At the Mission Bay Theater, a 55th celebration video will run daily through Memorial Day.On Thursday, parkgoers will be given free parking and can enjoy 55 cent souvenir bottle refills and .50 churro or popcorn and soda combos. SAN DIEGO (KGTV) – Fixing San Diego’s streets was one of Mayor Kevin Faulconer’s top priorities when he took office, and now he believes they’re on schedule to reach his goal of repairing more than 3,000 miles of roads.About a decade ago, it took crews an entire year to get about 24 miles of street repairs done in the city. Now, crews are averaging 25 miles of street repair a month.Kris McFadden, director of San Diego’s Transportation & Storm Water Department, said the pandemic helped them get the work done without causing much backups on the roads.“We staggered working times, people coming in different times. So, we were able to do a lot of repairs, especially when people weren’t driving on the roads,” said McFadden.Faulconer said, “When I ran for mayor, there was no issue that San Diegans complained about more than streets, so we have been on a mission over the past six years to bring smooth streets to neighborhoods across the city. We overhauled the repair program to speed up fixes, made record investments in street repair, and are on pace to fix half of all City streets by the end of the year. The robust program we now have in place fixes hundreds of miles annually and I strongly encourage the next Mayor to keep the pedal to the metal until every San Diegan can experience a freshly paved street outside their front door.”In a news release, city officials said crews “completed repair work on some of the City’s busiest streets including completing repairs to North Harbor Drive, Fairmont Avenue, Montezuma Road, and a network of streets in Mission Bay that have not seen a major facelift in nearly two decades. Construction on Scripps Poway Parkway is underway and anticipated to be completed in December.”Even though the city is on track to repave half of the its entire street network by the end of the year, City Councilmember Vivian Moreno said there’s more work that needs to be done, specifically on dirt and gravel roads in neighborhoods like Stockton.Moreno sent ABC 10News a statement that read, in part: “These dirt streets are vestiges of the past maintained by policies that are over six decades old.”The city says they’re looking at this request, but the plan is to finish the repairs that have already been scheduled to meet the goal by the end of the year. 2308

SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. Businesses can ask if a person has a disability, but not much beyond that.RELATED: Confrontation over wearing a mask at Coronado coffee shop"You can't delve into someone's medical condition and ask them a bunch of questions," said attorney Colin Harrison. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. So what's reasonable?"A reasonable accommodation might be to ask the person to wear a face shield, which is about an inch and away and probably wouldn't restrict their ability to breathe," says attorney Steven Elia.RELATED: GoFundMe started for San Diego barista after woman posts about not wearing mask at StarbucksElia says other accommodations might include curbside pickup, but the ADA has limits: businesses don't have to fundamentally alter the way they operate."Customer says I don't want to wear a mask, I want you to deliver to my home. If the business doesn't already provide delivery service, that would be a major fundamental alteration of their business, one they would not be required to do," Harrison said.Both attorneys suggested businesses try to make accommodations first.RELATED: Feds warn of phony cards claiming face mask exemptionBut what happens if those accommodations won't work? There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. There have been at least nine across the country. But businesses that win can pursue legal fees from the other party. 2548

  

SAN DIEGO (KGTV) -- Democrat Ammar-Campa Najjar and Republican Darrell Issa have emerged as the favorites to represent East County's 50th Congressional District, according to a scientific poll released Tuesday. The 10News/Union-Tribune scientific poll comes one week before the March primary, in which voters will head to the polls for the first time since Republican Congressman Duncan Hunter resigned in January after pleading guilty to one count of felony campaign fraud. The poll, of 552 likely voters, shows Campa-Najjar, the lone household Democrat, leading the field with 35 percent of the vote. Former Congressman Issa, a Republican, comes in second with 21 percent, with former San Diego City Councilman Carl DeMaio at 15 percent. The poll had 12 percent undecided and State Sen. Brian Jones, a Republican, at 7 percent. 837
