SAN DIEGO (KGTV) - KAABOO Del Mar will become KAABOO San Diego in 2020 as the popular music festival held at the Del Mar Fairgrounds moves to Petco Park. The change was announced by its producers Sunday at the end of a sold-out three day festival, its fifth at the North County location. Concerts will be held on Petco Park's playing field, Sycuan Stage at the Park, Lexus Premier Lot, and the Tailgate Lot, KAABOO officials said. “The location of Petco Park and its surrounding venues in downtown San Diego provides fans and artists alike the opportunity to enjoy everything that the vibrant metro area has to offer. We couldn’t be more ecstatic about this partnership and our relocation,” said Jason Felts, Managing Partner of KAABOO. “Our venue and the downtown Ballpark District offer the perfect setting for an event of this magnitude and further establishes Petco Park as the premier entertainment destination in Southern California. SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. SAN DIEGO (KGTV) - Local VFW posts are bracing for the new restrictions to kick-in on Saturday.The restrictions result from an increase in COVID-19 cases in the county, putting the county in the state's purple tier, the tier with the toughest covid-19 related restrictions.Mike Hill, the post commander at VFW 5985 in Pacific Beach, says they are already struggling to make ends meet during the pandemic because of the restrictions."There are 22 VFW posts and more American Legion posts through San Diego County, and all of us rely on having events and having people coming to our canteen, which is sort of military for a bar and spend money there, and that helps support us," Hill said. "We've eaten up most of our savings to pay the bills while we've been closed."He says they have relied on donations so far and will be needing more the longer the pandemic lasts."I will tell you the members, and I will be dialing for dollars," Hill said. He says they will start within their members first, then the community."We'll reach out to the community and hope that some of them will value this place that's been in the community for 90 years and let it still be a home for veterans to be around other veterans," he said.VFW 5985 has been closed most days except Tuesdays and Fridays to make meals for dozens of veterans, their families, and those who need it. SAN DIEGO (KGTV) - Members of Congress are responding to a Team 10 investigation that uncovered allegations the government is not providing adequate medical care to some U.S. citizens in its custody.Two recently filed lawsuits allege that dozens of individuals’ medical needs were deliberately ignored by Department of Homeland Security (DHS) agents, and Americans were forced to undergo life-threatening and torturous detox in temporary holding cells at the border.In a statement to 10News U.S. Congressman Bennie Thompson, Chairman of the Committee on Homeland Security wrote, “The allegations made in these lawsuits are extremely troubling. Anyone in CBP custody who is in medical distress should receive urgent medical care if they require it. Across the board, it’s clear that CBP has work to do to ensure safe and humane conditions for all detainees.”San Diego area Congressman Scott Peters also responded saying, “Everyone in federal custody deserves access to basic care. Ignoring a detainee’s pleas for help runs counter to CBP’s own national policies, which say detainees are entitled to medical care if they report an illness or appear to need help. Officers at the border may be overwhelmed, but if CBP is going to detain people, they have a duty to provide proper medical care to the people in their custody.”10News also heard from ACLU of San Diego & Imperial Counties. A spokesperson wrote, "Unfortunately, horrible detention conditions at U.S. Customs and Border Protection facilities, including inadequate medical care, is nothing new – though they are violations of the agency’s own internal standards for treatment of people in its custody. As a result of recent federal policy decisions, far more people are being unnecessarily held in CBP custody, for longer, under these deplorable conditions. These decisions are greatly exacerbating CBP’s longstanding failure to meet the basic humanitarian needs of the people it insists on detaining.”When asked for a comment on the allegation in the lawsuits a spokesperson for Customs and Border Protection said the agency cannot comment on matters that are currently under litigation. 2159
