I would ask that you reserve judgment or comment on this case until you actually see the evidence presented by the parties.In the event that you will not, I understand that a person unfamiliar with most of the facts in this case, and a person unfamiliar with the obligations that individuals are under when they give deposition testimony, might perceive Mr. Ryan’s statement as noteworthy. It is not. First, as I doubt you’re aware, Mr. Evans himself has testified – unequivocally and under oath – that Mr. Ryan is not racist and was his friend; so whatever point Mr. Evans is trying to make by leaking deposition testimony to you is undone by his own words. Second, this testimony is not Founders’ defense in this case as you allege. Founders evaluated and decided to terminate Mr. Evans based only on his job performance. Mr. Evans’ poor job performance will be apparent when Founders files its upcoming motion. Third, through this testimony, Mr. Ryan was simply saying that he does not assume anything about individuals’ race or ethnicity unless they tell him that information. While it might be acceptable to speculate about this type of thing in casual conversation, Mr. Ryan was not having a casual conversation. He was under oath when he made these statements. As all deponents are instructed, Mr. Ryan was directed not to guess, assume or speculate in his deposition. This is the reason for his answer.The fact that Mr. Evans is selectively leaking this type of information to you indicates that, unlike Founders, he has no evidence to support his position in this case. Police are investigating the fatal shooting of a 2-year-old girl at a hotel in Wickliffe, Ohio on Friday night.The shooting happened around 11 p.m. at the Econo Lodge Wickliffe-Cleveland East, 28611 Euclid Ave. Police said it appears the child's mother was handling a gun when it went off and the 2-year-old girl was shot in the chest.The mother initially told the 911 operator the gun's safety was off, but a few seconds later said the safety was on when she dropped the weapon."The safety was on when I dropped the gun and the bullet shot her. The gun dropped, I dropped my gun," the mother told the 911 operator. "She's gone. My baby's gone. She's not breathing at all. She's gone."The child was taken to a nearby hospital but later died from the injury, according to authorities.Police said the shooting appears to be accidental. The mother had the weapon legally and had a concealed carry permit. It will be left up to the Lake County Crime Lab and the prosecutor's office to determine if any charges are filed, police said. 1062

(KGTV) — An auto theft suspect barricaded himself in an SUV at a South Bay motel, prompting a seven-hour SWAT standoff Thursday.SWAT officers surrounded the SUV in the E-Z 8 Motel on Outer Rd. at around 9 a.m. in the Palm City neighborhood, near Otay Mesa West.About 4 p.m., the suspect surrendered with his hands up.The suspect, identified as a man in his late 20s or early 30s, was the suspect of auto thefts in the South Bay and has a criminal history in the National City area, according to San Diego Police. Police had previously told 10News the man was a hit-and-run suspect.National City Police responded to the motel Thursday morning waiting for the suspect to exit, according to SDPD. The suspect and his girlfriend got into the parked SUV. When police surrounded the pair, the woman surrendered but the suspect did not. She was not arrested, police told 10News.Police initially believed the suspect was armed, they're continuing to search his motel room and vehicle for the gun. 1015
