SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez. On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence. The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson. This would have been Fulcher’s third trial. His first trial ended in a mistrial. 1695

SAN DIEGO (KGTV) - A pair of local singers are trying to help people cope with social distancing by hosting live happy hour concerts on Facebook.Don LeMaster and Corey Hable host shows a couple of times a week, singing for nearly three hours."It's just as fun for us as it is for the people watching," says LeMaster. "We love doing it, and it's helping us in our home. It's helping us escape as well."RELATED: Woodward Animal Center launches 'critter cam' amid social distancingLeMaster started the shows before the stay-at-home orders went in place in San Diego. He had to miss a gig because he had a cold. So he decided to sing online that night. Now that he and Hable are out of work, they've kept it going. So far, they've done seven shows. The concerts have become extremely popular, garnering thousands of views. A show LeMaster and Hable did on St. Patrick's Day got nearly 10,000 views on Facebook.RELATED: San Diego County libraries go digital to fight spread of coronavirus"People are watching us all over the world," says Hable. "We've had people join from Spain. We had South Korea. We had some in the Philippines, and Stockholm last night. So it's crazy."It's also therapeutic. LeMaster and Hable say they try not to mention coronavirus at all during the show, because they want it to be an escape from the realities of the outside world."What we're doing is a whole different thing," says LeMaster. "We're taking people out of it and into something that is much more positive."RELATED: Kids can design their own Disney park online with 'Imagineering in a Box'"It's escaping the stuff that's going on outside, and instead embracing what we do have, which is music and positivity and fun," adds Hable. It's part of a larger trend that is seeing entertainers all over the world host shows from their living rooms. They're using social media to reach the audience and give people something to do while sitting at home.LeMaster and Hable have their next show on Wednesday night, April 1. They plan to do a Yacht Rock theme for this concert. And while they do accept donations through PayPal and Venmo, they say it's not about the money. It's about the connection to each other and the music."People's response has been great," says Hable. "They've been showing us support and love, saying thank you so much for doing this. We need this positivity. We need this sort of happiness going on in these crazy times."Click here to go to Don LeMaster's page on Facebook, where you can watch the next show or see archived concerts. 2536

SAN DIEGO (KGTV) — A new political attack ad accuses mayoral candidate Barbara Bry of repeatedly falling asleep at public meetings. The ad is from a committee that supports State Assemblyman Todd Gloria. It says San Diego needs a mayor on alert given the coronavirus outbreak, the threat of wildfires, and the homeless crisis. It then cuts to shots of Bry appearing to doze off at two City Council Committee meetings within the last year. The committee, called Neighbors for Housing Solutions Supporting Todd Gloria for San Diego Mayor 2020, is backed by more than a dozen organizations, including the Municipal Employees Association and the Regional Chamber of Commerce. Attorney Gil Cabrera, its principal, is responsible for the ad."If it was a random falling asleep during a 10-hour council meeting, I'm not going to get into that, there's an amusement factor to it but I'm not going to get into it. It's the pattern of it," Cabrera said.Cabrera said Bry regularly dozes off at public meetings, but also said employees who see it fear retaliation for speaking out. Still, the ad raises questions about accuracy. It shows an image of Bry appearing to sleep at a committee meeting on the city's Get it Done app, while the narrator says she fell asleep during a meeting on police reform. "If this ad is talking about a meeting on police reform but showing a picture of Barbara Bry in a very different hearing, one, that plays a bit fast and loose with the truth and two, it makes problems with the ad the story rather than the Barbara Bry falling asleep on the job, which is what the backers of this ad wanted you to think about," said Thad Kousser, political scientists at UC San Diego. Cabrera says he stands by the ad and its accuracy. Bry, meanwhile, fired back Thursday, issuing this statement: 1808

SAN DIEGO (KGTV) - A plan to improve bike access along Harbor Drive may put pedestrians at risk.As SANDAG works to promote alternative transportation through its "Keep San Diego Moving" initiative, they plan to upgrade the Bayshore Bikeway. That includes a stretch through Barrio Logan that runs along Harbor Drive from 32nd Street to Park Boulevard.Renderings from SANDAG show a two-way bike lane protected from traffic by concrete or plants. But, plans to build the bike lanes also call for the removal of two pedestrian bridges that go over the intersection of Harbor Drive and 32nd Street. SANDAG will replace the bridges with crosswalks.Navy personnel use the bridges as they go to and from Naval Base San Diego every day. Some people who use the bridge daily say they're worried that it will lead to more accidents and dangerous conditions while trying to cross. Others say it could lead to more people jaywalking along Harbor Drive.SANDAG told 10News that safety is their top concern, and the new crosswalks will "enhance the entire intersection, including adding pedestrian pushbuttons, striped crosswalks, median landings, and other safety features."SANDAG also says they're working with the Navy and other city organizations to make sure the crosswalks are as safe as the bridges. A spokesperson for the Navy was unable to provide a comment about the project.Right now, the project is in the environmental review phase. Construction is expected to begin in the summer of 2020 and wrap up by the end of 2021. 1523

SAN DIEGO (KGTV) – A man was stabbed to death in San Diego’s Gaslamp Quarter early Wednesday morning, and police say one person was detained in connection with the incident. At around 2:30 a.m., San Diego police responded to reports of a stabbing in the 400 block of Fifth Avenue, near J Street. When officers arrived, they saw a man in his 40s with a stab wound on his chest lying on the ground with a woman trying to keep pressure on the injury. The victim was rushed to UC San Diego Medical Center, where he later died from his injuries. After the victim gave police a description of the attacker, officers spotted and then apprehended a man believed to be linked to the stabbing.ABC 10News learned the man was detained for questioning.SDPD Lt. Andra Brown said the incident is under investigation, but it appeared the stabbing took place following an exchange of words between the victim and his friends and another group of people. 940
