SAN DIEGO (KGTV) -- There are more concerns about vacation rentals in the Bankers Hill area, following action taken by the City Attorney’s office to shut down what they called a COVID party Airbnb on 2nd Avenue.The civil enforcement action cited concerns over gatherings during coronavirus-related restrictions and numerous other violations, from lack of permits to not obtaining proper tax licenses. According to the complaint the homeowner David Contreras Curiel, did not pay required taxes or fees to operate a vacation rental. It also alleges Curiel illegally made numerous renovations to the home.“From packing a party house during a pandemic to illegally renovating an entire property, the conduct of the defendants in this case is egregious and unacceptable,” City Attorney Mara Elliott said in a news release Friday.On Monday, ABC 10News spoke to a neighbor who lives next to another Airbnb rental on 3rd Avenue. Records show the rental is also owned by David Curiel. The home is listed as The Alfred Mansion on Airbnb’s website.“It’s disruptive every weekend,” one neighbor told ABC 10News. He did not want to be identified, but he said the parties picked up at The Alfred Mansion a few months ago.“Two weekends ago, there was a wedding there with at least 40 people. Nobody had a mask on,” the neighbor said. He added that he has made several complaints to police and the City of San Diego, but nothing had been done. He also had not heard anything from Airbnb regarding his concerns.Curiel did not return requests for comment. Early Monday afternoon, ABC 10News contacted Alex Mendez, the person who helps manage the property and deal with guests.On Monday evening, Mendez called the allegations against the Airbnb properties “unwarranted.”Regarding the city action taken against The Ashley, Mendez said that he and the owner were willing to work with the city. When he asked to reschedule a meeting with code enforcement a couple months ago due to Curiel’s travels, Mendez said the city was not willing to be flexible.Instead of a code enforcement officer calling him back, someone from the City Attorney’s office contacted him, Mendez said.He and Curiel were both caught off guard by the city’s allegations.“We, by no means, have a party house. The house rules are very strict,” Mendez said.Mendez said he has been willing to work with any neighbors who have had issues with the Airbnb properties. “We’re very responsible,” he said, adding that it is also not fair for “neighbors to complain any time there’s any little noise and mischaracterize it.”A spokesperson for the City Attorney’s office could not say whether or not the property on 3rd Avenue was being investigated, but told ABC 10News that the case against The Ashley could affect the other rentals owned by Curiel.“If granted, our injunctive relief would apply to any properties within the county owned by Mr. Curiel that have one or more of the same-type violations that are listed in our complaint,” a spokesperson said.Airbnb has not responded to this latest allegation, but previously told ABC 10News that hosts are not allowed to authorize parties where current public health orders prohibit gatherings, like in San Diego County. 3217

SAN DIEGO (KGTV) — The San Diego Padres infielder Ian Kinsler has announced his retirement from baseball.The Padres' second baseman announced his retirement after 14 seasons in the major league, team announced Friday. Kinsler, 37, will remain with the Padres as an advisor to baseball operations. According to The Athletic's Ken Rosenthal, Kinsler is still owed .25 million on his contract, which he will reportedly work out with the team.Kinsler was placed on the disabled list last August over a herniated cervical disk, which prevented him from finishing out the season. The injury played a role in his decision to leave the game.“To be honest, it was a factor in my decision,” Kinsler told The Athletic. "It just felt like this is the end, time to move on. SAN DIEGO (KGTV) - The target at the center of a murder for hire plot is suing his former business partner and his associates. Ninus Malan says, he suffers from severe emotional distress as a result of his business partners actions."I wish this would go away, but I wake up every morning, and it's there," Malan told 10News. In November, federal authorities charged Salam Razuki, Sylvia Gonzales and Elizabeth Juarez with offenses related to a conspiracy to kidnap and kill a business associate over a dispute involving real estate investment properties, most of which were leased to marijuana dispensaries.   