SAN BERNARDINO, Calif. (KGTV) -- Prosecutors said Monday that a California man killed his business partner and his family out of greed, according to the Associated Press. Prosecutor Sean Daugherty told jurors that Charles Ray Merritt wrote checks totaling more than ,000 on his partner’s QuickBooks account after the family disappeared. The comments came during opening statements in the trial for the alleged murders of Joseph McStay, Summer McStay and their three and four-year-old sons. Prosecutors also say that, while being questioned about the family’s disappearance just days after they went missing, Merritt kept referring to Joseph in the past tense.Outside the courtroom, defense attorney Rajan Maline said Merritt’s livelihood depended on McStay being alive. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.RELATED: Trial set to begin in McStay family murder caseIn 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. SAN DIEGO (CNS) - A 32-year-old man is expected to survive a stab wound to the abdomen after being attacked by a suspect who rode up on a bicycle and assaulted him on a bridge in the Hillcrest community of San Diego, police said.The victim was with friends on a bridge in the 3900 block of Vermont Street when the bicyclist rode up about 9 p.m. Saturday and stabbed him once in the abdomen, said Officer Robert Heims of the San Diego Police Department.The suspect rode away southbound on the bridge. Paramedics rushed the 32-year-old man to an area hospital with non-life-threatening injuries.No description of the suspect was available. SALEM, Ore. – Oregon voted to legalize psilocybin mushrooms for therapeutic use on Tuesday.A psilocybin is a hallucinogenic chemical obtained from certain types of fresh and dried mushrooms, according to the Drug Enforcement Administration (DEA).With 81% of votes reported Wednesday morning, 55.8% of the electorate had voted to approve Oregon Measure 109, The Associated Press reports.While some states have decriminalized the so-called “magic mushrooms” or "shrooms," this measure makes Oregon the first state to legalize them.Under the measure, licensed service providers are permitted to administer psilocybin-producing mushroom and fungi products to those 21 years or older. The DEA says it’s often ingested orally, brewed as a tea or added to foods.The measure authorizes the Oregon Health Authority (OHA) to create a program to help these licensed providers to administer the products.The measure was backed by war veterans with PTSD, those with terminal illnesses and others who suffer from anxiety or depression, who claim psilocybin helps.Some opponents say science does not yet indicate that psilocybin is a safe medical treatment. 1150

SALT LAKE CITY, Utah — South Salt Lake Police officers pitched in to replace a woman's American flag after they say she used it to fight off a home intruder on Monday.According to the department, 42-year-old Justin Scott Smith attempted to break into the woman's home shortly before 9 a.m.Police say when the suspect entered the front yard through the gate and assaulted multiple people, the woman grabbed the flag pole with the flag attached to defend herself and her family members. They say she hit the suspect multiple times, breaking the pole in the process, and the victims retreated into the home.Smith kicked the door in and continued to assault everyone inside, police say, before officers arrived and took him into custody.He was arrested on suspicion of assault, aggravated assault, aggravated burglary, and criminal mischief.After the incident, police say the woman was worried about desecrating the flag because the pole had broken and the flag had hit the ground, so officers took up a collection to replace it.
