A second autopsy on the in-custody death of Adrian Ingram-Lopez concludes the way three Tucson Police Officers restrained him contributed to his death.An earlier autopsy by the Pima County Medical Examiner attributed Ingram-Lopez's death to cocaine intoxication and a heart condition.An autopsy commissioned by Eduardo Coronado, the attorney for Ingram-Lopez family concluded those conditions alone were not enough to have killed the man. It concluded officers continuing to hold Ingram-Lopez face down, handcuffed, and with officers putting their weight on his back led to “positional asphyxia”---inability to breathe because of body position.Police were about to fire Officers Jonathan Jackson, Samuel Routledge, and Ryan Starbuck when the three resigned.RELATED: TIMELINE: What happened after a man died while in TPD custodyThe TPD report which recommended firing the officers noted Ryan Starbuck had more extensive medical training than the other two. He is a licensed Emergency Medical Technician. The Arizona Health Department shows an EMT license for a Ryan Starbuck still active. TPD says Starbuck has been an EMT for 14 years.Police body cameras show, when other officers arrived, they recognized Ingram-Lopez was in medical distress and had him re-positioned to allow better breathing. Officers called an ambulance and administered an antidote for opioid overdose but that drug does not work on cocaine. Ambulance EMT’s pronounced Ingram Lopez dead.The family’s attorney hired a former Maricopa County Medical Examiner to do an independent autopsy. It conflicts with the Pima County Medical Examiner’s ruling on death.The Pima County report basically attributes the death to cocaine and a heart condition and mentions how Ingram-Lopez was restrained. It says, in part:“...the cause of death is ascribed to sudden cardiac arrest in the setting of acute cocaine intoxication and physical restraint with cardiac left ventricular hypertrophy as a significant contributing condition.”The alternative report says the cocaine and the heart condition were not serious enough to have killed by themselves. It puts more blame on how the officers restrained Ingram-Lopez and say, “his death is most consistent with asphyxia due to compromised airway which is best explained by a facedown position restricting his breathing.”Attorney Eduardo Coronado says instead of putting their weight on Ingram-Lopez back, officers should have realized he was co-operating and let him sit up and breathe.“What I can say is that there was a complete lack of empathy, a complete lack of humanity, a total disregard for his needs and just indifference, complete indifference.”Now the family says it wants a thorough criminal investigation of what the three former officers did and it’s considering a civil lawsuit.Report details TPD officer misconduct in death of Carlos Ingram-LopezKGUN's Craig Smith first reported this story. 2918

A US Army veteran who served two tours in Afghanistan has been deported to Mexico, US Immigration and Customs Enforcement said.The deportation follows an earlier decision by US authorities to deny Miguel Perez's citizenship application because of a felony drug conviction, despite his service and the PTSD he says it caused.Perez, 39, was escorted across the US-Mexico border from Texas and handed over to Mexican authorities Friday, ICE said in a statement.Perez, his family and supporters, who include Sen. Tammy Duckworth of Illinois, had argued that his wartime service to the country had earned him the right to stay in the United States and to receive mental health treatment for the PTSD and substance abuse."This case is a tragic example of what can happen when national immigration policies are based more in hate than on logic and ICE doesn't feel accountable to anyone," Duckworth said in a statement following reports of Perez's deportation. "At the very least, Miguel should have been able to exhaust all of his legal options before being rushed out of the country under a shroud of secrecy."Perez was born in Mexico and legally came to the United States at age 8 when his father, Miguel Perez Sr., a semi-pro soccer player, moved the family to Chicago because of a job offer, Perez told CNN earlier. He has two children born in the United States. His parents and one sister are now naturalized American citizens, and another sister is an American citizen by birth.It's a complicated case. Perez has said that what he saw and experienced in Afghanistan sent his life off the rails, leading to heavy drinking, a drug addiction and ultimately to his felony conviction."After the second tour, there was more alcohol and that was also when I tried some drugs," Perez said last month. "But the addiction really started after I got back to Chicago, when I got back home, because I did not feel very sociable."In 2010, he was convicted in Cook County, Illinois, on charges related to delivering more than 2 pounds of cocaine to an undercover officer. He was sentenced to 15 years and his green card was revoked. He had served half his sentence when ICE began deportation proceedings. He had been in the agency's custody since 2016.Perez has said he was surprised to be in ICE detention and mistakenly believed that enlisting in the Army would automatically give him US citizenship, according to his lawyer, Chris Bergin. His retroactive application for citizenship was denied earlier this month. While there are provisions for expediting troops' naturalization process, a main requirement is that the applicant demonstrate "good moral character," and the drug conviction was enough to sway the decision against his application, Bergin said.Perez enlisted in the Army in 2001, just months before 9/11. He served in Afghanistan from October 2002 to April 2003 and again from May to October 2003, according to his lawyer. He left the Army in 2004 with a general discharge after he was caught smoking marijuana on base.Perez went on a hunger strike earlier this year, saying he feared deportation would mean death. A nonprofit group dedicated to finding missing persons says they've found items that "brought a lot of interest" during their search for missing Fort Hood soldier Vanessa Guillen.Guillen, a private first class soldier assigned to the 3rd Cavalry Regiment, was reported missing on April 22. She was last seen in the parking lot of her Regimental Engineer Squadron Headquarters on Fort Hood at 11:30 a.m.The Army is currently investigating whether Guillen was sexually harassed prior to her disappearance. On Tuesday, Guillen's family met with officials from Fort Hood and the Texas Criminal Investigation Command (CID) who said that they suspect foul play in her disappearance.A number of organizations have joined efforts to find Guillen, including Texas EquuSearch — a local nonprofit dedicated to finding missing persons.Tim Miller says this is the fifth time he and Texas Equusearch have traveled to search the area for Guillen."Areas that we've searched, we've cleared," said Miller. "If she would have been there, we would have found her."The search-and-rescue team has searched several areas in and around a 25 mile stretch between Fort Hood and the Leon River, looking for anything that could lead to Guillen."I'm not going to say we found evidence in the Leon River.
