SAN DIEGO (KGTV) - A lawsuit was filed on Monday in San Diego County Superior Court against the County of San Diego, Registrar of Voters and other entities related to the ongoing battle over the future of the Julian volunteer fire department. Attorney and mayoral candidate Cory Briggs filed the suit and told 10News that the claim is that a group of former volunteer fire department board members made the decision to dissolve the department in secret meetings, and the County allegedly let it happen. For the past two years, locals have been in a contentious battle over the future of San Diego County's last all-volunteer fire department. Many residents believe the County should take over the department because it has more resources and money.Opponents don't trust the County and think that the department's volunteers can do a better job on their own. This morning, an independent regulatory agency conducted a final vote in favor of dissolving the department. A hearing on this new lawsuit is scheduled for Wednesday morning. 1041

SAN DIEGO (KGTV) - A San Carlos family is hoping surveillance video will help track down the man recorded making himself comfortable in their home.Along Wallsey Drive, the Meduna family got a heart-sinking scare the day before Halloween.Around 8:30 a.m, Megan Meduna and her husband both got a notification that their garage door was open.  Inside the home, a camera was recording an intruder. Meduna says the man had pried open a window screen in the front and forced open a window.  A sound heard in the video is the burglar opening the door to the garage, before he's seen shutting the window he just climbed through. As he puts on his gloves, he walks up to the camera and flips it over."It's just creepy, creepy to see someone in my house sneaking around," said Meduna.By the time police arrived, the man was gone. He got away with only a little bit of cash, but the impact was felt across a neighborhood.  Surveillance video showed him casing the area.  Minutes before the break-in, a neighbor reported seeing the man knocking at her door, then pretending to need directions when she answered the door.  At another home, a ripped screen was found near a side window and an out-of-place brick was discovered outside another window.Neighbors are now wondering if the same man could be linked to other burglaries. A few weeks ago and blocks away, 10News reported on a break-in with a similar MO that left a newlywed couple missing wedding gifts and family heirlooms.  A month ago, there was a another burglary at Meduna's home, in which electronics and jewelry were taken."Feel violated and angry. SAN DIEGO (KGTV) -- A principal in La Jolla apologized after sending an email to parents she says unintentionally reinforced stereotypes.La Jolla Elementary School Principal Donna Tripi last month sent an email after two parents expressed concern over a man they believed was following a parent and her two children out of a Starbucks and across the street.In the email, Tripi described the man as “an African American male, about 30 years old, about 6’1” tall, wearing a hooded sweatshirt.” Tripi added in an apology email that she was passing along the description she was given.RELATED: La Jolla students, teachers gather to battle bullying on campus“My email was a mistake. SAN DIEGO (KGTV) - A North Park family is appealing for tips after a former high school football star - and recent college graduate - was injured in a drive-by shooting."They thought it was fireworks at first," said Dawn Kinder.Sisters Denisha Montgomery and Dawn Kinder say two Fridays ago, their brother Devante Kinder, 24, and three friends had spent a day at the beach and were driving up to his driveway near Meade Ave. around 9:40 p.m. Devante was at the wheel of the used Mercedes SUV he had saved up to purchase, when neighbors heard about nine shots ring out, and a car drive away. Devante was shot twice in the face."The only thing he could think of was to save his life, and he drove himself to the hospital," said Montgomery.Soon after, his sisters got the news."Unreal and didn't believe it at first actually. There is no way he could be injured in this way," said Montgomery.One of the bullet entered Devante's neck, shattered his cheekbone and lodged in his sinus cavity. The other one grazed his cheekbone."He's devastated ... asking himself why it was him," said Montgomery.His sisters say Devante does not have any enemies. Devante, a football standout at Mission Bay High School, went on to graduate from San Jose State six months ago. He returned home and recently got hired for engineering position in March."Starting his career, saving money. All he could talk about was buying his own condo," said Montgomery.Those plans have been put on pause by the drive-by shooting. Amid a national dialogue on racial injustice, Devante's sisters say they know many families impacted by violence."It's something that shouldn't be happening. SAN DIEGO (KGTV) - A pet parrot gave its owner quite the scare after flying up into a tall tree in La Jolla.The owner, Katie Anthony, said she camped under the tree all night worried about her African Grey parrot named "Sidekick." Anthony said the bird is domesticated and not used to being in the wild.Anthony called the San Diego Fire Department and crews came out to investigate. SDFD Capt. Margot Johnson - who was retiring Wednesday - climbed up to retrieve the bird, but it took a couple tries to get it down. At one point, another firefighter fought off a falcon in the process."We really appreciate it and very very thankful because we didn't think we were ever going to see him again," Anthony said.Sidekick is now safe and sound.
