SAN FRANCISCO (AP) — A jury on Monday ordered agribusiness giant Monsanto Co. to pay a combined .055 billion to a couple claiming that the company's popular weed killer Roundup Ready caused their cancers.The jury's verdict is third such courtroom loss for Monsanto in California since August, but a San Francisco law professor said it's likely a trial judge or appellate court will significantly reduce the punitive damage award.The state court jury in Oakland concluded that Monsanto's weed killer caused the non-Hodgkin's lymphoma Alva Pilliod and Alberta Pilliod each contracted. Jurors awarded them each billion in punitive damages in addition to a combined million in compensatory damages.A federal jury in San Francisco ordered the weed killer maker in March to pay a Sonoma County man million. A San Francisco jury last August awarded 9 million to a former golf course greens keeper who blamed his cancer on Monsanto's Roundup Ready herbicide. St. Louis-based Monsanto is owned by the German chemical giant Bayer A.G.Bayer said Monday that it would appeal the verdict."The verdict in this trial has no impact on future cases and trials, as each one has its own factual and legal circumstances," the company said.The company noted that none of the California verdicts have been considered by an appeals court and that the U.S. Environmental Protection Agency considers the weed killer safe.The EPA reaffirmed its position in April, saying that the active ingredient glyphosate found in the weed killer it posed "no risks of concern" for people exposed to it by any means — on farms, in yards and along roadsides, or as residue left on food crops."There is zero chance it will stand," said University of California, Hastings School of Law professor David Levine said. He said the ratio between the billion in punitive damages and million in compensatory damages is too high. He said judges rarely allow punitive damages to exceed four times actual damages awarded.The California Supreme Court ruled in 2016 that any punitive damages exceeding 10 times the compensatory damages are likely unconstitutionally high. The court didn't propose a ratio it felt correct, but said punitive damages should almost never exceed nine times actual damages, it said.The punitive damages awarded Monday are 36 times the actual damages.The lawsuits have battered Bayer's stock since it purchased Monsanto for billion last year and Bayer's top managers are facing shareholders discontent.Chairman Werner Wenning told shareholders at Bayer's annual general meeting in Bonn last month that company leaders "very much regret" falls in its share price. At the same time, CEO Werner Baumann insisted that "the acquisition of Monsanto was and remains the right move for Bayer."Bayer's stock price closed Monday at .91 a share, down 45 cents or 2.76 percent per share, in trading on the New York Stock Exchange. (KGTV) -- Mexican authorities are investigating the discovery of a tunnel near the Otay Mesa border in San Diego, U.S. officials said.Department of Homeland Security officials confirmed the discovery Thursday morning but did not provide any further details.“At this time, U.S. authorities are aware of a tunnel discovered by Mexican law enforcement officials near the Otay Mesa border. However, we have not yet determined whether the tunnel entered into the U.S.," said Lauren Mack, a spokeswoman with the DHS.All that is known at this time is that the tunnel is in Mexican territory, south of Otay Mesa which stretches east of 805 and south of the 905 freeways.10News station partner Televisa reports that the tunnel does cross the border. SAN DIEGO, Calif. (KGTV) -- Homeless people in San Diego woke up Tuesday morning to find San Diego Police officers going street by street, offering resources.  Police officers lined the streets of the East Village. They were going street by street approaching the homeless in their tents. At one point there were at least eight patrol cars on one block.  SDPD says their efforts are a part of their ongoing outreach to let the homeless know about the resources available to them in hopes of ending the cycle of homelessness.  Most of the homeless received warnings about their property blocking the street or other violations. A few were detained for previous violations. One person was arrested for an outstanding felony warrant. Two people were transported to county mental health. Officers were also letting people know about the new bathrooms installed by the city in hopes of stopping the spread of Hepatitis A.  965

SAN DIEGO (KGTV)-- It's been more than a year since the first legal cannabis transaction took place in the City of San Diego. Marijuana industry professionals gave members of the City Council an update on revenue, but also pushed for updated laws.The City if San Diego found out that going green generated green. Since San Diego voters approved of Measure N or the Cannabis Business Tax in 2016, the City’s general fund has increased by .3 million. It's the culmination of a 5% tax from the 14 legal pot shops within the city in 2018.Dallin Young with the Association of Cannabis professionals also updated Council members that crime numbers around marijuana establishments are close to none. However, Young also expressed the industry's hopes for updated city rules. He said the permits are a massive hurdle for pot shop operators. As it stands now, both public retailers and harvesting facilities are only permitted in areas one thousand feet from parks, schools, and churches, 100 feet away from residential areas, and they must be in industrial zones. “Those properties are a little more expensive, they’re off the beaten path, and there are not many available," Young said. Because of these strict rules, Young said future operators struggle to open. More people are applying for permits than what the city has made available. He said the supply and demand for marijuana facilities in the city of San Diego do not align. “We’re just asking for this business and industry to be treated like any other business when it comes to commercial sales," Young said.The industry is also asking the city to consider a place for customers to use their products. Now, people can only smoke pot products if they own their home, or if their lease allows for pot smoking. That is why Young is suggesting the city to approve the opening of a pot version of a hookah bar.“[We are asking for] Consumption at these retail locations or a separate use like a cigar bar or more like a tasting room for a brewery,” Young said.Lastly, Young is hoping the city extends the operating hours for pot shops to match the State's. Currently, the city only allows pot shops to operate between 7 am and 9 pm. The State of California allows for sales between 6 am and 9 pm.“We want to make sure that this industry is thriving and it does well. So if it’s one extra hour, that’d be great," Young said. Young understands that changing rules for a new industry is not easy. But he is hopeful with small changes, it will shift the industry away from illegal sales."I think a lot of people would rather go to a licensed facility than to someone down the street," Young said. 2650
