The mother of a Florida child who was punched in the face by an adult is wondering why the man was not arrested. “He was screaming at us, cursing at us, calling us the 'n-word' and he came down to the middle of his yard, and I was like 'who are you talking too,' and he said 'come within arm's reach and I'll show you who I'm talking to,'" said Malikai Villatte, the 12-year-old boy who was punched.  A picture of Malikai after the incident showed his two front teeth were knocked out. The young boy also received stitches to heal a gash on his mouth. “When I realized my teeth were dangling in my mouth it was kind of shocking, I didn't know what was going on," Malikai said. “It was like a nightmare, I just knew I had to get there and I had to get there fast," said Malikai's mother Brittany Graham. His parents are upset because the man who punched Malikai was not arrested. Lataevion Graham, 13, says he witnessed the incident and claims Cerfalo spat on them after punching Malikai. Graham's father says he wants justice for the children. “Where it is okay for an adult to take the law into their own hands, and to strike a kid hard enough to knock out his teeth. Where is that acceptable, in what country is that acceptable?" said Larry Graham. According to a Charlotte County Sheriff’s Office incident report, the man who punched Malikai was 27-year-old Vincent Cerfalo.“Originally this is where the altercation took place, right here," Cerfalo said.“I told them to back off and if they come on my property I'm going to defend myself. They said, 'you won't hit us, you won't hit us,' and they started to surround me," said Cerfalo. He says it all started when he yelled at the kids to get out of the road because they were blocking traffic.A cellphone video captured the moments after Malikai was punched. Cerfalo claims he was acting in self defense.“He touched me and I lifted my hand out, and I ended up hitting him. It was not my intention to hit anybody that hard, it was not my intention to knock teeth out or do harm, or cause any kind of trouble,” Cerfalo said. The children say no one touched Cerfalo at any time during the incident. Cerfalo says he never expected things to escalate to violence. He now plans to press charges against 12-year-old Malikai for assault, which the child’s parents can’t understand. “He's not going to jail, nothing is happening to him and he's basically getting away with it right now," Malikai said.“I want the man in jail," said Brittany Graham.  The case has been sent to the state attorney’s office, which will determine if a summons will be issued to Malikai for assault.  2750

The lawyer for one of the women suing President Donald Trump for defamation is seeking recordings of "The Apprentice" from Metro-Goldwyn-Mayer.Former "Apprentice" contestant Summer Zervos filed a lawsuit against Trump in January 2017, in which she alleged that Trump defamed her in 2016 after she said he sexually assaulted her in 2007.Her lawyer, Mariann Wang, is also seeking hotel records from the Beverly Hills Hotel."We are gathering evidence that will prove that (the) defendant lied when he falsely denigrated Ms. Zervos and denied sexually assaulting her," Wang said.MGM owns the archives of "The Apprentice" and Wang wants the company to hand over all documents, video or audio that feature Zervos or Trump talking about Zervos and any recording in which Trump speaks of women in a sexual or inappropriate manner.Zervos' attorney also wants to depose an MGM representative to inquire about how recordings of "The Apprentice" are stored and maintained, who has access to them, and when if ever they were transferred or destroyed. The subpoena asks for "(a)ll video and audio recordings that include Donald J. Trump talking or commenting on the female candidates or female potential candidates of any season of The Apprentice in any sexual or inappropriate manner, including without limitation any statements or comments by Donald J. Trump concerning any female candidate's or potential candidate's body or body parts and/or his sexual or romantic desire or intention concerning any female candidate or potential candidate."MGM declined to comment.Wang also wants records from the Beverly Hills Hotel of any stay by Trump from 2005 through 2009 and documents related to his longtime bodyguard Keith Schiller, his longtime assistant Rhona Graff or Zervos. She also asks for, "(a)ll video recordings that depict the entrances, common areas, or bungalow areas of the Beverly Hills Hotel during the month of December 2007."The communications director for the Beverly Hills Hotel, Brittany Williams, confirmed the hotel was subpoenaed."I can confirm we received a subpoena but we are not providing any further comment at this time," Williams said.Wang has set a May 31 deadline for both companies to comply with the subpoena for the material requested. The New York Times first reported on the subpoenas Wednesday.T 2322

The mayor of a California town says police are investigating after video widely shared on social media shows a woman making racist remarks about a Filipino American woman who was exercising in a local park.Patrick Furey, the mayor of Torrence, California, says the city is aware of the viral video."All visitors to our open spaces should always feel safe and free to exercise while practicing social distancing without conflict," he said, according to The Los Angeles Times. "Conduct like that displayed on the video cannot be tolerated."KABC-TV in Los Angeles adds that Furey said an investigation has been opened by police. The video was originally posted by Rachel Tennell on Twitter (@rmtennell). Tennell says the video shows her friend, who she later identified as "Sherry," being accosted by a white woman as she exercised in Torrence's Wilson Park."The next time you talk to me like that, you're going to get your a** kicked by my family. They're going to f*** you up," the woman yells as Sherry stretches."Go back to whatever f***ing Asian country you belong in," the woman later said.Tennell said that Sherry no longer feels safe working out in the park because of the incident.Later on, in her Twitter thread, Tennell shared a statement by Sherry."I never imagined my story would reach so many people, and I am happy to shed some light on the work that needs to be done in this country. As a Filipino American, I believe all people of color should be treated with humanity, dignity and respect," she wrote. "I stand in solidarity with all oppressed people who face discrimination and violence just because of their ethnicity, nationality, gender, gender-nonconformity and sexual orientation."Watch the viral video below.Warning: The video includes explicit and racist language. 1794

The National Rifle Association is setting aside years of documents related to its interactions with a Kremlin-linked banker, as the gun-rights group appears to be bracing for a possible investigation, according to sources familiar with the situation. The NRA has faced fresh scrutiny from congressional investigators about its finances and ties to Alexander Torshin, one of the 17 prominent Russian government officials the US Treasury Department recently slapped with sanctions. The gun-rights group has said it is reexamining its relationship with Torshin, who is a lifetime NRA member, in the wake of the sanctions. The renewed attention has highlighted the close-knit if sometimes uneasy alliance between top NRA officials and Torshin -- a relationship that ensnared members of Trump's team during the presidential campaign, inviting further congressional scrutiny. Those inquiries could shed light on the tightly held fundraising practices and political activities of the NRA. The political powerhouse shelled out more than million in 2016 to back Donald Trump's candidacy -- more than it spent on 2008 and 2012 political races combined, according to the Center for Responsive Politics. Vice President Mike Pence is slated to speak at the National Rifle Association's annual convention in Dallas next Friday, an official told CNN.The NRA recently found itself facing allegations that the FBI was investigating whether Torshin illegally funneled money through the group to bolster Trump, according to a McClatchy report. The NRA has publicly denied any contact from the FBI and insisted it hasn't accepted illegal donations.Despite the public denials, officials at the gun-rights group have been anxiously preparing as if they were already under investigation, sources said. Some employees have been tasked with preserving years of documents mentioning Torshin or his associate, Maria Butina, who runs a pro-guns group in Russia, a source familiar with the situation said. Privately, some officials have expressed anxiety about a potential investigation and the group's Russian ties. The NRA's precautions could be little more than due diligence as the group faces inquiries from congressional investigators and the media about its relationship with Torshin. But the feeling among some officials internally is that the group appears to be readying for an investigation."True believers to the cause are getting very antsy," said a person privy to the NRA's internal deliberations. "They were definitely preparing, they were bracing themselves."The NRA declined to comment.  2589
