SAN DIEGO (KGTV) - A former San Diego Unified School District student and football player is suing the district.The lawsuit filed by Jason Srouy alleges he was never informed of the potential financial and legal risks of participating and playing an organized sport if a lawsuit were to be filed alleging any negligent or other claims against the student-athlete.In 2018 Srouy and the school district were sued by a referee. The referee was injured during a 2015 game and claimed it was done on purpose. He alleged Srouy had a history of unsportsmanlike conduct known and encouraged by the coaching staff.At the time Srouy told 10News he was playing wide receiver during the game, tasked with blocking the opposing cornerback. During the block, he says the opposing player fell onto the back of the referee's legs, injuring the official.In a previous interview, Srouy said after learning of the lawsuit a school official led his family to believe the district would help him; however that was not the case. “It wasn’t on purpose, it was an accident, I didn’t mean to hurt anybody," said Srouy.Srouy’s attorney tells Team 10 he was eventually dropped from the lawsuit but not before racking incurring more than 5,000 in costs and fees.A spokesperson for the district says they can’t comment on pending litigation. 1323

SAN DIEGO (KGTV) -- A 96-year-old family secret reveals a piece of the Carlsbad school district’s history. Florence Oliver has lived in San Diego her whole life."I was born at SD General at that time, but of course I don't remember it!" The family settled down in Carlsbad, and for Florence, family is everything. For the last century, her family hung on to another memory. A brass bell from the Carlsbad School which rung daily for class.In 1922, Florence's uncles stole stole the bell to pull off a prank on her mother's wedding night. "They hung it, in those days you had those wire springs on bed to hold mattresses, they hung it underneath, no one knew… so the bell really rang loud!"Rather than return the bell, it stayed in the family - first handed down to Florence's oldest brother, and then the next brother, and eventually to her."What does it mean to me, it's just a piece of our life, and it's gone through our family, it's like it's related."One day, Florence had a conversation with her niece. "She said Dad used to go in the garage and she told me that bell needs to go home, that would make him very proud."So last month, Florence made good on her promise. SAN DIEGO (KGTV) - A burglary victim is hoping doorbell camera video will help track down some thieves who hunt down garage remotes before raiding the garage. Ring video shows a man on his stomach, around 2 a.m. Saturday, in Curtis Both's driveway off Morena Boulevard. In his hand is Both's garage door opener."My car was ransacked. The remote was in the center console," said Both.The man in the video likely pushed the button for the garage, just slightly. "He wanted to peer in to see what was there," said Both.Moments later, the garage door is heard opening. The man then walks in, before eventually leaving. About two hours later, that man is back with a friend. A camera mounted inside the garage shows them collecting items from the garage."Horrible. A complete violation," said Both.Airsoft gear, ski equipment, power tools, a pricey road bike were among the items that would vanish.A week earlier, about a mile away, a man with a similar backpack and high socks was recorded putting down the backpack and getting on his knees to shine a flashlight at a garage door. Soon after, he's seen heading across the street. That light inside Matt Friend's SUV comes on. Tucked in the door panel is the garage remote. Eventually, Friend's garage door open is seen opening."We were sleeping inside, with two sons in the other room, two- and three-year-old boys and my wife is pregnant so it's disheartening to think somebody is on our premise without us knowing," said Friend.The thief would get away with several items, including friend's ,000 Intense mountain bike."Some of the violation feels like they're just coming to our neighborhood and treating it like a department store, and they have no fear," said Both.Both victims say they almost always lock their car doors and aren't sure how the thief broke into their vehicles. 1840

SAN DIEGO (KGTV) -- A 25-year-old has been arrested after being shot by a store clerk he was trying to rob, San Diego Police say.According to police, Hector Lopez-Gastelum entered the La Michoacana store on the 700 block of Vesta Street around 10:40 a.m. on October 18 demanding cash. Police say Lopez-Gastelum was armed with a handgun.After the clerk handed over the cash, the suspect reportedly demanded that a second register be opened.“While Lopez-Gastelum was still in the store, the clerk shot him twice in the torso with his own handgun, which is legally owned,” police said.The clerk then retrieved Lopez-Gastelum’s handgun and called 911. The suspect was taken to a hospital where he is being treated for his injuries. SAN DIEGO (KGTV) - A 46-year-old Oak Park man is being held without bail in San Diego's Central Jail after San Diego Police say he kidnapped a toddler and molested her.Francisco "Freddy" Diaz faces 8 felony counts, including burglary, kidnapping sexual assault and lewd and lascivious acts on a child under the age of 14. His alleged victim is just three years old.The girl's father, Silvester Soltero told 10News he was working on his car when, unbeknownst to him, the "strange" man who lived next door broke into a bedroom window, grabbing his sleeping daughter.Soltero said Diaz' mother brought his daughter home, but she didn't have her pants. “I grabbed my daughter and I was like, baby what happened?" Soltero said his daughter proceeded to tell him the man touched her private parts.  When the father asked who the man was. Soltero said his daughter pointed out Diaz."I lost it," said Soltero.When the father approached Diaz he became hostile.  “He started screaming if you snitch on me I'll kill you," recalled Soltero.The men fought.  Soltero showed a bruise where he said Diaz tried to poke him in the eye with a fork.Eventually, Diaz ran off, but San Diego Police caught him a short distance away.That's when Soltero said things got worse.  He soon learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Court records show Diaz was convicted in 2006 for molesting three girls on the playground adjacent to Oak Park Elementary School, which is right across from his mother's house.  He was sentenced to eight years in prison, in part because he already had a criminal history.  In 2000, Diaz was convicted of making a terrorist threat and assault with a deadly weapon.Court records show Diaz is schizophrenic and abuses drugs, specifically methamphetamines. A psychologist is quoted in court documents saying, "If he can remain in treatment, and avoid drug and alcohol abuse, he should not pose a danger to the community's children."12 years later, Diaz finds himself back under the legal microscope.Soltero wants to know why a registered sex offender could live right across from a school full of potential victims, and right next door to the home where Soltero's daughter and three other children live.San Diego Police say Diaz was in full compliance with the terms of Megan's Law.  He is required to check in with police every year and he does so, said Lt. Jason Weeden.  Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds.Silvester Soltero says if that's true, the law should be changed.  “If you’re a sex offender you shouldn’t be by a school, period," he said.Diaz will be arraigned before a judge Wednesday.  Soltero says he will be there to make sure justice is done. 3102
