SAN DIEGO (CNS) - A San Diego judge granted a preliminary injunction Friday sought by Hall of Fame horse trainer Jerry Hollendorfer against the Del Mar Thoroughbred Club, which banned Hollendorfer from participation in the wake of a spate of horse deaths.Hollendorfer, 73, was banned last month from Del Mar and sought legal intervention to allow him to participate at this summer's racing season.He argued that Del Mar officials did not provide an adequate reason for precluding him from racing. The complaint alleges that he was notified on June 28 that he wouldn't be assigned stalls because of "PR risks and considerations."RELATED: 2 horses killed in collision during training at Del Mar RacetrackIn his written ruling, Judge Ronald F. Frazier ruled that Del Mar "arbitrarily" denied Hollendofer's stall application without providing him a hearing on the matter.In court, Frazier noted that there was no definitive link tying Hollendorfer to the horses' deaths.Thirty horses died at Santa Anita during its most recent meet that started in late December and ended in late June. Four of the those horses were under Hollendorfer's care.Hollendorfer also has been banned by the Stronach Group, which owns the Santa Anita racetrack, as well as the New York Racing Association.RELATED: Del Mar Thoroughbred Club upgrades horse safety for 2019 racing seasonJ. Christopher Jaczko, representing the Del Mar Thoroughbred Club, argued that whether or not Hollendorfer could be connected to the horses' deaths, Del Mar's decision to exclude Hollendorfer was a valid business decision based on the negative publicity Hollendorfer could bring."Mr. Hollendorfer's record over the past six months in California is problematic," Jaczko said.He alleged that banning Hollendorfer was also in the interests of horse safety and not just to avoid bad publicity. However, had avoiding negative publicity been the sole reason for the ban, Jaczko contended that would be a rational business justification on Del Mar's part, particularly with the heightened scrutiny the horse racing industry is currently facing."We're not saying he did anything to kill those horses. We're saying that in the best interest of our business, we don't want the attention, we don't want the clamor that we're not doing everything we can to change business as usual," Jaczko said.Jaczko also said the ban does not cause "irreparable harm" to Hollendorfer, as he has the ability to participate in other races, including several ongoing and upcoming races in California.Talking to reporters outside the courtroom, Hollendorfer said he was "very grateful" that Frazier ruled in his favor."I've lost an awful lot of business because of this," said Hollendorfer, who was not sure when he would begin participating in the Del Mar racing season.Hollendorfer said he had confidence in his training methods, but would be open to recommendations to improve horse safety."I would guess my stable does more with horses every day than any other stable that I know of," Hollendorfer said. "We examine every horse every day from head to toe. We take them out of their stalls and jog them down the road and make sure that they're sound before we even consider taking them to the racetrack. I think that we're doing plenty to ensure the safety of our stable and if somebody else has another suggestion how to do more, than I'm certainly willing to listen to somebody's opinion on that."Hollendorfer's attorney, Drew Couto, said his record with equine fatalities was not as severe as Del Mar claimed, and laid blame to Stronach Group racetracks, identifying them as the common denominator in the deaths of horses under Hollendorfer's care."Where did (Hollendorfer) have equine fatalities? He had them at Stronach group racetracks," Couto said. "They were horribly managed in our opinion this last year and that's the cause of these issues."Couto did not make any definitive statements regarding any legal steps towards contesting Santa Anita's ban."One step at a time," Couto said. "We had to take care of this issue. They (Santa Anita) are certainly on our radar and probably next up."Another status conference in the Del Mar case is slated for Oct. 25 in Frazier's courtroom. 4226

