SAN DIEGO (KGTV) – A verdict has been reached in the trial of a former Yuma Police officer accused of raping his then-wife's cousin in 2017.Jurors found 34-year-old Jared Elkins guilty of four felony counts, including forcible rape and sexual penetration by force. Elkins was found not guilty, however, on four similar counts involving an intoxicated victim."I'm extremely pleased with this jury and their verdicts," said Deputy District Attorney Lisa Fox."The fact that he was a law enforcement officer and carried a weapon was significant for the victim in this case she believed that he would carry through with these threats and why she was so afraid of him," argued Fox.Elkins was taken into custody without bail following the reading of the verdict. The group had been out to dinner, then watched a movie while drinking beer and wine at the home. That night a 23-year-old woman, related by marriage, says Elkins forced her to have sex while other family members were asleep in the house. Elkins claimed during testimony this month that the sex was consensual and the rape charges were made out of guilt.Following the encounter, the woman says she ran to her mother's room and both escaped out of a window. SAN DIEGO (KGTV) - After a deadly house fire in Logan Heights, 10News spoke with a retired fire captain on fire safety checks that can protect you and your family.Bob Lyon is a retired fire captain and knows the tragedy that can come with burglar bars in the Logan Heights neighborhood, "something that they're using for protecting their lives, ends up being something that costs them their lives."A Fire Code adopted in the late 1990's requires bars have a safety latch. "You put your foot on it, and it releases the bars because there's a little spacer in it and it will pop them, and the bars are supposed to swing open," Lyon said.RELATED: One dead, five injured in Logan Heights house fireMany homes still have old bars, or those with the safety mechanism can rust, locking them in place. "Rarely do people maintain those, just because they're something out of sight, out of mind," Lyon said solemnly.Neighbor Miguel Hernandez a few doors down from the deadly Sunday morning fire told 10News in Spanish he checks his home's bars often to ensure the security of his family. He added he checks the smoke alarms as well, changing the batteries the recommended 6-months or each year.Lyon said one more thing you can do is "sleeping with your bedroom doors closed because that helps compartmentalize and keeps the fire out of your room, gives you more time to get out."It also gives firefighters more time to get to you.Lyon said firefighters learn how to break through burglar bars in the academy, but it takes precious time. 1534

SAN DIEGO (KGTV) - A shopper at Westfield UTC mall got a disturbing surprise while going to the bathroom, in the form of a cell phone's camera lens.Around noon on Saturday, amid a busy holiday shopping day, Mike Gonzalez went to the bathroom. His wife and 5-year-old daughter were waiting for him in the nearby food court."The urinals were taken so I went into the stall," said Gonzalez. Gonzalez went inside the stall at the far end."I'm finishing up my business, and I see a cell phone pop out of the stall next to me and pop back like that," said Gonzalez.He says the phone slid against the back wall just enough for the camera lens to be visible."Wow, did that actually happen?" said Gonzalez. Gonzalez' confusion quickly gave way to action."I was angry and felt violated," said Gonzalez. He told another man to get mall security before turning his attention to the stall."When you looked at the stall, he had it blocked with paper towels. You couldn't see in, top to bottom. Kicked the door a little and told him to get out," said Gonzalez.Gonzalez says the man that emerged was in his early 20s, about 5'10", 175 lbs, with curly, light brown hair. Gonzalez told him what he saw and the man denied it all."I was pushing him back, holding him in place so he couldn't leave," said Gonzalez.The shoving moved into the hallway, before the man slipped away and raced off. Gonzalez says what makes his skin crawl the most is the paper towel setup, which may mean the man had been in there awhile, taking photos. "The scariest thing is probably what if there were kids in there. You can put photos and videos online. Who knows what he does with it," said Gonzalez.Gonzalez filed a report with San Diego Police. 10news reached out to Westfield, but a spokesperson declined to comment, citing an active police investigation. 1828

SAN DIEGO (KGTV) — An autopsy report released on Trevor Heitmann, the teenager known as "McSkillet" on YouTube, is revealing details about what happened before he crashed his vehicle on Interstate 805.The report says Heitmann’s parents called the police to request a psychiatric evaluation stating, “On August 23, the decedent's parents contacted the local police department to request a psychiatric evaluation but were informed that the evaluation could not be performed as the decedent had not broken any laws."The statement means hours before Trevor Heitmann drove his car down the freeway killing two people, police were at his house.RELATED: Autopsy details mental state of McSkillet before deadly I-805 crash"Even though police are trained to identify mental health issues and mental illness issues they just can't take someone off the streets unless there is such conduct to warrant it,” said attorney Kenneth Rosenfeld.Rosenfeld, who has no connection to this case, explained law enforcement does have the ability to detain someone using the 51-50 law. It would allow someone to be involuntarily detained for a psychiatric hold for up to 72 hours.Conduct in many cases needs to be observed. Just saying someone is acting out of nature isn't always good enough.RELATED: YouTuber's family releases statement, offers condolences to crash victims“Police officers are not psychologists or psychiatrists,” he said. “They do their best, but usually when someone’s conduct or behavior is so erratic, that’s when they can factor into the idea that this is probably someone worth taking it.”Police dispatch logs show units arriving at the Heitmann home just after 8:00 a.m., Aug. 23, the morning of the crash.At 9:14 a.m., notes say, “based on statements from parents, there was no credible threat and Subject did not meet 5150 criteria. Parents advised if we went in house to ask subject if he would voluntarily go to hospital, subject may become violent. We did not encounter subject. SAN DIEGO (KGTV) -- A water contact closure was extended Sunday to include the Silver Strand due to flows from the Tijuana River. According to the county, a water contact closure was issued Saturday for Imperial Beach. The closure was extended north to include the Silver Strand. “Sewage-contaminated runoff in the Tijuana River has been entering the Tijuana Estuary as a result of recent rainfall,” the Department of Environmental Health said.
