(CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. McDavid faces 50 years to life behind bars, and Lovejoy could be sentenced to 25 years to life.After court, the jury foreperson, Erin Reed,  told reporters the defense version of the shooting "seemed too far-fetched." 2224

(KGTV) — A double shooting in North County has left one woman dead and a man hospitalized Saturday.A caller reported two people suffering from gunshot wounds, one was not breathing, at a home in the 1800 block of Hartwright Road just before 7 a.m., according to San Diego County Sheriff's Department.Deputies and Vista Fire personnel arrived to find one woman with a traumatic gunshot wound. She was pronounced dead at the scene. A man suffering from a suspected gunshot wound was transported to a nearby hospital with "severe" injuries, deputies say. Deputies said his prognosis is unknown.The San Diego County Medical Examiner has not released the identity of the woman pending family notification. WASHINGTON — The Justice Department is suing Walmart, alleging the company unlawfully dispensed controlled substances through its pharmacies, helping to fuel the opioid crisis in America. That's according to a person familiar with the matter who spoke to The Associated Press on Tuesday. The person says the civil complaint points to the role Walmart’s pharmacies may have played in the crisis by filling opioid prescriptions and by unlawfully distributing controlled substances to the pharmacies during the height of the opioid crisis. The lawsuit claims Walmart wanted to boost profits and pressured employees to fill prescriptions quickly, according to the Wall Street Journal. “Walmart knew that its distribution centers were using an inadequate system for detecting and reporting suspicious orders,” said Jason Dunn, the U.S. attorney in Colorado. “As a result of this inadequate system, for years Walmart reported virtually no suspicious orders at all. In other words, Walmart’s pharmacies ordered opioids in a way that went essentially unmonitored and unregulated.”Walmart operates more than 5,000 pharmacies in its stores around the country. The Justice Department’s action comes nearly two months after Walmart filed its own preemptive suit against the federal government. Walmart's lawsuit at the time claimed the Justice Department and Drug Enforcement Administration were trying to scapegoat the store for what Walmart says are the federal government's own regulation shortcomings, according to the Wall Street Journal. WASHINGTON - President Trump signed 4 executive orders Friday afternoon which all aim to lower the cost of prescription drugs for Americans.The first executive order will require medical facilities to pass along discounts they receive on insulin and EpiPens to consumers. The second order will allow for the importation of prescription drugs from Canada and other countries.The third order aims to eliminate the "middle man" in prescription drug sales. "Nobody even knows who they are. But the middle men are making a fortune,” President Trump said Friday.The fourth executive order strives to bring Medicare’s drug prices more in-line with prices in other countries.Florida's Governor, Ron DeSantis, joined the press conference, along with administration representatives and Americans who have diabetes and other medical conditions.During Friday's event, President Trump said he and his administration has secured 90 percent of the world's supply of remdesivir, which has proven to be a reliable treatment option for Covid-19. These efforts were initially announced in early July by the U.S. Department of Health and Human Services.Reducing drug prices has been an ongoing effort of the Trump administration. In 2018, the president signed two pieces of legislation into law on Wednesday that aimed to inform consumers about drug prices.Both measures, the Know the Lowest Price Act and the Patient Right to Know Drug Prices Act, aim to end the drug industry's so-called gag orders of pharmacists, which prevent them from discussing cheaper price options with consumers.In 2019, A federal judge nixed a regulation that was a centerpiece of the Trump administration's efforts to bring down drug prices.US District Judge Amit Mehta of the District of Columbia vacated the Department of Health and Human Services' rule that would have required drug makers to include their list prices in TV ads, saying the agency had overstepped its authority."No matter how vexing the problem of spiraling drug costs may be, HHS cannot do more than what Congress has authorized," Mehta wrote at the time of the ruling in July 2019. "The responsibility rests with Congress to act in the first instance."President Donald Trump has been unable to land the big deal with Congress to curb drug costs.Democrats, including Joe Biden, are pushing a much more ambitious plan to empower Medicare to negotiate prices.Friday's orders come at a time when the pharmaceutical industry is racing to create a Covid-19 vaccine. 2498
