BEIJING, Dec. 20 (Xinhua) -- A draft amendment to China's Criminal Law remained unchanged in reducing the number of crimes subject to the death penalty.The draft amendment was submitted Monday to the Standing Committee of the National People's Congress (NPC), China's top legislature, for its second reading.In August this year, the NPC Standing Committee discussed the draft amendment during its first reading. The draft amendment will make 13 crimes exempt from capital punishment, if it becomes law.The crimes included: smuggling cultural relics, gold, silver, and other precious metals and rare animals and their products out of the country; carrying out fraudulent activities with financial bills; carrying out fraudulent activities with letters of credit; the false issuance of exclusive value-added tax invoices to defraud export tax refunds or to offset taxes; the forging or selling of forged exclusive value-added tax invoices; the teaching of crime-committing methods; and robbing ancient cultural ruins.During the process of the NPC Standing Committee's discussion, when the draft amendment was released for public submissions, some people suggested some of the 13 crimes be given death penalty while others thought that more crimes should be exempt from capital punishment.If the amendment becomes law, it will be the first time the number of crimes subject to the death penalty has been reduced since the People's Republic of China enacted its criminal law in 1979. It will also be a move by China to limit the use of the death penalty, after the Supreme People's Court in 2007 began to review and approve all death penalty decisions.The current law allows the death penalty for 68 crimes. The draft amendment, if passed, will reduce that number to 55.

NANJING, Dec. 18 (Xinhua) -- A kindergarten teacher who reportedly burned seven children using a hot iron on Tuesday has been detained for 10 days by police and fired from her teaching position in east China's Jiangsu Province, said local authorities on Saturday.The teacher, surnamed Yi, 30, of Banqiao Kindergarten of Xinghua City, said that "she did not know the iron was still hot when she used it to discipline the children," according to information released at a press conference held by the city government.The seven children were slightly burned on the face. The burns are expected to fade without treatment within two weeks and probably will not leave scars, according to doctors at Xinghua City People's Hospital.As of Saturday, two children had returned to class, one dropped out of this kindergarten, two remained at home resting and two are seeking treatment in east China's Shanghai Municipality, according to information released at the press conference.Further, the municipal police detained Yi for 10 days and fined her 500 yuan (75 U.S. dollars).The kindergarten owner apologized at the press conference and fired Yi.As for Yi's using an iron because she did not think the iron was still hot, many people did not believe this and posted threads online, such as "How could you still think the iron is not hot since you burned seven kids."But the police believe Yi did not foresee such consequences.Dai Yongjian with the city public security bureau, said the iron had been unplugged from the socket for over ten minutes before burning the children, according to Yi's co-workers."Yi had treated children well before the incident, according to our talks with the kindergarten owners, teachers and children' s parents," said Dai.The students' faces did not show any injuries until that afternoon, said Dai.Yang Qiuhong, mother of one injured child, named Wang Junhua, said , "I was angry at first, but now I forgive Yi and the kindergarten since Yi used to treat my child well and after this incident, the head of the kindergarten came to my home right away and took my child to the hospital."The police believed that Yi lacked necessary medical knowledge and did not seek treatment for the children immediately after their faces began to show signs of being burned.Yi was said to "regret her actions very much", according to Wu Gang, deputy chief of the municipal Education Bureau.Yi does not have a preschool teacher certificate, which is quite common in Xinghua City, since only 40 percent of the 1,600 kindergarten teachers have such certificates, said Wu.According to the regulation issued by the Jiangsu Provincial Government, such a certificate is required for some kindergarten posts, such as the head of the kindergarten and medical personnel. ZHENGZHOU, Dec. 1 (Xinhua) -- A Chinese court Wednesday upheld the death sentences with two year reprieves given to two mine bosses found responsible for a gas explosion that killed 76 people at a central China coal mine last year.The sentences were the first time mine bosses in China held responsible for a fatal accident were given the death penalty.The provincial high court in Henan Province rejected the appeals of Li Xinjun, former head of the No. 4 coal mine in the Xinhua District of Pingdingshan City, and Han Erjun, former deputy head of the mine.The court also rejected appeals filed by three other managers of the mine who were sentenced to 13 years, 15 years and life imprisonment respectively.The Intermediate Court of Pingdingshan City sentenced the five mine bosses on November 16 for neglecting safety procedures and forcing miners to work underground despite knowing the mine lacked adequate safety measures.The blast ripped through the No. 4 mine in Pingdingshan City on September 8, 2009, as 93 miners worked underground, killing 76 and injuring 15 others.The mine was under technological renovation at the time of the blast and did not have a safe production license, the court has found.China's coal mines are notorious for deadly accidents. More than 2,600 miners were killed in mine accidents in China last year, a number significantly less than in previous years.

BEIJING, Dec. 12 (Xinhua) -- China said it will make greater efforts to start six-party emergency consultations because tensions on the Korean Peninsula have not eased."The six-party talks are a very important way to advance the denuclearization process on the Korean Peninsula and maintain peace and stability in northeast Asia. We, the concerned parties, should make full use of the talks," Chinese Foreign Minister Yang Jiechi said in an interview in Beijing Friday.Launched in 2003 and stalled since the end of 2008, the six-party talks involve China, Russia, the United States, Japan, the Democratic People's Republic of Korea (DPRK) and the Republic of Korea (ROK)."While the talks have yet to be resumed, we think it is the proper time for emergency consultations between the heads of the delegations of the six parties," said the foreign minister.Tensions remain high on the Korean Peninsula after the DPRK and the ROK exchanged artillery fire on Nov. 23. China proposed emergency consultations among the chief negotiators in December.Amid the international community's repeated calls for restraint and calm, the United States held separate large-scale naval drills with the ROK and Japan in waters near the peninsula."We will continue to make patient efforts to persuade the parties to engage in consultations," Yang said.He said the tensions on the peninsular will ease "only if all the parties show their sincerity and make joint efforts.""Stability on the Korean Peninsula is good for all.