SAN DIEGO (CNS) - A wrongful death lawsuit was filed Monday on behalf of the family of a 24-year-old woman who died last fall at the Las Colinas Detention Facility in Santee.Elisa Serna died Nov. 11, 2019, a few days after she was booked into the county jail.Earlier this year, the sheriff's department said Serna died from complications of drug abuse, with a contributing factor of early intrauterine pregnancy.The lawsuit filed in San Diego federal court alleges jail staff were aware of Serna's substance abuse and subsequent withdrawal symptoms, but did not provide her with treatment. Though Serna was fainting, had low blood pressure, was vomiting regularly and displaying odd and incoherent behavior, jail staff "ignored the obvious signs of medical distress" and "failed to provide proper medication as Elisa's condition was worsening," the complaint alleges.Sheriff's officials could not immediately be reached for comment on the suit, which names San Diego County and Sheriff Bill Gore as defendants.Plaintiffs in the suit include Serna's parents, Michael and Paloma Serna; her husband, Brandon Honeycutt, and a minor child referred to as S.H.The sheriff's department has come under fire recently over a spate of deaths among county jail inmates, which were referenced within the complaint.The lawsuit cited news reports indicating the county had the highest jail mortality rate among the state's largest counties, and said prior deaths from inmates suffering from withdrawal symptoms should have made jail staff aware of the potentially fatal consequences of those symptoms.The suit also alleges staff are inadequately trained and in-custody deaths at county jails are not being properly investigated."Even though inmates are dying or suffering catastrophic injuries at an alarming rate at San Diego County jails, the medical and correctional staff whose actions or inactions cause the deaths are not investigated; not informed of their failures; not given further training or remedial instruction; and are not monitored or closely supervised after these adverse events," the lawsuit alleges. 2111

  

SAN DIEGO (CNS) - A person at Southwestern College has tested positive for tuberculosis and may have exposed others to the disease, the San Diego County Health and Human Services Agency announced Tuesday.The agency is working with the college to notify people who were possible exposed to TB. The period of possible exposure is from last Sept. 10 through Feb. 21, according to the HHSA.Tuberculosis is transmitted from person to person through indoor air during prolonged contact with an infectious person. Most people who are exposed do not become infected."We are recommending that all the identified people get tested to make sure they are not infected," said Dr. Wilma Wooten, the county's public health officer. "Early diagnosis and prompt treatment can prevent the infectious form of the disease."The HHSA and college are reaching out to students and other members of the public who possibly interacted with the positive-testing individual. They can go to the college's Student Health Services Student Center, Room 601F, 900 Otay Lakes Road, Wednesday and Friday from 8 a.m. to 3 p.m.Affected college employees will be tested separately by Occupational Health.The infected person was not publicly identified, nor did officials specify whether it was a student or staffer.Symptoms of active tuberculosis include persistent cough, fever, night sweats and unexplained weight loss. Tuberculosis can be treated and cured with medication. People who have TB symptoms or are immuno-compromised are encouraged to see their medical health care provider to rule out TB.Tuberculosis is not uncommon in the San Diego region but has been decreasing since the early 1990s and has stabilized in recent years. In 2013, 206 cases were reported in the county, the lowest number since local TB cases peaked at 469 in 1993. There were 237 cases reported in 2017 and 226 in 2018. Last year, 265 local residents were diagnosed with TB. 1927

  

SAN DIEGO (CNS) - A man who fatally stabbed his 66-year-old uncle during an argument in their Pacific Beach condominium was sentenced Monday to 15 years to life in state prison.Randy Bautista Baisa, 39, pleaded guilty to a second-degree murder charge in connection with the 2018, killing of Merlino Bautista. Authorities said the defendant and the victim lived together.Prosecutors said Baisa -- who has significant mental health issues, according to the prosecution and defense -- stabbed his uncle 16 times, mostly in the back. One stab wound to the left arm severed an artery, the prosecutor said.Baisa previously pleaded not guilty by reason of insanity but withdrew that plea in May.RELATED: Nephew arrested, accused of stabbing uncle to death in Pacific Beach apartment complexA neighbor at The Plaza Condominiums complex on Diamond Street called 911 in the early morning hours of Jan. 17, 2018, after the mortally wounded Bautista knocked on the door asking for help.Bautista was on the ground of a second-floor hallway when officers arrived on scene and immediately began administering medical aid, police said.He was taken to Scripps Memorial Hospital in La Jolla, where doctors pronounced him dead.Police found Baisa -- who they believed stabbed Bautista inside their residence -- at the complex and arrested him. 1331
