SACRAMENTO, Calif. (KGTV) -- Governor Gavin Newsom declared a statewide emergency Sunday as nearly 200,000 people flee their homes amid wildfires. The Kincade Fire in Sonoma County has burned more than 30,000 acres as it threatens hundreds of structures. The blaze started Wednesday night and, as of Sunday afternoon, was only 10 percent contained. SAN DIEGO (CNS and KGTV) - A San Diego County Superior Court judge ruled Monday in favor of conditional release for a sexually violent predator known as the "Bolder than Most'' rapist.Judge David M. Gill made the controversial decision for Alvin Ray Quarles, 56.Some of those who were in the courtroom when the decision was announced were visibly upset, 10News reporter Jon Horn said. One person yelled, others were in tears.Last fall, Gill ordered that Quarles be released, a decision that prosecutors, along with county Supervisor Dianne Jacob, requested Gill reconsider. Since that time, the agreement to rent the residence in Jacumba Hot Springs has fallen through, and Gill allowed for further argument toward a possible reconsideration of his decision to release Quarles. Gill heard testimony during a closed-door evidentiary hearing last week, which was kept under wraps due to privacy concerns over the potential disclosure of Quarles' psychiatric reports. Quarles' victims and their supporters have argued against the order to keep the hearings private, including by staging a protest on the steps of the downtown San Diego courthouse where the hearings were held. Quarles was dubbed the "Bolder than Most'' rapist because of the way he attacked his victims, at knifepoint, sometimes forcing the women's husbands or boyfriends to watch. He pleaded guilty in 1989 to committing more than a dozen sexual assaults in the mid-to-late 1980s and was sentenced to 50 years in prison.Prior to Quarles' release from prison, the District Attorney's Office filed a petition to have him civilly committed as a sexually violent predator. In 2014, Quarles was committed to the Department of State Hospitals to undergo sex offender treatment. In September 2016, Quarles petitioned the court to be granted release through the Conditional Release Program for sex offenders.Quarles will return to the hospital where he has been held until it's determined where he will be placed. SAN DIEGO — It appears the Congressional seat vacated by Republican Duncan Hunter will remain in Republican hands, according a new scientific poll.The ABC-10 Union-Tribune scientific poll shows Republican Darrell Issa leading Democrat Ammar Campa-Najjar 51 percent to 40 percent, with 9 percent undecided. The poll, released Tuesday, has a margin of error of 5.7 points. It comes after the two prior polls showed the candidates in a virtual tie for the 50th Congressional District, which comprises most of East County and stretches into southern Riverside County. The shift came because independents moved to support Issa. Last month, the poll showed Campa-Najjar leading Issa in independents by 13 points. Tuesday's poll showed a major swing, with Issa leading among independents by 14 points. That's a 27-point swing. "In the end, independents in red-leaning area tend to be more red leaning, vice versa for blue-leaning areas, and so it's not surprising that Darrell Issa, as we get closer to the election, is bringing home these independents out in East County, San Diego," said Thad Kousser, political scientist at UC San Diego.The 50th District is the county's last in which Republicans outnumber Democrats in registration, giving Issa the advantage.In an interview Tuesday, Issa said he was traveling the district from Temecula to Jamul, meeting voters with social distancing. "I think my 18 years of support for pro-business, pro-50th type voting has allowed me to whether some pretty egregious claims of, somehow, corruptness and so on," he said. Campa-Najjar declined an interview Tuesday, but released this statement: “I’m inviting voters to reach me personally at 619-721-5148. The only poll that matters is on Election Day, and CA-50 voters have defied the odds time and time again. Darrell Issa is trying to buy and lie his way back to Congress. But CA-50 voters know me, I’ve spent the last four years listening to their needs. And I know that in one week, voters will show the world what I’ve seen over the past four years.”In response to that statement, Issa said, "It's a statement of somebody who is way behind in the polls, not likely to win, and somebody who spent more money and went negative claiming that, somehow, I was unfit from day one."SurveyUSA polled 538 likely voters in the district from Oct. 22 to Oct. 26. 2348

  

SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. That is abundantly clear, and frankly, I think it's also clear that he wanted and needed an emotional relationship with her. But the sex was not her idea; the sex was his idea," Rogers said. "He was the grown-up and it was his responsibility not to do that." 3129

  

SAN DIEGO (CNS) - A drunken driver who crashed into a Lyft vehicle at high speed on state Route 163 in Balboa Park -- killing one passenger and injuring the other two occupants -- pleaded guilty Wednesday to gross vehicular manslaughter while intoxicated and DUI causing injury. Alondra Selena Marquez, 22, of San Diego, faces up to 13 years and four months in prison, with sentencing slated for Sept. 24 at the downtown San Diego courthouse. Prosecutors say Marquez had a .25 percent blood alcohol content -- more than three times the legal limit -- at the time of the March 23 crash that killed San Francisco resident Giao Pham. RELATED: 1 dead, 3 injured in crash along SR-163Pham, 40, was in San Diego to attend a wedding when the vehicle he was riding in was struck from behind by Marquez's car about 2:30 a.m. on SR 163 near Laurel Street. Deputy District Attorney Cally Bright said Marquez was traveling somewhere between 101 and 108 miles per hour at the time. The other passenger -- Pham's friend, Andy Lynn -- was hospitalized with a traumatic brain injury, which still affects him to this day, the prosecutor said. The Lyft driver suffered minor injuries in the crash, but has had to seek counseling due to the emotional after-effects of the crash, according to Bright. 1289
