Prosecutors will seek to put Nikolas Cruz to death for carrying out last month's massacre at a Parkland, Florida, high school, they announced in court filings Tuesday.A Broward County grand jury last week indicted the 19-year-old gunman on 17 counts of premeditated murder in the first degree and 17 counts of attempted murder in the first degree. In its filing, the prosecution said that, among the aggravating factors spurring its decision, were that Cruz knowingly created a risk of death for many people, his crime was aimed at hindering "any government function or the enforcement of laws" and that the shooting was "especially heinous, atrocious or cruel."Read the notice of intent for yourselfAnother factor: "The capital felony was a homicide and was committed in a cold, calculated and premeditated manner without any pretense of moral or legal justification."Cruz, through his attorneys, had previously expressed a willingness to plead guilty to avoid the death penalty.Prosecutors, in Tuesday's filing, also ask the court to put several provisions in place in the event that Cruz's defense intends to introduce documentation or testimony regarding their client's mental health. This could certainly come into play as Cruz's defense team has said he battled with mental illness and depression after his adoptive mother died. From 'broken child' to mass killerDuring a previous hearing, a public defender described him as a "deeply disturbed, emotionally broken" young man who is coming to grips with the pain he has caused. Classmates and others who knew him also described signs of mental illness, with some telling media outlets they outright predicted he might one day be a school shooter.Cruz was arrested shortly after committing the Valentine's Day killings and fleeing the Marjory Stoneman Douglas High School campus among terrified students. Seventeen students and teachers died in the shooting. The teen confessed to being the gunman, according to a probable cause affidavit released shortly after his arrest.Tuesday's news comes one day before the one-month anniversary of the mass shooting at Marjory Stoneman Douglas. On Wednesday, students across the nation intend to walk out of schools in solidarity with the Parkland students and to demand tougher gun control laws.The-CNN-Wire 2307

President-elect Joe Biden named former General Lloyd J. Austin as his nominee for secretary of defense on Wednesday. If confirmed, Austin would become the first Black person to lead the Pentagon. At a press conference in Wilmington, Delaware on Wednesday, Biden introduced Austin as a man who is "breaking down barriers and blazing a trail," adding that he is "going to do it again" if confirmed.Biden called for Austin to be confirmed "swiftly," adding that the country "needs his expertise.""It will be my sincere honor and privilege to return to the department and to lead our great service members and civilians in accomplishing the mission of ensuring our nation's security," Austin said Wednesday. He also added that he would give Biden clear and "unvarnished council" when it comes to military matters.Austin also said that he had benefitted greatly from leadership above him throughout his career, citing the influence of former Sec. of State Colin Powell, among others. In addition to needing Senate confirmation, Austin will also need a waiver, as there is seven-year waiting period after leaving the military in order to become defense secretary. Some Senate Democrats, including Sen. Elizabeth Warren, have signaled that they are hesitant to grant Austin a waiver."I would not be asking for this exception if I didn't think this moment in history called for it," Biden said.President Donald Trump's first defense secretary, James Mattis, also required such a waiver upon his nomination.Austin, a former four-star general, was the 12th head of Central Command from 2013 through 2016 under President Barack Obama.Austin followed Mattis in leading Central Command. He also served as the vice chief of staff of the Army. 1732

President-elect Joe Biden is slated to deliver remarks in defense of the Affordable Care Act (ACA) on Tuesday — the same day the Supreme Court is slated to hear arguments in a case that could effectively strike down the law.Biden, who was serving as Vice President in the Obama Administration when the landmark legislation passed in 2010, has promised to build upon and improve the public health care system set up by the ACA.Biden faces an uphill battle in enacting legislation on the Senate, where Democrats must win two runoff races in Georgia in January in order to control the chamber. But because Republicans rushed to confirm Justice Amy Coney Barrett to the high court prior to the election, conservatives now hold a 6-3 advantage — and there's a chance the ACA may not even survive long enough for Biden to make changes to the law.The case, brought by several conservative states and the Trump administration, asserts that one of the law's most controversial items — the individual mandate — is unconstitutional. The individual mandate required all Americans to be covered by insurance or pay a penalty tax. In 2019, Trump signed a law that removed the individual mandate, allowing conservative states like Texas, to set the penalty rate to RAMONA (KGTV)- Myrtle the coyote is recovering at The Fund for the Animals Wildlife Center in Ramona, after the Rancho Bernardo neighborhood came together to help.Katie Ryan has been watching Myrtle the coyote for years, and sounded the alarm when she first saw the new mother ensnared in a pipe. Katie guessed Myrtle was trying to capture a small animal that hid in the pipe and she got stuck. It took five weeks of constant phone calls, prayers and sleepless nights looking after Myrtle before she could get a trapper to catch the elusive coyote."I can't even describe I was crying and laughing all at the same time," Ryan said, her smile wide. She enlisted neighbors to block off the area, after a failed attempt Monday night due to a man trying to approach Myrtle and scaring her off.Neighbors said they guarded the neighborhood for hours Tuesday evening, going home with no hope. Then, a few minutes later, Myrtle followed a trail of rotisserie chicken and was caught in a trap around 8:30p.m.The Fund for the Animals Wildlife Center picked up the coyote that night and sent this statement. 1118. Those states now argue that because the individual mandate is not raising revenue, it makes the law unconstitutional. The Supreme Court is expected to issue a ruling on the case early in early summer.Biden's remarks on Tuesday come a day after he met with his newly-appointed COVID-19 advisory board — a group that will provide guidance to Biden's transition team about the pandemic. During his address on Monday, Biden stressed that the U.S. will face "a very dark winter," but added there are steps everyone can take to slow the spread of the virus."I implore you, wear a mask. A mask is not a political statement," Biden said.Biden's remarks about the Affordable Care Act are scheduled to take place at 2 p.m. ET. 1975
