BOSTON (AP) — Federal immigration agencies have launched a coordinated campaign to arrest and deport immigrants seeking to become legal U.S. residents through marriage, according to documents released this week in a class-action lawsuit filed by the American Civil Liberties Union.The documents, which include depositions and correspondence from federal officials, show the extent to which officials for the U.S. Citizenship and Immigration Services have been coordinating with their counterparts at Immigration and Customs Enforcement to facilitate arrests at citizenship offices in New England.The ACLU, in its arguments, criticizes the efforts as a deportation "trap" that violates the constitutional rights of immigrants otherwise following the rules to become legal residents."The government created this path for them to seek a green card," Matthew Segal, legal director for the ACLU of Massachusetts, said in an interview Tuesday. "The government can't create that path and then arrest folks for following that path."A spokesman for USCIS said the agency doesn't comment on pending litigation, and ICE representatives didn't immediately respond to requests for comment. The two agencies both fall under Department of Homeland Security oversight.The ACLU lawsuit argues that Homeland Security regulations created under former President Barack Obama allow immigrants with U.S.-citizen spouses to stay in the country while they seek a green card — even if they're already subject to deportation."That regulation is still the law of the land," Segal said Tuesday. "So arresting these folks is not about law and order. These are people with a path to legalization and the government is trying to block that."The federal government, in seeking to dismiss the lawsuit, argues in part that the federal District Court has no jurisdiction in the matter.The ACLU's more than 250-page legal brief includes emails between ICE officials outlining how it coordinates arrests with USCIS in New England.Andrew Graham, a Boston-based ICE officer, said the agency generally receives from USCIS lists of immigrants seeking legal residency who have already been ordered for deportation, had re-entered the country illegally or were considered "an egregious criminal alien."Graham says ICE then works with USCIS to schedule interviews so that ICE agents can be present to make an arrest. He notes ICE prefers to spread out the interviews to ease the workload on its agents and to prevent generating "negative media interest" from the arrests."In my opinion, it makes sense for us to arrest aliens with final removal orders as they represent the end of the line in the removal process," Graham wrote in part. "(A)t the end of the day we are in the removal business and it's our job to locate and arrest them."The ACLU's legal brief is the latest in the class-action suit it filed earlier this year on behalf of immigrants who have been or fear being separated from their U.S.-citizen spouses.The case will be argued Aug. 20 in Boston federal court and names five couples, including lead plaintiffs Lilian Calderon and Luis Gordillo, of Rhode Island.Gordillo is a U.S. citizen, but Calderon is a native of Guatemala who came to the country with her family at the age of 3. I enjoy it," said Richard Reyes. "This is my coffee right here."Reyes takes it in every morning before checking his tools, supplies, and his route for the day."Going to be a very good day. Hope to get lots of litter," said Reyes.On this day, he and his crew were on Federal Highway in Boynton Beach."When I walk, I do the median and crew does the sides," said Reyes, who was joined by his friends Suzie and Shawn.They have quite a few fans. The three of them search the streets, sidewalks, and parking lots."I have a facemask, gloves," said Reyes as he picked up trash.There are bad surprises and sometimes good. On this day the Publix parking lot was clean.No matter the weather, Reyes is out there."Six times a week. Sometimes seven," said Reyes.Reyes has been picking up trash since his days on the west coast of Florida, back when life threw him a curveball."Aortic valve replacement and an aneurism repaired," said Reyes.Following his recovery, Reyes started walking and gathering trash."I can’t go long distances like I used to. So walking is very healthy for me and that’s a big reason why I do it," said Reyes. "I came out here and continue the effort in Boynton Beach."At the end of his cleanups, he weighs his garbage. Racism is still prevalent in Santa Barbara, as it is in the entire land, unfortunately," said Ron Paris Green, a musician who lives in Santa Barbara, California. When a mural paying tribute to George Floyd went up in the downtown area, Green jokes that he thought he was in a different city. Santa Barbara has strict rules on what signs are allowed on buildings. The town has a uniform architecture of red tile roofs and white stucco walls. "To have a Black man on the side of a wall, which is supposed to be white, is not something a lot of people want to see, especially in Santa Barbara," said Bix Kaufman, owner of EOS Lounge. After the death of Floyd, Kaufman broke the city's longstanding tradition, inviting an artist to transform the white wall outside his club. The overwhelming white community has a Black population of less than 2 percent."This is, I think, one of the strongest statements in Santa Barbara right now, and it feels really good. And there's been so much positive feedback," said Kaufman. Green visits the mural twice a day now, "I'm very optimistic, yes, because of the young people stepping for the cause."He's been marching with young activists and hopes to send some to a massive march planned for this August in Washington D.C., led by Al Sharpton and Floyd's family. But in the face of hate, artists and activists have grown more resilient.In Santa Barbara, the mural was not only repaired within hours but also granted permission by the city to stay up indefinitely, according to Kaufman. "We heard the word revolution during the 60s. this is a cultural revolution," said Stan Holder, a poet and activist. Holder has helped cover the Santa Barbara mural with stories of pain endured by generations."How many more innocent Black lives must be sacrificed for us to all realize we are all in this human race together?" Holder reads off the wall."People go back to their regular lives and sometimes forget this is still a problem," said Kaufman.He hopes the mural serves as a constant reminder of the years of work ahead needed to fight systematic racism and achieve equality for all. 3009
