SAN DIEGO (CNS) - San Diego's 73rd City Council was sworn in Thursday morning alongside new Mayor Todd Gloria, bringing a Democratic supermajority to the council chambers.Departing councilmembers Georgette Gomez, Barbara Bry, Chris Ward, Mark Kersey and Scott Sherman offered thanks to the citizens of San Diego and words of advice to incoming councilmembers Joe LaCava, Stephen Whitburn, Marni von Wilpert, Raul Campillo and Sean Elo-Rivera as the city faces one of the most tumultuous periods in its history.The 73rd City Council must contend with the ongoing COVID-19 pandemic and all the physical, economic and budgetary issues it presents the city. Other major items before the council, which now sits at an 8-1 Democrat advantage, include the city's Climate Action Plan and battling climate change, homelessness and rising housing prices, the cleanup of the Tijuana River Basin, social and racial justice and large-scale projects such as Pure Water.A visibly emotional Gomez thanked her family, wife and supporters for a brief but significant four-year term representing the city's District 9. Her tenure, including the last two years as Council President, saw a citywide focus on climate change, racial justice and infrastructure projects.Her replacement, Elo-Rivera, said he would continue radical reform to better the city. He drew issue with the description of the many problems caused by COVID-19 as "unprecedented.""For too many San Diegan families, the challenges presented by COVID- 19 are not unprecedented but all too typical," he said. "We must not go back to normal. Normal is not good enough."Bry, a candidate for mayor against Gloria, said she was proud of her four years representing District 1 and that she would continue to "demand accountability," from city government. She pointed to the 101 Ash Street real estate deal and the failed Soccer City proposal as examples where she blew the whistle about backroom deals.Her replacement, LaCava, said his engineering background would continue Bry's policy of no-nonsense straight talk. He hoped to work with all city departments to survive the pandemic."Successful navigation of these uncertain pandemic waters will take all of us working together," he said.District 3's Whitburn thanked his predecessor, now-Assemblyman Chris Ward, for continuing to "break the rainbow ceiling." He was sworn in by former Councilwoman Christine Kehoe -- the first openly LGBT person elected to office in San Diego County in 1993 -- and all LGBT former District 3 councilmembers were in attendance. This included Kehoe, Senate President Pro Tempore Toni Atkins, Gloria, Ward and now Whitburn himself.He said he wanted to move forward with the city into a new era."We need to advance past the us versus them mentality," that he said plagued politics around the country but especially in San Diego.Von Wilpert took over from Mark Kersey in District 5 and said she was dedicated to empowering justice throughout the city. She said action must be swift and decisive on how to tackle COVID-19."With a vaccine on the verge, hope is on the horizon," she said, adding the importance of bipartisanship. "We must reject anger and division."In District 7, former Councilman Scott Sherman said he stuck to his guns and didn't sell out to special interests.He reminded his former colleagues and the new elected officials of their responsibility."It's not your money," Sherman said. "We are stewards of the taxpayers' money."His replacement, Campillo, said although he comes from a different political party than Sherman, all the members of the council serve their constituents."We must not let the past impede us," he said. SAN DIEGO (CNS) - The San Diego County Police Chiefs and Sheriffs Association announced Thursday its adoption of a collective set of strategies designed to "de-escalate" confrontational and potentially violent law enforcement situations.The policies unanimously adopted by the group on Wednesday are the culmination of a project that began last June with the creation of a committee tasked with exploring the hot-button issue, according to the regional police leadership group.The panel included representatives from all countywide municipal police agencies, the San Diego County District Attorney's Office and a local psychiatric emergency-response team.Guiding the development of the new program was "the overarching principle of reverence for human life in all investigative, enforcement and other interactions between law enforcement and members of the community," according to the association.The plan calls on all police personnel to "use tactics and techniques to persuade (crime suspects) to voluntarily comply (in order to) mitigate the need to use increased physical tactics to resolve (standoffs) safely.""Some situations require an immediate response, while other situations may allow peace officers the opportunity to communicate with the individual, refine tactical plans and if necessary, call for additional resources," the agency stated.Whenever "reasonable opportunity exists," according to the association's strategy, peace officers should consider the following concepts:"Pre-engagement considerations," which involve "the process of gathering and assessing information prior to deploying the available personnel, tactics, equipment and other appropriate and obtainable resources" so as to "enhance the probability of a peaceful outcome."De-escalation, which hinges on the use of techniques intended "to gain voluntary compliance from an individual in order to gain or maintain control of an incident while reducing the need for physical coercion."Disengagement, or "tactical withdraw," an enforcement method that can "be a viable option for individuals in crisis who pose no additional threats to others, or resistant offenders who may later be apprehended under safer conditions."The mission of the project "was to not only define best practices for de-escalation, but to do so collectively to ensure the county is of one mind on the philosophy," said Chula Vista Police Chief Roxana Kennedy, president of the police-leadership body."As part of this community, we understand the importance of violence prevention whenever possible, and de-escalation techniques are the best way to get there," Kennedy said.District Attorney Summer Stephan called the renewed commitment to de- escalation in policing a government approach that "respects life itself and advances a blueprint for transformation we set in motion two years ago based on community input.""When translated into action, de-escalation policies are the opposite of de-humanization and are an action-based response to calls for equality, fairness and dignity," Stephan said.The association comprises the law enforcement leadership of the county and all local cities, as well as San Diego Harbor Police, the county Probation Department and the police departments of the San Diego Community College District, San Diego State University, San Diego Unified School District and the University of California San Diego. 3398