According to a complaint filed on November 2018, in October of that year, Salam Razuki and Sylvia Gonzales met with a Confidential Human Source and asked the source to arrange to kill Malan. The complaint says according to Razuki and Gonzales, they had invested in multiple properties and business ventures together and were not involved in a civil dispute over their assets. The complaint alleges, "Razuki and Gonzales told CHS1 (confidential human source) that they wanted CHS1 to 'Shoot him in the face,' 'to take him to Mexico and have him whacked,' 'or kill him in some other way.'"Federal authorities say Elizabeth Juarez later joined Razuki and Gonzales, and the three talked about having Malan killed.The complaint says the confidential human source, Gonzales, and Juarez discussed a cost of ,000 for "the job." Federal authorities say during one of the meetings, Gonzales went to the Goldn Bloom Dispensary and returned with ,000 cash. "After the meeting, CHS1 provided agents with ,000 case provided by Gonzales," the complaint says.Federal authorities say, "according to the complaint, on November 15, 2018, the source met with Razuki and stated, 'I took care of it.'" Razuki replied, "So he will take care of it, or it's done?" The source replied, "Done." Malan told Team 10 investigator Adam Racusin that he's now forced to live his life day by day afraid for his family's safety. "My nine-year-old daughter had to see this on the news, and she knows all about it," Malan said. "I don't know how to explain it to her." Malan is suing Razuki, Gonzales, Juarez and a handful of businesses. The lawsuit alleges, interference with exercise of civil rights, unfair competition, intentional infliction of emotional distress and negligence. The lawsuit says the "defendants committed the acts herein despicably, maliciously, and oppressively, with the wrongful intention of injuring plaintiff, from an improper and evil motive amounting to malice, and with the conscious disregard of the rights and safety of Plaintiff and others." "Mr. Malan and Mr. Razuki were involved in a number of businesses together," said Malan's attorney John Gomez of Gomez Trial Attorneys. "That relationship kind of fell apart, so litigation commenced." Gomez says Razuki brought a civil suit against Malan and Malan filed a lawsuit against Razuki. "That's a big litigation involving a lot of money," Gomez said. "Mr. Razuki apparently thought it was ok to put a hit on Mr. Malan to eliminate him from the litigation." Gomez told 10News all the businesses and entities named in the lawsuit are affiliated with Razuki and participants in the litigation. "When he puts a hit on Mr. Malan to advance the litigation he's doing it on behalf of all of these businesses and people," Gomez said. With a criminal case underway, Malan was limited in what he was willing to discuss. He thanked the FBI, his family and told Team 10 investigator Adam Racusin he'll always be looking over his shoulder. "In the courts is where I'm seeking justice, not only for me but for my family who were terrorized by these people," Malan said. Criminal defense attorneys for Gonzales and Juarez have not yet responded to 10News requests for comment.Razuki's attorneys told 10News they have no comment. 4194

SAN DIEGO (KGTV) - The United States Postal Service unveiled its newest forever stamp Wednesday, honoring pioneering astronaut and UC San Diego professor Sally Ride.The ceremony, held at the UCSD campus, featured several of Ride's family and friends, including her life and business parter, Tam O'Shaughnessy, astronaut and Director of the Johnson Space Center Ellen Ochoa, and tennis legend and activist Billie Jean King.RELATED: First American woman in space to be honored with the Sally Ride Forever Stamp"It's amazing the impact and the long-lasting impact that Sally Ride's going to have," King told 10News. "And the stamp, this forever stamp, will be a big help."O'Shaughnessy revealed to 10News that Ride was a stamp collector, herself. "She just kept doing it her whole life, so she would just be so honored with this."Ride was the first American woman in space. Upon leaving NASA, she became a professor. Ride simultaneously founded a business called "Sally Ride Science", which is housed at UCSD. It is dedicated to inspiring young people in STEM.Ride died of pancreatic cancer in 2012 at age 61. 1124
