SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. SAN DIEGO (KGTV) -- A passenger has tested positive for coronavirus on one of the first Caribbean cruises since the pandemic started. The case may push the start of cruising out of San Diego even further.On its maiden voyage since the pandemic, the SeaDream Cruiseliner has its first case of COVID-19. Travel writer Gene Sloan for “The Points Guy” is on that ship and now stuck in quarantine.“They’re going right now cabin to cabin and testing everyone on board,” said Sloan.The ship with 53 passengers and 66 crew set sail from Barbados on Saturday. Sloan says everyone got tested before getting on board and the trip was going well until the captain made an announcement Wednesday that someone had tested positive.All passengers were instructed to self-isolate in their staterooms.The CDC’s “No Sail Order” for ships in the United States expired Oct. 30. SAN DIEGO (KGTV) — A popular North Park concert venue has agreed to pay ,000 worth of fines and reimburse the City of San Diego ,000 in police investigation costs.The operators of Observatory North Park agreed to pay the penalties after City Attorney Mara Elliott filed a complaint against the venue on July 3. The complaint alleged the venue's operators were maintaining a public nuisance and operating without required permits. The city attorney's office added that the Observatory has become a source of local complaints for, "noise, violence, teenage drinking, public intoxication, public vomiting, and the accumulation of trash, debris, and human waste."“The Observatory has long dragged its heels on correcting violations that would protect the safety of its patrons and North Park community residents,” Elliott said in a release. “Its managers have agreed to begin following the law, and if they don’t, our Office will be there to hold them accountable.”The building also includes West Coast Tavern next door, which shares restrooms and bar areas with the theater.Between January 2015 and May 2019, San Diego Police received 174 calls to the venue, leading to 500 hours of overtime, the office said.The operators of the North Park venue agreed to address criminal activity and nuisance complaints and obtain all required permits. The venue's mezzanine and balcony will also remain closed until building permits and code violations are addressed. If the Observatory fails to comply with the terms of the agreement with the city, another 0,000 in fines will be issued, the office said.The lawsuit is the latest issue in the city's battle with the venue. SAN DIEGO (KGTV) - A possible theft ring may be 'fishing' for checks at local post offices.Kevin, who owns a small business, mailed out several checks to vendors at the post office in Poway on a Friday night. On the next Tuesday morning last month, he got a call from his bank, Wells Fargo. A woman had tried to cash a fake check at a bank in Los Angeles, a typed check for nearly ,500 written out to a woman's name from Kevin's business. The bank rejected it. The bank representative then asked him about two other checks that had just been deposited at other branches. The two fake checks - written out to a different woman for some 0 each - had been deposited for cash in the Los Angeles area."There's definitely anxiety. You don't know how much money has been compromised," said Kevin.Kevin is not alone. In April, 10news featured the story of Barbara Reynolds and her state tax check, stolen and altered after she dropped it off at post office in Mira Mesa. Her check was likely 'fished' out by thieves using a rodent glue trap, before being washed. A chemical solution dissolves away the ink, allowing a thief to fill in the blanks.Another theft victim told 10news the Postal Inspection Service supervisor described to him a possible theft ring that has hit post offices in Encinitas, Poway and Mira Mesa in recent months. 10news has also tracked down reports of similar thefts in Sorrento Valley and Rancho Bernardo."It's frustrating. Never crossed my mind that something dropped off at post office could be compromised," said Kevin. Kevin's bank did cover the loss of the fake checks. 10news reached to the Postal Inspection Service but haven't heard back.Experts say use the slots inside the post office and if you do use an outside collection box, drop off your mail before the final collection time. 1823
