SAN DIEGO (KGTV) - Fed up homeowners' associations are now turning to a local licensed private investigator for help with catching homeowners who are breaking HOA rules by renting out their homes on short-term vacation rental sites such as Airbnb, VRBO and Craigslist.  “I admittedly watched a lot of Magnum, P. I. growing up,” jokes Nick Bradley of San Diego’s Bradley Investigative Services.  In the last 6 months, Bradley has taken on a new field of investigative work. He and his associates are being hired by HOAs to investigate homeowners and tenants who are violating HOA bylaws and CC&Rs that prohibit turning units into short-term vacation rentals.   Bradley gave 10News an exclusive interview about this new area of detective work. He declined to offer us specifics about how he executes his investigations into short-term rental violators. We ask, “Do you ever pose as a guest and do you do surveillance work?” Bradley replies, “No comment.” “My initial thought was [to laugh],” says San Diego attorney Dan Zimberoff. He represents homeowners and has previously represented HOAs. Zimberoff thinks it’s an extreme measure for HOAs to hire private investigators, but he understands why there’s so much passion over short-term rentals. “I think what makes this issue a little different [from others] is the dollars at stake, especially in San Diego. Some of these units can go for multiple hundreds of dollars a night or thousands of dollars. People care,” he adds.  According to Airbnb, San Diego is the second ranking city in the state for Airbnb guests, after Los Angeles. Per Airbnb, in 2017 there were 537,000 guest arrivals in San Diego, generating 0 million in host income. “Right now, it’s too lucrative for [homeowners] to not do this,” says Bradley. The short-term rental fight in America’s finest city continues to be ugly. The city attorney has deemed short-term rentals illegal, per code. Meanwhile, the city council is delaying discussions over how to regulate them. Even so, certain HOAs have rules prohibiting them. The fines for violators can be astronomical. “It’s been ,000 per occurrence in some situations,” adds Bradley. If fines don’t work, court is another option. In 2012, The Mark condominium owners association filed a lawsuit against Thomas Stevens, a former condo owner, accusing him of violating the association’s policies about short-term rentals. He then had to pay out more than 0,000 after a judge ruled that he violated The Mark’s policies.  Bradley can help gather the evidence that HOAs need to litigate. “When [HOAs] go to court, my documentation and reporting will basically count as expert witness testimony for our side,” he says.  Zimberoff thinks it’s time for HOAs to consider allowing short-term rentals, but with reasonable and efficient regulations to curb nuisances, like excessive partying. “Instead of spending that energy trying to catch [a homeowner], let’s try to think of a long-term fix,” he adds. For more information about Bradley Investigative Services click here.For more information about Dan Zimberoff click here. 3193

SAN DIEGO (KGTV) — Every prom is memorable, but only one is truly an "Unforgettable Prom." Yet just like so many momentous occasions this year, the Unforgettable Prom had to be canceled. But its legacy lives on, touching lives 20 years later."Scott was an amazing young man. Sorry. He was very charismatic," says Carmen Delgadillo.Twenty years and Carmen Delgadillo still gets choked up talking about her son Scott. At 13, Scott Delgadillo was diagnosed with leukemia. He was determined to beat cancer because he was driven to one day attend Notre Dame, he was a fighter, and was surrounded by loyal friends who would always visit him in the hospital."Scott had a lot of friends that would come to visit, and some of the other kids did not. So, he would ask his friends, 'Hey, can you stop by and see my friend?' That's how Scott was; he brought people together," adds Carmen.Those same friends planned to take Scott to the Winter Formal that year. Unfortunately, Scott's sickness got worse, and he passed away shortly after. But his legacy was just beginning."Shortly after his passing, a nurse at Rady Children's Hospital, a nurse that took care of him, stopped me and asked if we would be interested in putting together a prom for the teenagers at Rady's Hospital," says Carmen.So, Carmen and Scott's friends got together and created the Friends of Scott Foundation. Teenagers with cancer and other illnesses, many too sick to attend their own proms, get the red-carpet treatment here at the Unforgettable Prom. Everything from the limos to the boys' tuxes, to the girls' gowns, and everything in between is taken care of for them."This is a way that they just forget about everything, and it's a free night from cancer. And we're very, very proud of this event," adds Carmen.But like most proms this year, the Unforgettable Prom had to be canceled. Instead, Carmen and the foundation are working to gather donations to create care packages for those teenagers suffering from illnesses and their families."We are providing gift cards, whether it be groceries or gas to help some of these families out during the pandemic," says a smiling Carmen.Now, 20 years later, Carmen Delgadillo and her volunteers have impacted and touched thousands of lives in the memory of her son Scott."I'd like to say how many lives have touched me," says Carmen. "Some of these kids are now parents. I've got to meet their children. They've gone on with their lives, some of these kids have gone on to college. So, all those lives that have been part of Scott and his legacy." 2566

SAN DIEGO (KGTV) - Family members of military members on the USS Bonhomme Richard set up a lemonade stand over the weekend to raise money for the Navy and Marine Corps Relief Society.Becca Kofonow and her three children set up shop on the Siver Strand Saturday morning. It's been a hard week. SAN DIEGO (KGTV) -- Friday, Gov. Gavin Newsom announced that counties can reopen schools for in-person education when the county has been off the state's watch list for 14 consecutive days.Newsom said schools that don't meet that requirement would have to start the fall school year with distance learning.Though some of California's schools will make that grade for in-person classes this fall, Newsom outlined when schools may be required to go back to distance learning:Schools should consult public health officer first if a classroom needs to go home because of a positive caseA classroom goes to distance learning if there is a confirmed caseA school goes to distance learning if multiple classrooms have cases or more than 5% of a school is positiveA district goes to distance learning if 25% of a district's schools are closed within two weeks"Our students, teachers, staff, and certainly parents, we all prefer in-classroom instruction for all the obvious reasons, social and emotional foundationally. SAN DIEGO (KGTV) — Even though many local businesses have struggled amid the pandemic and San Diego County saw an unprecedented spike in unemployment in the second quarter, there has not been a significant jump in the number of empty retail storefronts -- at least not yet.The vacancy rate in San Diego County ticked up slightly to 5.6 percent in the second quarter, according to an analysis by commercial real estate firm CBRE.Vacancies tend to be a lagging indicator. Large national chains like 24 Hour Fitness and Pier 1 Imports have announced closures in recent weeks, but the businesses are still occupying their commercial spaces. 24 Hour Fitness is closing four clubs in San Diego County. Pier 1 Imports is closing all 11 of its local stores; four of those locations have already closed.While vacancies take time, the pandemic has slowed the region’s commercial real estate market in other ways, said CBRE Associate Field Research Director Michael Combs.New leasing activity in the retail sector dropped to nearly a 10-year low in the second quarter, down nearly 50 percent from the first three months of 2020.“There just haven't been a lot of new deals as tenants especially in retail are waiting to see how this situation plays out,” he said.The slowdown in new leasing activity may be a sign that companies are holding off on plans to expand operations, since new leases with larger footprints are typically signed far in advance. 1448
