SAN DIEGO (CNS) - A motorist who fled a traffic stop in Encanto Tuesday led officers on a 40-minute pursuit that ended with his arrest near Lake Hodges, authorities reported.The man refused to yield when San Diego police tried to pull him over for a traffic violation in the 6800 block of Akins Avenue shortly after 9 a.m., SDPD public-affairs Officer Michael Stirk said.The motorist drove off to the east toward Spring Valley, then entered state Route 125 and headed north, Stirk said.Reaching Santee, the man entered SR-52 and headed west, then merged onto northbound Interstate 15 when he got to the Miramar area.While passing through northern San Diego with SDPD and California Highway Patrol personnel tailing him and tracking his pursuit aboard a police helicopter, the driver managed to avoid running over several spike strips that CHP officers hurled onto the roadway in his path.After entering Escondido, however, the man finally pulled to a stop on the side of the freeway near Ninth Avenue and was taken into custody without further incident about 9:45 a.m., Stirk said.The arrestee's name was not immediately available. 1139

SAN DIEGO (CNS) - In a 6-3 vote, the San Diego City Council today rejected a proposed .5 million sale of the property holding the city's only roller skating rink, Skateworld.The proposal called for the city to sell the parcel of land to big-box store developer Pacifica Companies, much to the chagrin of Skateworld supporters who called on the council to either collect more community feedback before approving the sale or reject it outright in favor of renovating the rink.Skateworld advocates collected thousands of signatures in an effort to save the skating rink, including a change.org petition that garnered more than 19,000 supporters. "I really appreciate that residents of every council district came to speak today about the community that Skateworld fosters,'' said City Councilwoman Barbara Bry. "I think there's so few family friendlyopportunities in that community that it's really essential.''The skating rink was developed under a state redevelopment agency more than 40 years ago. When Gov. Jerry Brown dissolved the redevelopment agencies in 2011, he ordered that their assets be liquidated to the highest bidder.The city put the property up for bid last year and named Pacifica the recommended buyer after three rounds of receiving offers for the site. Supporters of the sale, including City Councilman Scott Sherman, who represents the district Skateworld is in, argued the city's hands were tied and it should honor Pacifica's bid. City Council members Mark Kersey and Chris Cate also voted in favor of the sale."I have to try to make a decision on what is fair,'' Sherman said. "And the reality is, if we went through three rounds of bidding and everybody was aware and we went through the community outreach and all that process andSkateworld had won that bid and I came in and said, `No, the developer said they'll give us more money, just tell them what they have to beat' ... everybody in this room would be down here screaming `How dare you do that.'''After rejecting the sale, the council voted unanimously to shift the property from a liquidation designation to a future redevelopment site. Sherman raised the concern that the council could be in the same position one year fromnow, with Skateworld finishing second in a bidding process to redevelop the site. But he voted for the motion regardless. "When I was looking at this, I really did say, you know, I like to give deference to my fellow council members and their district,'' City Councilwoman Monica Montgomery said. "This though, I went to church down the street as a child and went to Skateworld, so it is something that affects all of us.''The technically nonpartisan council voted along party lines to avoid the sale, showing the influence of council Democrats' supermajority. SAN DIEGO (CNS) - A man was sentenced to 50 years to life in prison Friday for the car-to-car shooting death of a 16-year-old boy on a San Diego freeway nearly 20 years ago -- the second time the defendant has been sentenced for the killing.Phong Huynh, 42, was convicted in May of murder and firearm allegations for the Feb. 13, 2000, slaying of Nghia Tan Pham. Huynh was previously convicted of the killing in 2015 and sentenced to 50 years to life behind bars, but an appeals court panel overturned that conviction, leading to this year's retrial.Pham was struck in the head by one of about a half-dozen shots fired at the car he was driving on southbound Interstate 15, north of state Route 52. The case went unsolved for more than a decade until Huynh, who was living in Montana, was identified as a suspect.Both the prosecution and defense said Pham was killed in retaliation for a fight he was involved in at a San Diego pool hall, in which he inadvertently bumped a man with a pool cue while lining up a shot at a billiards table. The fight triggered another altercation days later at an area coffee shop, then the shooting of Pham, which occurred about a week after the pool hall fight.Deputy District Attorney Christopher Lawson said Huynh was friends with two men injured in the fight, while Huynh's attorney, William Nimmo, claimed his client was not present at the brawl, nor at the coffee shop.On the night of the shooting, Lawson said Huynh had a driver follow Pham as the victim drove onto the freeway, then fired on him from the front passenger seat. The prosecutor said Huynh fled to Michigan six weeks after the teen's death.The driver of the car had no idea Huynh was planning to kill Pham on the night of the shooting and declined to come forward for more than a dozen years out of fear, Lawson said, but eventually told authorities what happened after being overcome by guilt. Other witnesses also told police that Huynh bragged about committing the killing or threatened others that they might be next, Lawson said.Nimmo countered that the driver and Huynh did not like each other and he would never agree to drive Huynh in the first place, as the prosecution contended.Nimmo claimed that a pair of San Jose-area gang members were in San Diego and were on the run due to an attempted murder drive-by shooting they committed in the Bay Area. He alleged that those men lost the fight at the pool hall, and their humiliation over the altercation triggered a chain of events that led to Pham's killing.At Friday's sentencing, Nimmo requested that San Diego County Superior Court Judge Amalia L. Meza strike a 25-years-to-life gun enhancement due to Huynh's age at the time of the offense, his lack of criminal history between the shooting and his arrest, and that the gun enhancement served little purpose and doled out unnecessary punishment when other homicidal methods such as strangulation would be far more tormenting for a victim.Deputy District Attorney Christopher Lawson called the shooting "an assassination" that he described as "cold-blooded," "calculated," "pointless" and "senseless," and said Huynh displayed "a total lack of remorse" throughout the case.Meza declined to strike the enhancement, citing the terror and fear the killing caused throughout San Diego's Vietnamese community.An appellate court panel overturned Huynh's 2015 conviction on several factors, including that the defense was not allowed to postpone a portion of the trial in order to produce a key witness.The three-justice panel also ruled that Huynh should have been allowed to introduce evidence that some of the prosecution's witnesses were associated with a gang that frequented the pool hall and coffee shop. Huynh was accused of confessing to killing Pham -- an associate of some of the gang's members -- at one of the suspected gang members' homes, something his first trial lawyer characterized as "so highly improbable as to be ridiculous," according to the court's ruling.The gang evidence was not allowed to be presented at trial, as it was ruled to have no bearing on Huynh's alleged motive, but the appellate court ruled that its introduction would have allowed for "a materially different understanding of the relationships between the relevant individuals." 4287

