White House adviser Stephen Miller is pushing to expedite a policy that could penalize legal immigrants whose families receive public benefits and make it more difficult to get citizenship, three sources familiar with the matter tell CNN.The White House has been reviewing the proposal since March at the Office of Management and Budget, which is the last stop for regulations before they are final. But concerns over potential lawsuits have delayed the final rule, and the draft has undergone numerous revisions, multiple sources say.The crux of the proposal would penalize legal immigrants if they or their family members have used government benefits -- defined widely in previous drafts of the policy.The law has long allowed authorities to reject immigrants if they are likely to become a "public charge" -- or dependent on government. But the draft rule in its recent forms would include programs as expansive as health care subsidies under the Affordable Care Act, as well as some forms of Medicaid, the Children's Health Insurance Program, food stamps and the Earned Income Tax Credit.The rule would not explicitly prohibit immigrants or their families from accepting benefits. Rather, it authorizes the officers who evaluate their applications for things like green cards and residency visas to count the use of these programs against applicants and gives them authority to deny visas on these grounds -- even if the program was used by a family member.Two non-administration sources close to US Citizenship and Immigration Services, which would publish and enforce the proposal, say that Miller has been unhappy by the delay and has pushed the agency to finish it quickly. The sources say Miller even instructed the agency to prioritize finalizing the rule over other efforts a few weeks ago.Miller is an immigration hardliner within the administration, a veteran of Attorney General Jeff Sessions' Senate office who has been at President Donald Trump's side since the early stages of his presidential campaign.But two other administration sources downplayed the idea of any instructions to defer other policies until it's done, though they acknowledged Miller is keenly interested in the rule.The White House and Department of Homeland Security did not respond to a request for comment.Earlier this year, DHS spokesman Tyler Houlton said the administration is concerned about taxpayer dollars."The administration is committed to enforcing existing immigration law, which is clearly intended to protect the American taxpayer," Houlton said. "Any potential changes to the rule would be in keeping with the letter and spirit of the law -- as well as the reasonable expectations of the American people for the government to be good stewards of taxpayer funds."In one illustration of how many avenues there may be to challenge the complex rule, it was sent over to the Office of Management and Budget designated as not "economically significant" despite the possible impact to millions of immigrants and federal spending.Executive director of the pro-immigration group America's Voice Frank Sharry alleged that Trump and Miller are using a "deeply cynical and cruel strategy" and accused Republicans of "race-baiting.""Trump and Miller have concluded that the best 2018 political strategy is a divisive and desperate three-step: 1) do something cruel to immigrants; 2) sit back as Democrats, the fact-based media and the majority of Americans denounce the cruelty; 3) step in and claim that the President is standing up for his white base and against 'the other' while working to define Democrats as doing the opposite," Sharry said. Wisconsin Gov. Tony Evers and the Department of Health Services issued a new order Tuesday limiting the capacity of bars, restaurants and stores in the state to 25% on Tuesday, as Wisconsin becomes a hot spot for COVID-19 in the U.S.Evers directed DHS Secretary-Designee Andrea Palm to issue the order Tuesday afternoon.The order is capping capacity to 25% in public spaces beginning on Thursday. Gatherings in indoor spaces without an occupancy limit are limited to 10 people."We're seeing increased COVID-19 hospitalizations across the state, and every region is reporting current and imminent hospital staffing shortages in one or more of their facilities," Palm said.Wisconsin has become a hot spot for coronavirus cases in the country after schools reopened this fall. The state has tallied record numbers of cases, hospitalizations and deaths in recent days. Areas that have been hit particularly hard include the state's two largest cities — Milwaukee and Madison — as well as smaller cities like Fox Valley, Green Bay and Wausau.The governor's top attorney, Ryan Nilsestuen, says he's confident the restrictions will withstand legal challenges from the GOP-controlled legislature. Evers' "Safer at Home: order issued last March was eventually blocked by the Wisconsin Supreme Court, after the legislature raised objections with a potential overreach of authority by the health department and the governor's office.“At the end of the day, doing orders and having them challenged in court maybe makes for great theater,” Evers said during a press conference Tuesday. “But it frankly does nothing in making sure people are safer in the state of Wisconsin.”The order goes into effect at 8 a.m. local time on Thursday and will remain in effect until Nov. 6. Violators could face forfeitures of up to 0, according to the governor.The order does not apply to outdoor spaces.The DHS tallied 2,020 new cases on Tuesday and 18 new deaths caused by complications from the coronavirus. Wisconsin has recorded 136,379 confirmed cases and 1,399 deaths since the pandemic began.“We’re in a crisis right now and need to immediately change our behavior to save lives,” Evers said in a statement. “We are continuing to experience a surge in cases and many of our hospitals are overwhelmed, and I believe limiting indoor public gatherings will help slow the spread of this virus. When the COVID-19 pandemic first prompted shelter-in-place restrictions, daycares across the country quickly saw families withdraw their children from their centers. Many lost valuable tuition dollars that keeps their doors open."We've done the best we can in staying open and supporting our community. We are a locally private-owned school so our enrollment really depends on the survival of the school and we’re struggling. I mean, as probably all childcare centers are, we’re struggling with enrollment, we’re struggling with our numbers," says Debbie Bradford, the director of education at Milton Montessori in Georgia.Bradford says the last few months have been very challenging as many families are worried about the coronavirus."The (coronavirus) numbers are on the rise so it’s definitely affecting the end of our school year, our summer and as we look to relaunch in August, we still see light enrollment," says Bradford.The school, which has two locations, has been able to stay open due to a number of parents who are essential workers. Bradford says, "These are front-line families. Some of them are workers on the front line and some of them are workers at home but need the income to make ends meet for our families."Primrose Schools has more than 400 locations across the country, providing infant daycare through private kindergarten. Primrose says the pandemic has dropped enrollment numbers at their facilities significantly."What we are seeing across the country is a very unsettling situation, where a lot of the family home cares that used to be accessible to families are closing. And the childcare centers, those individually owned and operated childcare centers, because of the shelter in place situation, many of them haven't been able to survive them," says Jo Kirchner, the CEO of Primrose Schools.Kirchner has been meeting regularly with other national daycare facilities and says many are concerned about the future of the childcare industry."It is a potential crisis that is going to escalate significantly in the next eight to 10 weeks as the districts decide what they're going to do," says Kirchner.One glimmer of hope is the boost of private kindergarten enrollment, which some parents have deemed a safer alternative than their local public school. Many hope private kindergarten enrollment can be kind of a saving grace for some private childcare centers."It will be somewhat of a saving grace in terms of bringing in base revenue to cover their fixed costs while we get through this pandemic and the families with the younger children will begin to come back,” Kirchner said.For Milton Montessori, the owners are hopeful they will be able to ride out this pandemic."We hope that at some point, families get comfortable with the new requirements for cleaning and for health and safety. And as things return to a normal, it's going to be a new normal," says Bradford.Bradford says they're hoping families start feeling safe enough to enroll their children and continue to support locally-owned childcare centers. 3055