  

SAN DIEGO (CNS) - The California Supreme Court on Monday upheld the conviction of a death row inmate found guilty of hiring another man to shoot and kill his fiancee in Alpine 20 years ago.Michael William Flinner applied for a life insurance policy for 18-year-old Tamra Keck, then arranged for his former employee, Haron Ontiveros, to kill her on June 11, 2000, according to the ruling.The killing occurred shortly after Flinner met Keck and began dating her.According to the ruling, Flinner named himself as the beneficiary in the insurance policy, and falsely alleged Keck was an employee at his landscaping business whose death would cause him to suffer financially. Prosecutors alleged Flinner arranged for Ontiveros to meet with Keck at a gas station, then direct her to his car in a nearby cul-de-sac under the guise of having engine trouble. Once there, he shot Keck in the back of the head.Separate juries convicted Flinner and Ontiveros of murder and conspiracy and found true special circumstance allegations of killing for financial gain and lying in wait. Jurors recommended capital punishment for Flinner and life imprisonment without the possibility of parole for Ontiveros.In the appeal, Flinner's counsel alleged his case was adversely affected by issues that included limited access to defense counsel, which was allegedly restricted by Flinner's relocation from the downtown San Diego jail to the jail in Vista. Flinner's defense attorney at the time claimed the distance to Vista and other limits on telephone communication would hurt the defense's preparation for trial. According to the ruling, the relocation was implemented because Flinner obtained the home addresses of the prosecutor and trial judge through another inmate.The state Supreme Court found the claims had no merit, as the trial court permitted increased communication between Flinner and the defense team at the defense's request.Another claim alleged juror misconduct by one panelist who sought to write a book about the trial. Flinner's counsel alleged her objectivity may have been compromised as a result. The state Supreme Court disagreed, though it noted the juror had made misconduct claims about other panelists, which the high court also ultimately ruled were unfounded. 2276

  

SAN DIEGO (CNS) - The Metropolitan Transit System is increasing bus and trolley services as the economy continues to reopen.MTS will increase weekday midday service on the UC San Diego Blue Line beginning Monday, June 15, followed by service increases on dozens of bus routes in late June."As we continue the regional reopening of our economy, we know more people will need the services that MTS provides. We want people to know that San Diego's transit system will continue to be a safe and reliable option as possible," said MTS Board Chair Nathan Fletcher. "We've strengthened our already-enhanced sanitizing protocols on vehicles and at stations and implemented policies to better protect our passengers and employees. We are now increasing service to help reliability and allow for greater physical distancing of passengers."Beginning Monday, the UC San Diego Blue Line trolley -- which connects the San Ysidro international border to downtown San Diego -- will increase its service frequency to every 7 1/2 minutes from 4:30 a.m. until 7 p.m., and keep 15-minute frequencies until 9 p.m., followed by every 30 minutes until the end of the service day.Weekday ridership on the Blue Line plummeted 69% between February 24 and April 20, from 63,715 daily riders to just 19,787. Since April 20, average weekday ridership has increased 28%, topping out at 25,367 the week of June 1. More frequency will give more opportunity for passengers to practice social distancing on board and on platforms when possible. Service on the Orange Line and Sycuan Green Line will remain unchanged.While trolley service will first be increasing to closely mirror pre- COVID-19 levels, MTS is also making preparations to increase bus service in the coming weeks. Schedules and routes are being finalized. The goal is to provide service increases that meet market demands. MTS reduced weekday service levels approximately 25% on April 13 to address record-low ridership while still providing critical service for essential workers and trips.In addition to service increases, MTS says it also continues to improve its already-strict safety and sanitizing protocols. The latest development on that front is retrofitting buses with germ barriers to better protect bus operators. Barriers will also allow the agency to return to front- door boarding, which gives passengers more room in which to spread out. MTS has only allowed rear-door boarding since April 1 to protect the health of bus operators.MTS continues to operate about 95 bus routes and three trolley lines. Frequencies and spans have been modified due to COVID-19. Updated schedules can be accessed on the MTS website.
