SAN DIEGO (KGTV) — San Diego court records show a history of legal disputes with Clark Construction Group, the company that employed the worker who died in yesterday’s accident on a construction site at UC San Diego.10News found a court complaint over the 2017 death of a driller. Frederick Von Kahl's family sued Clark Construction and other defendants for negligence, alleging they created a dangerous workplace at a San Ysidro job site which reportedly caused a valve to strike Kahl in his chest.Friday afternoon, Kahl family attorney Benjamin Bunn said that the case just recently moved into a settlement agreement. He said that Kahl had been married for 40 years.The Occupational Safety and Health Administration (OSHA) website revealed that it issued violations and a ,260 fine. In another negligence case, a worker sued Clark Construction Group and other defendants over a 2010 accident at the San Diego Marriot & Marina Hotel, claiming that a large piece of concrete dropped through a roof and struck a worker's body and right arm. The case was later dismissed.There's also a negligence suit that settled after a 91-year-old woman reportedly suffered broken bones from a fall while walking by a downtown construction site that she claimed was unsafe.The Division of Occupational Safety and Health of California (Cal/OSHA) has done at least 10 investigations into the company in the last 10 years. A Cal/OSHA spokesperson said Thursday that most of the investigations involve complaints from workers reporting unsafe conditions, with no violations issued. However, Clark Construction was reportedly issued two safety violations and a ,000 fine in 2014 over a project in Riverside, California. 1715

SAN DIEGO (KGTV) - San Diego gun owners could soon face more requirements when it comes to storing their firearms.City Attorney Mara Elliott announced the proposal Tuesday. It would require gun owners to store their guns in a Department of Justice approved lockbox or trigger lock, unless the owner or authorized user is carrying the firearm or it is in their immediate control. Elliott said state law requires locks to accompany guns sold in California but does not always require their use. "Safe storage laws work when it comes to protecting our kids," said Elliott, who made the announcement next to a playground at Mission Bay. Elliott pointed to the 2013 death of 10-year-old Eric Klyaz, who was fatally shot when playing with a gun in a friend's garage. "Two families were torn apart that day, but the impact of his death cut deeper than that," Elliott said. Violators would face up to six months in jail and a ,000 fine. Elliott said police wouldn't be doing door-to-door checks, but could cite someone when responding to a different call.Still, Michael Schwartz, who heads the San Diego County Gun Owners PAC, said law is duplicative and that education is the better approach. "This is something that invades someone's choice in their home," he said. "Whether or not you have a child, maybe you're a single woman who lives at home, and now she's taking away a number of choices that a single woman has to be able to defend herself in her own home."The proposed ordinance says it will not substantially burden a person's ability for self-defense at home. The city's public safety committee will consider the ordinance at its meeting Wednesday. 1662

SAN DIEGO (KGTV) -- San Diego Fire-Rescue Thursday pulled a man to safety who fell 30 feet into a trench on the grounds of a work site at UC San Diego. According to the department, the incident happened just before 3 p.m. on Voit Drive at Matthews Lane. Crews used a pulley system to get the worker, a man in his 20s, out of the trench. He was then taken to UCSD Medical Center for treatment of blunt-force injuries and burns he received when he landed on a steam pipe. His condition is unknown at this time. RELATED: 1 dead, 4 injured in accident at construction site at UC San DiegoNearby workers and an officer were able to climb down and stay with the worker until he could be safely lifted out of the trench.The incident comes after one of five workers injured in a construction site accident died on the UC San Diego campus in July of 2019. SAN DIEGO (KGTV) — San Diego Padres games just got a little classier.The Padres hosted their inaugural "Anchorman" race at Petco Park Friday, featuring San Diego's favorite news team from Channel 4: Anchor Ron Burgundy, sports reporter Champ Kind, reporter Brian Fantana, and weatherman Brick Tamland.And by the beard of Zeus, Burgundy took the first race handily. SAN DIEGO (KGTV) - San Diego marijuana supporters are being invited to legally celebrate 4-20 at an Embarcadero Park festival but organizers remind attendees that smoking in public remains illegal.Legal weed supporters will gather in Embarcadero Park North for Bayked?SD, a festival meant to celebrate marijuana and the unique holiday with educational seminars and various musical acts."Regardless of the origin of 4-20, it now marks a community celebration of a makeshift holiday where friends gather to enjoy life and spread the feel-good (sp) vibes year after year," organizers wrote online.RELATED: City of Chula Vista gives legal marijuana sales the green lightFestival organizers cautioned there will be no marijuana products of any kind sold on the premises, noting while it's legal to smoke marijuana in California it's not legal to smoke in public.A variety of cannabis brand vendors will be in attendance and sessions to provide education on recreational marijuana will be held.An insider with the festival told 10News that organizers will incorporate a combination of pre-event and on-site precautions to deter marijuana consumption.Organizers will remind attendees on-site and through email prior to the event that marijuana is not allowed.