  

SAN DIEGO (CNS) - A man who beat his estranged wife to death with a commemorative baseball bat as she delivered food to him at his City Heights apartment was sentenced Friday to 16 years to life in state prison.Dana Marion Davis, 56, pleaded guilty at an earlier hearing to second- degree murder in the death of April Davis, his spouse of more than 30 years and the mother of his six children.The defendant beat the 51-year-old victim with a wooden bat on the afternoon of Oct. 7, 2017, then prevented a family member and police from entering the apartment, said Deputy District Attorney Stephen Marquardt. When officers finally gained entry, she was found dead on the floor.Davis told Judge Michael Smyth that he was remorseful for killing the mother of his children."She didn't deserve this," the defendant said before he was sentenced.To his children -- three of whom were present in court -- Davis said, "I am deeply sorry for the pain I have caused you."A psychologist determined the defendant suffered childhood development trauma that affected his relationship with his wife, Deputy Public Defender Amy Hoffman told the judge.When talking to police after the murder, Davis was "clearly in shock" as to what happened, Hoffman told the judge. The attorney said alcohol was involved in the fatal encounter.According to Marquardt, the defendant was on probation for domestic violence when he killed his wife. The two had been living apart.The prosecutor said the defendant had been violent with the victim in the past, having been convicted of misdemeanor domestic violence in 1994 and 2016.When the defendant was convicted of punching his wife in the head in 2016, he was also prosecuted for choking his teenage daughter, Marquardt said. 1749
