SAN DIEGO (KGTV) — The heads of several of California's major theme parks voiced their disapproval on Wednesday with California's recently release theme park guidance. Members of the California Attractions and Parks Association called the reopening guidance unfair and unreasonable, adding that it will only keep parks closed for the foreseeable future.Leaders said legal action against California isn't off the table and they want state officials to reconsider the lasting negative effects of keeping parks closed.RELATED: California health officials release guidance for reopening theme parks, pro sporting eventsKaren Irwin, president of Universal Studios Hollywood; Kurt Stocks, president of LEGOLAND California; Raffi Kaprelyan, regional vice president of Knott's Berry Farm operator Cedar Fair; Ken Potrock, president of Disneyland; and Don McCoy, president of Six Flags Magic Mountain, were all in attendance for the virtual press conference."Theme parks create a 100% controlled environment, with temperature checks for all guests, mask enforcement, increased sanitization protocols, social distancing, measures that far exceed most daily life experiences in any other leisure activities," said Stocks.Tuesday, the state released the metrics that would allow theme parks to reopen in some capacity since being shuttered by the coronavirus pandemic. The state’s guidance for theme parks allows smaller theme parks to resume operations in the state's third reopening tier (moderate/orange) with a limited capacity of 25% or 500 visitors, whichever is fewer; only outdoor attractions; and ticket sales limited to visitors in the same county. All theme parks may resume operations in the state's fifth tier (yellow/minimal) with a limited capacity of 25%. Any open theme parks must implement a reservations system, screen guests for COVID-19 symptoms, and require face coverings throughout the park unless eating or drinking. In a statement Wednesday, Dr. Mark Ghaly, California Health and Human Services Secretary, said the rules are intentionally slow and stringent to stop the coronavirus spread."Theme parks are a high-risk setting where large scale, random mixing occurs. Theme parks draw regional, national and international attendees that may spend days mixing with others outside their own household," said Ghaly. "The state's public health guidelines have always been driven by data and science. This will continue. As the data evolves and science evolves we will update the guidelines and Blueprint accordingly as we did yesterday to allow all personal care services to operate statewide with modifications." 2627

SAN DIEGO (KGTV) -- The former Imperial Beach man convicted of molesting and strangling two young boys in 1993 has died of coronavirus, the California Department of Corrections and Rehabilitation said. Scott Thomas Erskine, 57, was sentenced to death in San Diego County in 2004 for the first-degree murders of 9-year-old Jonathan Sellers and 13-year-old Charles Keever. The California Department of Corrections said Erskine died from complications due to the virus at an outside hospital. He was on death row at San Quentin. Both Sellers and Keever disappeared while on a bicycle ride near their South Bay homes. Erskine lured the victims to an igloo-shaped “fort” of brush before molesting and strangling them.In March of 2001, Erskine was serving a 70-year sentence for raping a San Diego woman when newly-tested DNA linked him to the murder of the boys.Erskine also pleaded guilty to a second-degree murder for the Florida slaying of 26-year-old Renee Baker. He was sentenced to life without parole for that murder.City News Service contributed to this report. 1072

SAN DIEGO (KGTV) - The International Olympic Committee and Japanese government made an historic announcement Tuesday to postpone the 2020 summer Olympic games in Tokyo due to the coronavirus.Tuesday, Japanese Prime Minister Shinzo Abe confirmed on Twitter that the Tokyo Olympic and Paralympic games have been delayed until no later than summer 2021.The announcement left several San Diegan Olympic hopefuls dashed of any immediate Olympic dreams."It's kind of hard to wrap your head around it because you have been training so long for this one moment," Allison Halverson said back in Februaray. Her tone changed Tuesday."I was kind of like, 'Ok. That's good to know.' Now I can kind of refocus and figure out how to train for that," Halverson said.Swimmer Michael Chadwick says the lack of open pools is sidelining any training, making competition right now even less of a possibility."Too much has happened too quickly for us to really understand what the ramifications of it all are," Chadwick said. "We as athletes cannot expect to make a push right now, physically, it's just impossible. Especially with not having a pool open."A new date for the postponed games has not been announced. 1199

SAN DIEGO (KGTV) - The fate of a beloved torrey pine - saved from the chopping block more than seven years ago - is once again in question.Along tree-lined Long Branch Avenue, one tree has captured the hearts of Jeff Ray's family."My kids loved it.  They touch it all the time.  It's wonderful," said Ray.The towering torrey pine is believed to be about 90 years old."It signifies the beauty of nature and the history of the area," said Ray.The history includes safety concerns. In 2010, with the sidewalks buckling, city experts deemed it a safety hazard, concerned the leaning tree would fall over. Upset neighbors hired their own arborist. Eventually, the city relented, deeming the tree stabile and repairing the sidewalks.  Since then, the tree has been granted Heritage status, giving it extra protections. Still, safety concerns remain.  On Wednesday afternoon, a city advisory panel met and the city's forester told the group the tree isn't just learning. It's actually on the move."The tree has moved an inch-and-a-half in the last two-and-a-half years. The city is recommending removal of the tree based on safety," said City Forester Brian Widener. 1192
