A United States Customs and Border Protection officer is accused of falsely claiming to be a US citizen when he applied for the job, the Department of Justice said. According to DOJ officials, Marco Antonio De La Garza Jr., 37, of Hereford, Ariz. was charged with three counts of passport fraud and false statements on his federal law enforcement background application. The DOJ is claiming that De La Garza knowingly used a fraudulently obtained Texas birth certificate to apply for a United States passport. De La Garza is also accused of using the same birth certificate to claim US citizenship during his background check.It is unknown how US officials were unable to figure out that De La Garza's paperwork was fraudulent.  The charges stemmed from an investigation conducted by  the Department of State-Diplomatic Security Service and the Department of Homeland Security-Office of Inspector General. The DOJ claims that De La Garza was actually born in Mexico. The Associated Press confirmed that he was hired by border patrol in 2012.   1116

A panel of three federal judges in North Carolina ruled Monday the state's congressional map is an unconstitutional partisan gerrymander that favors Republicans, and said it may require districts to be redrawn before the November elections.Republicans hold 10 of the state's 13 seats in the House of Representatives, and a redrawn map could put more seats in play for Democrats -- potentially affecting control of the House.The judges acknowledged primary elections have already occurred, but said they were reluctant to let voting take place in districts that courts twice found had been unconstitutionally drawn.The same decision was reached by the court in January, but the Supreme Court declined in June to hear the case and it was sent back for reconsideration. The Supreme Court has never ruled a partisan gerrymander to be unconstitutional, and it passed up three separate opportunities to do so in the last term.The decision Monday could result in an election-year appeal to the Supreme Court. The court is currently evenly split on ideological lines and lacks a ninth justice to tip the scale. The court also traditionally does not approve of judicial actions so close to an election that could affect the outcome. 1231

A vehicle was intentionally driven Friday into three students outside a high school near the southern French city of Toulouse, injuring them, the country's interior ministry said.A driver was arrested after the collision, and the Toulouse prosecutor has been called to investigate, the ministry said.The collision happened outside Saint Exupéry high school, according to CNN affiliate BFM TV.Initial information about the conditions of the injured -- identified by authorities only as Chinese students -- conflicted. The interior ministry said the students were lightly injured; BFM reported that two were in serious condition.Toulouse Prosecutor Pierre-Yves Couilleau said around noon ET that two students remained hospitalized and one had left the hospital.The vehicle accelerated as the students crossed a road, the interior ministry said.The driver has a history of mental illness, the interior ministry said in a statement. A vintage plane crashed in the Swiss Alps on Saturday, killing all 20 people on board, police said.The mid-century plane, a Junkers JU-52, crashed in the Piz Segnas mountain range, near the Austrian border.All 17 passengers and three crew members died in the crash, which happened around 5 p.m. local time. They were aged between 42 and 84. 348

A Southwest Airlines plane flying from Fort Lauderdale to BWI was hit by a pickup truck after landing at the airport.  It happened early Monday morning.   Passengers said the white truck crashed into the side of the plane on the runway.  An ambulance was at the scene, but according to passengers, no one was injured.  Passengers were not allowed to leave while crews continued their investigation.  Southwest Airlines has not released any comment but the company did respond to a tweet from one of the passengers on the plane.  A passenger named Michael Simon posted this tweet: "So our southwest flight just got into an accident with a pickup truck. Guess that makes me an airplane crash survivor."  874
