SAN DIEGO (KGTV) -- The family of Kimberly Fattorini is suing former San Diego Chargers linebacker Shawne Merriman in connection with her fatal overdose, according to a TMZ Sports report.Fattorini's parents claim Merriman drugged and assaulted their daughter before she died at a house party in 2017, the report says.In a statement, Merriman's representatives said they are unaware of the lawsuit and that the original police investigation found no wrongdoing by the former NFL star.Her parents say Fattorini and her friends were invited to a club promoter's house party, and that Merriman "was allegedly witnessed carrying a bottle with some sort of liquid inside."At some point during the party, she texted the promoter saying, "you friend just poor'd half G in my drink," the lawsuit says. Her "parents believe G refers to GHB," the TMZ report says.Per the report, Fattorini's parents claim that first responders found her unresponsive and "half naked with jeans unzipped and buttoned" at a party in Los Angeles. A preliminary autopsy listed her death caused by a lethal cocktail of alcohol, cocaine, and gamma-hydroxybutyrate -- the last more commonly known as the "date rape" drug GHB.The suit alleges that while her autopsy did not reveal foul play, "a test for sexual assault wasn't done because officials said it wasn't conducted at the time of the initial autopsy, and couldn't be done properly afterward," the report says.The "complaint claims negligence, battery and a violation of the drug dealer liability act," and the Fattorinis are seeking damages, TMZ Sports reports.Merriman's representative told TMZ, "As of right now Shawne, nor his attorney, have any knowledge of him being named in any lawsuit. SAN DIEGO (KGTV) — The door-to-door salesman accused of taking swings at a Pacific Beach woman and a string of threatening outbursts while canvassing neighborhoods is behind bars.An arrest warrant was issued on Dec. 6, 2019, for 45-year-old Corey Lamont Terry on felony charges of making criminal threats and attempted burglary, according to the San Diego County District Attorney’s Office. According to San Diego Police, Terry was arrested by Sheriff's deputies on Jan. 9. SAN DIEGO (KGTV) — The new community plan for Kearny Mesa, given final approval by the City Council earlier this week, takes effect Friday. Several properties are being rezoned with 27,000 new housing units planned for those parcels.“My vision is that within five years, you’ll be able to live on Convoy, enjoy the restaurants and the shops that are on Convoy, and work in a job in Kearny Mesa, all in one community," City Councilmember Chris Cate, who represents the area, told ABC 10News ahead of the final vote.Cate says the city is trying to encourage a"live-work" village concept for many San Diego neighborhoods, especially those that are major job centers, such as Kearny Mesa. The idea is that by creating housing and recreational possibilities in the same communities where people work, they will have to commute less. That has numerous benefits across the city, including less traffic and car pollution.It is anticipated that many of the new projects will replace aging strip malls whose parking lots remain vacant much of the time. Cate hopes the areas around Convoy St., Clairemont Mesa Blvd., and Aero Dr. will become similar to the feel of Little Italy.Because parameters have already been set for how many homes will go onto each affected parcel, as well as other necessities such as pathways, street improvements, and parks, there will not be the same drawn-out approval process that has been seen with other recent attempts at development. Cate says that means developers who acquire the land will be able to move quickly, as long as their design stays within the parameters of the community plan. “They already have an understanding of what these projects will look like, what’s required of them, where different pathways or parks will go. SAN DIEGO (KGTV) — The County Board of Supervisors voted Tuesday to send a letter to Gov. Gavin Newsom requesting they be allowed to reopen the local economy.The board voted 4-1, with Supervisor Nathan Fletcher voting "no," to take further steps into reopening amid the coronavirus pandemic.
