(KGTV) - Sentencing will continue next week for the man convicted of killing his former business partner along with the man’s wife and two young sons. A San Bernardino County jury recommended the death penalty in June 2019 for Charles “Chase” Merritt. The recommendation came after Merritt was found guilty in the deaths of Joseph McStay, his wife Summer, and their two sons, Gianni and Joey Jr. A sentence was expected to be delivered Friday. The hearing will now resume on Tuesday.The family was last seen at a Fallbrook home in February 2010. Investigators had few leads in the case, at one point believing the McStays had crossed the border into Mexico voluntarily. Merritt alerted authorities to the disappearance and filed a missing persons report. That led to the discovery of the family’s remains in a shallow grave less than 20 miles from Merritt’s home. One year later, Merritt was arrested. During his trial, which started in January 2019, prosecutors said Merritt had been forging checks linked to the business he shared with Joseph McStay. During Friday's sentencing, Merritt tried to fire his attorney, Rajan Maline, after returning from the court's lunch break. The defense had spent the morning giving several motions about new cell phone evidence. The prosecution had yet to have the chance to argue against the motions before Merritt moved to fire Maline mid-trial. The judge denied Merritt's request and allowed the defense to continue arguments for a new trial because of the new evidence and alleged misconduct by the prosecution. 1795

(KGTV) -- Testimony will continue Tuesday in the preliminary exam for the suspected smuggler charged with murder after leading the border patrol on a wild, high speed chase that ended with the deaths of three of his passengers. It happened on westbound Interstate 8 near Boulevard on the evening of November 29th, 2018. Luis Virgen, 21, is a U.S. citizen who had been living in Tijuana at the time of the crash. He's charged with second degree murder and gross vehicular manslaughter. Virgen is accused of smashing through a gate that leads into the U.S. from Mexico with 10 undocumented immigrants in his truck, including 9 in the bed of the truck under a tarp. Everyone but the driver was thrown from the truck when it crashed after hitting a spike strip deployed by the border patrol. Gregg Curtis testified that after the truck blew past him, he started shooting video with his cellphone in case something happened. Curtis can be heard talking under the cellphone video, which was played in court Monday. "I wouldn't be surprised if he totally crashes his brains out," said Curtis. He also testified about how fast the defendant was going."I was alarmed at a vehicle passing me at such a large rate of speed that it shook my truck," said Rieu. The border patrol received some criticism following the incident, some questioning why they didn't call off the chase given the wet roads and dangerous conditions at the time. Several agents testified that they had no idea that the truck's bed was hiding several undocumented immigrants. Another agent described how he tried to revive the victims. "Another individual, I cradled his head, he was moaning and groaning, and I told him he was going to be fine that it was just a scratch and to stay awake," said Agent Jahir Waterman. (KGTV) - The California Department of Motor Vehicles announced plans Monday to close for half a day in July to conduct employee customer service training. Operation Excellence: DMV Training will “equip employees with the tools they need to handle an unprecedented volume of REAL ID applications,” said DMV officials. Californians will be required to show a REAL ID-compliant license or identification card, or passport, to fly in the U.S. starting Oct. 1, 2020.
