SAN DIEGO (CNS) - A former executive for an Orange County genetics company pleaded guilty today to a federal conspiracy charge for paying kickbacks to physicians.Donald Joseph Matthews, 50, formerly the vice president of market development for Proove Biosciences, admitted in San Diego federal court to paying doctors at least .5 million to order the company's DNA tests for their patients, according to the U.S. Attorney's Office.In total, the U.S. Attorney's Office said Proove billed around million to the Medicare program for the tests -- which the company alleged could determine a patient's risk of drug addiction -- and received around million in reimbursements.Prosecutors said the company claimed the payments were compensation for participation in a clinical research program, but the money was actually "directly tied to the volume of tests that a doctor ordered and whether a doctor continued to order more tests from Proove over time.''In his plea agreement, Matthews admitted that without the financial compensation, ``most doctors were not interested in ordering Proove's tests for their patients.''Doctors who complained about not being paid were told to order more tests, according to the U.S. Attorney's Office.The company's Irvine headquarters was raided by federal authorities in 2017.``Our nation's healthcare system cannot tolerate kickbacks to physicians while criminals line their pockets with taxpayer-funded healthcare dollars, particularly in light of our nation's current struggles with the COVID- 19 pandemic,'' said Acting Special Agent in Charge Omer Meisel of the FBI's San Diego Division.Matthews is scheduled to be sentenced Oct. 26. San Diegans who recently saw Hamilton at the Civic Theater downtown, or had any business at City Hall may have parked in the massive garage that's just steps from both buildings.The city owns that 1,140-space parking garage, called the Evan Jones Parkade - for the founder of Ace Parking.Many city workers also use it daily, since they get an employee discount. But the garage has also become a source of frustration among them - and in some cases, much worse. Numerous city employees told 10News that the elevators often breakdown, especially when it rains. That forces some of them to walk up 10 flights of stairs after a day's work - instead of waiting longer for the elevators that are working.But a notice posted on the city's website paints a much darker picture. It says the city has responded to more than 200 calls for service for the elevators in the last year, and that breakdowns have increased 20 percent in the last six months. "The elevators have now become unsafe," the notice says. "There is the increased possibility of persons being trapped in a broken-down elevator, needing immediate medical attention and not being able to get it."Additionally, the permit posted in one elevator is two years expired."I'm going to zip up there and hopefully everything wil work out fine," said Andy Jones, of Scripps Ranch, who parked on the 10th floor in a visit to City Hall. "That's a lot of stairs to climb."City spokeswoman Nicole Darling said the elevators are safe and routinely inspected. She said the notice is actually an environmental document, and was strongly worded to speed up approval for repairs.The city plans to replace the controls for all four of the building's elevators, for .8 to .2 million, but doesn't have a start date. A spokeswoman for Department of Industrial Relations says the elevator permits actually expired in September, but the city was late on requesting its permit renewal. SAN DIEGO (CNS) - A bicyclist riding with a group of cyclists was seriously injured Saturday when he was struck by a motorcycle in Pacific Beach, police said.The collision happened at 3:14 p.m. Saturday at the intersection of Ingraham Street and Reed Avenue, according to Officer John Buttle of the San Diego Police Department.A 23-year-old man riding a 2017 Harley Davidson Sportster was southbound in the 4200 block of Ingraham as a group of cyclists were eastbound in the 1500 block of Reed Avenue, Buttle said.The cyclists entered the intersection and the motorcycle struck one of them, a 49-year-old man, the officer said.The motorcyclist suffered road rash to his right leg, Buttle said. The bicyclist suffered a broken left femur and broken ribs. Medics took the cyclist to a hospital.Officers from the SDPD traffic division were investigating the collision, Buttle said.Ingraham was closed in both directions at Thomas and Oliver avenues and was expected to last a couple of hours, the SDPD said. 1012

SACRAMENTO, Calif. (KGTV) – The new year is right around the corner and with it comes a list of new laws going into effect on the roads. Some of the new California laws include gender identity on drivers licenses, new fees related to smog checks and rule changes for motorized scooters. The new laws take effect on January 1, 2019. Check out the list below for the new laws going into effect in 2019: Gender identity laws – The law allows people applying for a California drivers license or ID card to self-certify their chosen gender category of male, female or non-binary. Applicants who choose non-binary will receive an X in the gender category. Motorized Scooters – This law no longer requires helmets for riders who are at least 18-years-old on motorized scooters. It also prohibits people from operating the scooters on a highway with a speed limit over 25 miles per hour unless within a class IV or class II bikeway. Smog check changes and new abatement fees - The law expands smog check exemptions to vehicles that are up to eight model years old. During the additional two years, the vehicles will pay an annual smog abatement fee. Temporary license plate program – The law requires dealers to attach a temporary paper license plate on a vehicle at the time of sale unless the vehicle has a previously-issued license plate. The intent of the new law is to reduce the number of toll violations. Driving under the influence, ignition interlock device – From January 1, 2019 through January 1, 2026, the law mandates that repeat offenders for DUI and first DUI offenders whose violations result in injury to install an ignition interlock device for a period ranging between 12 and 48 months. Driving privilege for minors – The law repeals a juvenile court’s authority to suspend, restrict or delay the issuance of a drivers license of a habitual truant or ward of the state for up to one year. The law clarifies that any suspensions or delays reported prior to January 1, 2019, remain in effect.Unsafe, unsecured loads on vehicles – The law requires the DMV to include at least one question addressing laws on driving with an unsafe, unsecured load in at least 20 percent of the knowledge tests. The DMV is also reminding drivers of low-emission an transitional zero-emission vehicles that their green or white decals granting them access to HOV lanes expires January 1, 2019. Vehicles issued a green or white decal between January 1, 2017 and March 1, 2018 are eligible to apply for a red decal that grants them access to HOV lanes through January 1, 2022. The DMV plans to issue light purple decals in 2019 that will grant access to HOV lanes through January 1, 2023. Those eligible include drivers who haven’t applied for or received a consumer rebate pursuant to the Clean Vehicle Rebate Project, unless they meet annual income requirements. 2865
