A New York judge dismissed count 6 of Harvey Weinstein's criminal indictment Thursday, which was a criminal sexual act in the first degree.The count stems from charges brought forth against the disgraced movie producer in May by Manhattan District Attorney's Office.A source familiar with the investigation told CNN at the time that the criminal sex act charge was from a case involving aspiring actress Lucia Evans, who alleged Weinstein forced her to perform oral sex on him in his Tribeca office in 2004. She first spoke out about the alleged incident to Ronan Farrow in the New Yorker last fall.Carrie Goldberg, an attorney for Evans, spoke to reporters outside the court in lower Manhattan following the dismissal, and said the prosecution "jumped ship" and "ultimately she was caught between the middle of a feud between the NYPD and the DA's office."Goldberg added that despite District Attorney Cy Vance not opposing a motion to dismiss the charges against Weinstein, her client's claims remain and this "does speak to a system desperate in need of reform.""People always ask why don't sexual assault survivors come forward, this is why. Today is why," Goldberg said. Goldberg detailed how prosecutors used Evans for months and "put her through needless torture."The attorney said her client will continue her fight in other venues."Victims are becoming warriors and this is just the beginning," she added.Weinstein had previously pleaded not guilty to the six sex crimes he's been charged with in New York, including two counts of rape.Weinstein's bond was set at million and he is required to wear a GPS monitoring system and is only allowed to travel within New York state or Connecticut.Weinstein is also under investigation for alleged sex crimes in Los Angeles and London.CNN has reached out to Weinstein's representatives for comment. 1861

A new rule change will allow parents to get their children vaccinated at pharmacies in all 50 states.“Her pediatrician wanted her to have a pneumonia vaccine because of what’s going on with COVID. Unfortunately, the pediatrician doesn’t stock it, it’s expensive to order,” said Theresa Tolle, who owns a pharmacy in Florida.She was recalling a story involving one of her customers who needed to get her daughter a vaccine.“The Health Department didn’t have it and the mom was losing her mind. Calling everywhere and nobody, no pharmacy can give it because of the laws in our state,” said Tolle.It’s a story a lot of parents can relate to, especially around back-to-school time. Because of the laws in Florida and many states, Tolle, who is licensed to administer vaccines to adults, wasn’t able to do the same for this young girl.“Ultimately, what I ended up doing is ordering it for mom, ran it through her insurance, she picked it up, had it taken to the pediatrician to administer,” said Tolle.For many busy parents, making an additional appointment and taking time off to get their kids a shot can be a headache.But the Department of Health and Human Services just made a rule change that might make things easier. It allows for pharmacies in every state to administer vaccines to kids aged three to 18.According to the Centers for Disease Control and Prevention, after kids turn three, they should still get major immunizations like second doses of the measles, mumps, rubella, polio, tetanus, diphtheria and others. And don’t forget to add an annual flu shot.“As long as it increases vaccination rates, I think it’s fantastic,” said Dr. Malcolm Anderson.Anderson works in the Pediatric ICU at the Rocky Mountain Hospital for Children in Colorado. He’s very supportive of the rule change.“In the pediatric ICU, we only see the children that don’t get vaccinated and then when they get one of the illnesses they would have been protected against. That’s when we see them. So, I think anything that would help them get one of those bad illnesses would be amazing and help the parent avoid the stress and hardship of going through an ICU admission and seeing their kid very ill,” said Anderson.Before the rule change, 30 states had restrictions on vaccines being administered by pharmacies. Three states, including Florida, did not allow it at all.But now, pharmacies in all states can give flu shots to kids and adults.“This fall, they are heavily trying to promote flu shots to try and help protect all patients, all ages,” said Tolle.“If you’re at the pharmacy refilling your meds every three months or every month, then it’s nice to be like, oh, you’re offering flu shots here, I’m already getting my meds,” said Anderson.Theresa says she thinks that the rule change could also get the country ready for mass distribution of a COVID-19 vaccine.“Just COVID vaccine coming. We know little about that right now, but this order in theory would prepare pharmacists to be able to do that,” said Tolle.Until a COVID-19 vaccine comes, Tolle says she’s just happy to be able to give kids the immunizations they need to stay healthy. 3137

A prayer rally was held over the weekend for a 33-year-old man who died after being arrested by sheriff’s deputies in a Southern California grocery store.The man, Ernie Serrano, was at the store last Tuesday night in line to pay for his items. Sheriff’s deputies say when they arrived at the store, they saw Serrano tussling with a security guard and attempting to take the guard’s gun, according to a department press release.“While detaining Serrano, he continued fighting with the deputies and did not comply with their commands. At that time, a use of force occurred,” Sgt. Lionel Murphy with the Riverside County Sheriff’s Department states in the release.Serrano was arrested on suspicion of assault with a deadly weapon. Deputies say Serrano then stopped breathing. "Medical personnel on scene rendered aid and was able to obtain a pulse. Serrano was transported to a local hospital for medical treatment. While at the hospital, Serrano’s condition deteriorated, and he was later pronounced deceased," the department states. Serrano’s family disagrees on what happened in the store, and point to video shared on social media from a witness showing a deputy walk up to Serrano and beat him a few times with a baton before another deputy tackles him.The department said the use of force in Serrano’s arrest is under investigation at this time.The family is raising money for Serrano’s memorial services.Warning: the video may be difficult to watch and the post contains strong language. 1499

  

A middle school teacher and former Miss Kentucky pageant winner has been arrested and charged with sending nude photographs of herself to a 15-year-old boy, authorities said.Ramsey Bearse, a 28-year-old teacher at Andrew Jackson Middle School outside Charleston, West Virginia, allegedly sent the photos to a former student, according to the Kanawha County Sheriff's Office.The boy's parents found the photos on his phone and told police about them last week. They said their son was a student at Andrew Jackson from 6th to 8th grade and that Bearse was a teacher there during some of that time, according to a criminal complaint.In an interview with police, Bearse admitted to sending at least four photos of her topless via Snapchat from about August to October, the complaint states.She is charged with four counts of distributing obscene materials to a minor, a felony.The former beauty queen has been suspended from her teaching position and was released on a ,000 property bond after her arraignment, the sheriff's office said.Bearse, who competed in pageants under the name Ramsey Carpenter, was named Miss Kentucky in 2014.She won the preliminary talent competition at the national Miss America pageant in Atlantic City for her fiddle performance, CNN affiliate WTVQ reported at the time. A massive outage has wiped out power to Puerto Rico's capital San Juan.The problem is with a failure on a main north-south transmission line, said Fernando Padilla, an official with the Puerto Rico Electric Power Authority, known as PREPA."It was a mechanical issue on the line, could have happened at any line," he said.
