall of Samsung refrigerators.In an email, a Samsung spokesperson told Team 10 in response to the initial story: "At Samsung we stand behind all of our products, including our refrigerators, and want to ensure our customers are completely satisfied. If a customer encounters any problem with their product or service, we encourage them to reach out to us directly at 1-800-SAMSUNG so we can provide assistance."Nivinskus said she spoke to customer service before contacting Team 10. She is encouraging other customers dealing with similar problems not to give up. "Keep fighting,” she said. “They need to take responsibility for this and you need to get what you paid for." 2092
