TALLAHASSEE, Fla. — A Florida judge sided with a state teacher's union Monday in ruling that the Florida Department of Education could not require all brick and mortar schools to open by the end of the month or lose funding.Leon County Circuit Judge Charles Dodson ruled in favor of the Florida Education Association (FEA), in a lawsuit meant to stop the Education Department's order that would require all schools in the state to reopen for in-person classes by Aug. 31 or face loss of funding. The union filed their lawsuit shortly after the mandate was issued on July 6, claiming the order was in violation of the constitution's safe and secure public education guarantee.The FEA said Monday's ruling is a victory for schools all around the state of Florida."It is a pushback on reckless disregard on human life," said Randi Weingarten, the president of the American Federation of Teachers. "It is a pushback on politics overtaking safety and the science and the well being of communities."Fred Piccolo, a spokesperson for the governor's office, said the state intended to appeal the ruling."We intend to appeal this ruling and are confident in our position and in the authority of the Commissioner and the Governor to do what is best for our students," Piccolo said.The legal team for the FEA says the state can appeal, which would mean an automatic stay in the ruling given Monday. Starbucks opened the first of its fancy new Reserve stores Tuesday, as it continues battle competition from upscale coffee brands like Blue Bottle and Intelligentsia.The company said the store, which debuted inside its Seattle headquarters, is the first of 1,000 planned Reserve stores.Starbucks described the store concept as "an open, marketplace style" with a Princi bakery counter, a full liquor bar and a Reserve coffee bar, with tables, lounge areas and two fireplaces."Our Reserve store takes the best of coffee craft as well as artisan baking and layers in a marketplace-style customer experience creating a space that has both energy and moments of intimacy," said Liz Muller, senior vice president of Creative, Global Design & Innovation at Starbucks, in a statement.The company said the new products at the Seattle Reserve store include the Nitro Draft Latte, Spiced Ginger Cold Brew and an espresso drink called Bianco Mocha.Starbucks said that its Reserve rollout, which has been in the works since 2016, will also include 20 to 30 new Roasteries, with locations planned for Milan and New York this year, and in Tokyo and Chicago next year. STUART, Florida — A 29-year-old teacher at Stuart Middle School was arrested Thursday night and charged with sexual battery after incidents with a 13-year-old girl at the school.According to a Martin County Sheriff's Office report, the investigation began when a school resource was alerted on March 27 regarding suspicious behavior involving a seventh-grade math teacher.The teacher, later identified as Jeffrey Tomasulo, was accused of tickling several female students, causing them to feel uncomfortable.Detectives interviewed the girls, who said they were tickled on their stomachs, thighs and armpits. Surveillance video taken outside of Tomasulo's classroom during first period on March 20 showed a 13-year-old seventh-grade girl knocking on his door. At that time, Tomasulo has a planning period and not teaching a class.Video showed the girl entering his classroom 9:15 a.m. At 9:17 a.m., video shows Tomasulo opening the door and checking the outside handle of the door. The girl then leaves the room with Tomasulo at 9:27 a.m. On March 28, the girl's mother was interviewed by a detective. The woman said that her daughter admitted to performing oral sex on Tomasulo in his classroom.The girl told the detective and a state attorney victim advocate that the teacher asked her "creepy" questions about her virginity.She said Tomasulo asked her to stay longer after class and occasionally come to his classroom either during first or last period. The teen said she felt pressured by him and that's why she performed oral sex on him approximately five times from January 4 to March 20.At first, Tomasulo denied any sexual involvement with the girl but did say he was alone with her on several occasions to tutor her.He admitted to watching pornography in his classroom but said he was alone. Eventually, Tomasulo told detectives that the girl performed oral sex on him while alone his classroom.    Tomasulo was charged with sexual battery/custodial authority. He made his first appearance in court Friday morning where his bond was set at 0,000. TEMECULA, Calif. (KGTV) - U.S. Border Patrol agents arrested a man Sunday on suspicion of smuggling more than 143 pounds of methamphetamine on Interstate 15 in Temecula. Agents pulled over the Ford F-150 near the Border Patrol checkpoint at 9:15 p.m. A K-9 unit alerted agents during an exterior search. A secondary inspection led to the discovery of 33 bundles of meth inside the wood paneling, officials said. The drugs had an estimated street value of 0,640.
