SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' SAN DIEGO (CNS) - Violent crime in San Diego County rose in the first half of the year for the fifth consecutive year, according to a report released Tuesday by the San Diego Association of Governments. The report by SANDAG's Criminal Justice Research Division found that the mid-year number of violent crimes in the county was 5,545, up from 5,510 last year; 5,421 in 2017; 5,361 in 2016; and 5,330 in 2015. The five-year increase amounts to a 4% bump in violent crime. Reports of property crime went the opposite direction, falling from 30,447 in 2015 to 27,236 in 2019, an 11% decrease. The mid-year numbers of violent and property crimes in 2019 are vastly different from 2009, when the city received 6,256 violent crime reports and 35,204 property crime reports. Violent crime reports dropped 11.4% in that span, mainly because robbery reports fell from 1,931 to 1,411, according to the SANDAG report. Despite the overall drop in robbery reports, this year's number increased 5% compared to the same six-month period last year. Arson reports saw the largest drop from last year to this year -- falling 28% from 190 to 136 -- while homicides dropped from 40 to 38. Reported property crimes fell 22.6% from 2009 to 2019 and residential burglaries saw the biggest decrease in that time, dropping 53.9% from 4,460 to 2,054. Larceny over 0 was the only category to increase from 2009 to 2019, rising from 7,578 to 8,527. Reports of rape fell to 539 after reaching 604 at the midway point of 2018. However, numbers since 2015 may be somewhat deceiving, as California law enforcement broadened the definition of rape in 2015 to include ``male victims, sodomy, penetration with any body part or object, and no longer requires force,'' according to SANDAG Division Director of Criminal Justice Dr. Cynthia Burke. As a result, some crimes that would have been classified as aggravated assaults are now considered rapes and some crimes that would not have been considered violent crimes are now captured in these statistics, Burke said. Violent crimes include homicide, rape, robbery and aggravated assault. Property crimes include burglary, larceny and motor vehicle theft. According to the report, San Diego law enforcement has received an average of 31 reports of violent crime and 150 reports of property crime per day during 2019's first half. 2353

SAN DIEGO (KGTV) — A border officer admitted in court Wednesday to putting his hands around a person's neck and shaking them at the Calexico Port of Entry two years ago.U.S. Customs and Border Protection Officer Esaul Bello, 53, pleaded guilty to using unreasonable force on the individual while on duty in the primary vehicle lane booth at the Calexico Port of Entry on Nov. 26, 2018.U.S. Attorney Office officials say during inspection, Bello placed both of his hands around the person's neck, even though they were not resisting. Officials say Bello then shook the person.The person was applying for admission to the U.S., officials said.As part of the plea, Bello agreed to resign from his position.“This is a rare and troubling situation,” said U.S. Attorney Robert Brewer. “We will always move swiftly to protect the public from officers who use their power to violate another person's Constitutional rights.”Bello will be sentenced on June 2, 2020. SAN DIEGO (KGTV) - A bicyclist suffered life-threatening injuries after crashing near University of San Diego's campus.The bicyclist, identified as a 36-year-old man, was riding in the westbound bike lane along the 5600 block of Linda Vista Road at about 8:30 p.m. Friday, according to San Diego Police. Then for an unknown reason, police said the bicyclist overturned and crashed.The man was wearing a helmet at the time of the crash.He was transported to a nearby hospital with a skull fracture and several other serious injuries - which were considered life-threatening, police said.SDPD Traffic Division is investigating the cause of the crash. 661

SAN DIEGO (KGTV) -- A 16-year-old was hospitalized Saturday night after being shot at a gas station in Skyline. Police say the shooting happened at an Arco station near South Meadow Brooke and Paradise Valley Road. According to police, the victim and his friends were walking through the parking lot when one of them was shot. Witnesses told police an argument broke out between the victim and three other teens when one of the three boys, who are all under the age of 18, shot the 16-year-old in the stomach before running away. The 16-year-old was taken to the hospital where he is expected to survive. 613
