(KGTV) - On a given evening, the streets of Carlsbad Village are filled with people walking, biking, and driving across the train tracks that bisect the city.The number of trains passing through has also been steadily increasing.“There are projections that say in the next 10 years train traffic is going to double through this region,” said Jason Haber, who works for the City of Carlsbad.Carlsbad Village is one of the last remaining stretches of train tracks along the San Diego Coast that has not been double-tracked to accommodate the growth in train volume. But there are plans to change that.The option being pushed by the city is to trench the tracks through the downtown area. That would also address the other pressing issue on the tracks: safety.In the last 5 years, the North County Transit District says 11 people have died from being struck by a train in the city.Last September, Jason Holsinger was killed where the tracks cross Grand Avenue when he rode his bike passed a lowered crossing arm.Near Tamarack Avenue, Josh Foster was killed last February while walking along the tracks. The Medical Examiner determined he had marijuana in his system but ruled it an accident.One of the most high profile deaths occurred in 2014 when 22-year-old Patrick Terrin was struck by a train while crossing at Grand Avenue after a night of drinking.The family sued the City of Carlsbad and BNSF railways claiming there were inadequate safety measures at the crossing for pedestrians. However, they lost the case when a judge determined the city and BNSF were not liable.If a plan to trench the tracks is given the green light, the vehicle and pedestrian crossings would go over the tracks.Two alternatives are currently being looked at, a shorter and longer version.The North County Transit District oversees the tracks in the area and would end up making the end decision. It’s unclear where the money would come from at this point. Depending on the alternative chosen, the project could cost between 300-400 million dollars. Construction could take several years. 2093

(CNS) - The city of Carlsbad announced Thursday it was temporarily suspending its collection fees for sidewalk cafes, outdoor displays and curbside cafe permits to help businesses during the COVID-19 pandemic.This suspension of permit fees also means reimbursement of around ,000 to businesses that paid for these types of permits since March 1 of this year. Fee reimbursement and the revenue offset from the suspension of fee collection will be funded from the Economic Recovery and Revitalization Initiative funds. Of those funds, 5,000 remains for contingency or future city council actions.When the pandemic's public health orders required the closure of indoor operations, Carlsbad relaxed development standards to allow businesses to use these permits to quickly activate outdoor spaces on public sidewalks. Some businesses were also granted no-cost permits allowing them to use private property such as their parking lots, to add to their existing outdoor areas.On July 28, the City Council also relaxed standards for curbside cafes, allowing restaurants to use up to four street parking stalls to expand outdoor dining.The permits normally cost a one-time payment of 1 and ,200 per parking stall per year. These fees are now temporarily suspended until February 28, 2021, or for the duration of the local COVID-19 pandemic emergency, whichever is later.More than 70 businesses have been permitted, including restaurants, fitness classes, hair and nail salons, spas and churches, allowing them to temporarily move their operations outdoors onto private property, public sidewalks and on-street public parking spaces so that they can comply with public health guidelines.According to a statement from the city, even with the county now allowing indoor dining, retail shopping or fitness classes, capacity has been reduced by 50% to 90%, depending on the type of business. CARLSBAD (KGTV) - In response to a four year construction project that recently kicked off, California Highway Patrol has lowered the speed limit on a stretch of interstate 5 by 10 miles per hour. The stretch is about eight miles long, through Encinitas and Carlsbad. The entire project will eventually go all the way to the 78. The project with add HOV lanes over the next four years. The new speed limit will help to protect workers in the area working closely to the passing vehicles. California Highway Patrol officer Mark Latulippe tells 10News, "the days of well we just put the signs up and we’re giving you a grace limit, are over". They've put up dozens of signs to warn people of the change, dropping the speed limit to 55 miles per hour. Despite the many signs drivers are ignoring the change and sticking to their normal speeds upwards of 70 miles per hour. The signs have been up for about a month but Latulippe says, "we are sending enforcement units out now to start that ticketing process of trying to slow this down". Drivers can now expect to get pulled over and ticketed from here on out. Because the area is a work zone, the tickets will be double the normal speeding fine. 1202

Businesses may be reopening, but they're still struggling to pay their rent.About 40% of major retailers didn't pay their rent in May, according to numbers from data firm Datex Property Solutions.Some companies are warning they won't be able to pay rent for months. Starbucks for example is asking for landlords to adjust lease terms and rent for at least 12 months.It's an even worse situation for some small businesses.“I would think landlords ordinarily are not that sympathetic, right, because they can get somebody else to pay the bill,” said Jack Strauss, an economics expert and professor at the University of Denver. “In this case, a landlord is foolish to ignore the struggling small business.”Strauss says it will be difficult for landlords to find a new tenant quickly, so they have an incentive to delay or partially reduce rent.Businesses in malls are getting hit especially hard. The country's latest mall owner recently sued Gap over three months of unpaid rent.“Being sued kind of makes sense by the landlord to take a heavy hand, but at the same time, it doesn't make sense because they're going to have a lot of, they're potentially going to have a lot of empty spaces,” said Strauss.Punchbowl Social, a national restaurant and entertainment spot just closed one location in the Denver area and one in the Chicago area, acknowledging that landlords are trying to ensure the success of their business.But the CEO says, "landlords cannot expect to maintain status quo economic terms that were negotiated in pre-pandemic times."Strauss agrees with that.
