LANCASTER, Calif. — A 37-year-old man who was being treated for COVID-19 is accused of killing his 82-year-old hospital roommate while the elderly man was praying.Investigators with the Los Angeles County Sheriff’s Department say the younger man, identified as Jesse Martinez, is facing charges of murder with a hate crime enhancement and elder abuse.Martinez and the 82-year-old victim were housed in a two-person room together at Antelope Valley Hospital on December 17 when the attack happened. Both were receiving treatment for COVID-19 symptoms.“The suspect became upset when the victim started to pray. He then struck the victim with an oxygen tank,” reads a statement from the sheriff’s department.The older man died from his injuries the next day. Investigators say the two men did not know each other.Martinez is scheduled to appear in court at the end of the month. 883

LA MESA, Calif (KGTV) - According to the California Department of Public Health, seven deficiencies were issued after an investigation of Sharp Grossmont Hospital. In April state investigators conducted a survey consisting of 14 closed medical records. According to the investigator's findings documented in a statement of deficiencies and plan of correction report, "Hospital leadership did not provide notification of a potential investigation and the use of video recording during medical treatment without patient's consent." Investigators also noted deficiencies with regulations related to medical staff accountability, patient's rights, and use of restraint or seclusion. According to the state document, "The patient has the right to personal privacy. This Statute is not met as evidenced by: Based on interview and record review, the hospital failed to ensure the privacy of all patients undergoing medical treatment in the WHC (women's health center) ORs (operating rooms) when the hospital's Admission Agreement for Inpatient and Outpatient Services was utilized as consent to allow video recording during medical treatment. Also, the Admission Agreement did not allow the patients' the option to acknowledge and/or decline video recording. As a result, the hospital leadership allowed video recording of patients undergoing medical treatment without knowledge or consent." The deficiencies listed fall under violations to conditions of participation for a hospital as listed in title 42 of the federal code of regulations.   A deficiency is a violation of a federal or state law or regulation that the California Department of Public Health cites during a survey or investigation.Officials with the California Department of Public Health tell 10News issuing deficiencies is a form of enforcement action. It requires the facility to submit a Plans of Correction to fix any violations. According to Sharp officials, in 2012 they were alerted that beginning in 2011, potentially powerful drugs and equipment were missing from the anesthesia cart in each of Sharp Grossmont Hospital's three Women's Center operating rooms. The hospital installed a computer monitor with a motion-activated camera in each of the three Women's Center operating rooms. Between July 2012 and June 2013, the videos were recorded. The hospital says the cameras were intended to record only individuals in front of the anesthesia carts. In a statement to 10News, a spokesperson for Sharp wrote:"In their survey, the California Department of Public Health (CDPH) identified areas where opportunities for improvement existed. The hospital addressed each area of concern and created a plan of correction for those findings. Both CDPH and the Centers for Medicare & Medicaid Services (CMS) accepted Sharp Grossmont’s plan of correction, as confirmed in a follow-up survey. The hospital’s plan of correction provides that:The specific techniques used in the 2012-13 investigation have not been used since and will not be used for any future investigations.Any potential future investigations are required to strictly adhere to Sharp’s policies and procedures;Medical staff will be kept informed of any similar future investigations that may occur;Patients will receive full disclosure of any future investigations that may affect their privacy;The patient grievance practices have been strengthened to ensure patient complaints and grievances are appropriately and efficiently managed; andAdditional measures are in place to safeguard against the inadvertent release of patient information to third parties. Staff and clinicians have been educated on the hospital’s plan of correction and policies. While we are pleased that CDPH and CMS accepted our plan of correction, we regret that the investigation inadvertently recorded patients and may have caused distress to those we serve."More than 400 women who claim they were secretly recorded are suing the hospital.Court records show a hearing is scheduled in September. 4026

LAS VEGAS — A Las Vegas leader wants the city's airport renamed amid a wave of racial unrest and calls for removing brands, tributes and other items with racially-charged origins.McCarran International Airport, located next to the heart of the Las Vegas Strip, is arguably one of the most prominent places in Southern Nevada.In 1948 it was named for Sen. Patrick McCarran, a powerhouse in both state and national politics.McCarran represented Nevada from 1933 until his death in 1954 in Washington, D.C.During his time in public office, he was considered one of the biggest supporters of aviation, which was still getting off the ground in the 1930s, and sponsored key legislation that helped shape the modern air travel industry.However, historians have pointed out that McCarran's legacy is marred by racism, xenophobia and antisemitism."Pat McCarran was an evil man," Clark County Commissioner Tick Segerblom said.Segerblom wants to scrub McCarran's name from the airport and introduced a bill in the Nevada Legislature in 2017 to do just that."To have the first thing when you come to Nevada (be) McCarran Airport — when you look at his history, that's just unacceptable," Segerblom said.Segerblom wanted to rename the airport for longtime Nevada Sen. Harry Reid (D), but the bill ultimately failed."First off, I want to get rid of the name, but secondly, I want to honor Sen. Reid, he is really the father of modern Nevada," Segerblom said.There was push back, and Segerblom says he believes opponents felt using Reid's name as a replacement was too politically partisan."Our kids grow up hearing about McCarran airport; they don't know what that its, but they don't realize we are honoring somebody who didn't believe I should even be a citizen or have the right to vote, that's wrong," Segerblom said.Critics who are opposed to renaming the airport say McCarran was a critical part of history, and attempting to scrub his name from Las Vegas will not change that. LA JOLLA, Calif. (KGTV) - People from all over the world come to La Jolla Cove for its beauty, its water and to get an up-close look at the seals and sea lions living on the rocks. The two eyesores they don't come to see, however, are impossible to miss. "I suddenly turned around and saw these two structures and said, 'whoa! How'd that happen?" said Rich Heleniak, who was visiting the Cove on a recent Friday. Heleniak was referring to cottages called Red Roost and Red Rest. Built in 1894, they are the oldest structures still on their original location in La Jolla. At first glance, it's easy to see they have been crumbling for decades."They've been vandalized over the years, bricks have been thrown, there was an arson fire," said Corey Levitan, a journalist for the La Jolla Light newspaper who has tracked the cottages for years. The cottages were designated historic in 1976, meaning former owner Jack Heimburge could not redevelop them into apartments. Instead, he neglected them until his death in 1998. Heimburge also owned the La Jolla Cove Hotel and Suites next door, so his motivation to ignore them was up for debate. "There was never enough money to take care of the cottages properly," Levitan said. "Then again, this guy owned the hotel, I think there was enough money to take care of the cottages properly."In his will, Heimburge split the ownership of the cottage among his heirs.A multi-year legal battle over what to do with them settled in 2018, clearing a key road block to revamping the cottages. "Take the original structure and rebuild the outside, and they've got carte blanche on the inside to do whatever they want, right?" said Catherine Oborne, a tourist who stopped to see the cottages. The parent company of Cove Properties Inc., which also owns the Cove Hotel and Suites next door, did not return messages seeking comment.The group has retained La Jolla architect Alcorn Benton to design the project. The firm declined to comment, saying the owner is currently reviewing the alternatives and that the schedule is not yet finalized. The cottages were originally called the Neptune Bungalows.
