ENCINITAS, CALIF. (KGTV) -- The return to in-person instruction for some north county students appears to be in legal limbo.Friday, the California Teachers Association filed a legal petition on behalf of the union representing the teachers in the San Dieguito Union High School District. The union wants the district's reopening plan blocked, saying, among other things, it violates the state's public health rules concerning the pandemic.Last Tuesday, the school board voted to give students the option of returning to in-person instruction five days a week on January 27th. Previously, the board voted to return to campus one day a week beginning January 4th.Lori Laroque has two boys in eighth grade at Pacific Trails Middle School. She applauds the board's decision."I was elated, and this was something that should have happened a long time ago," said Laroque.Ann Cerny has been teaching U.S History at Earl Warren Middle School for twenty-seven years. She also has a high school daughter in the district.Cerny says she would love to see kids return to campus, but she says now is not the time."Yes, in-person learning is best, but it's not going to be that 2019 in-person situation, and people aren't seeming to accept that reality," said Cerny, who has been teaching remotely from her classroom.Union leaders estimate up to 20% of teachers won't return if the plan for five days a week in-person instruction goes through.Cerny says she has concerns about exposure to COVID-19, but that isn't her biggest fear."It's the academic chaos that we find ourselves heading towards. I'm just worried that it's not going to roll out well. I'm worried for equity for students. I'm worried for the many, many teachers going out on leave and having subs for classes," said Cerny.The school board president said the district is actively recruiting for teachers and substitutes.No one from the board was available to comment on camera, but President Maureen Muir sent 10News a lengthy statement explaining the reopening plan."The health and safety of our students and staff is the District's highest priority. The District's Safe Reopening Plan follows the guidance issued by the California Department of Public Health and includes detailed protocols for distancing and ventilation.Staff will be encouraged to maintain 6 feet of distancing, as practical, from one another at all times, and teacher desks will be at least six feet away from students. Students will maintain distancing as practicable and in compliance with guidance from CDPH, including arranging desks in a manner that minimizes face-to-face contact. We have evaluated all of our classroom spaces and planned to maximize distancing. We have also planned carefully to maximize distancing for students and staff outside of our classrooms, including before, after, and between classes.The District consulted with ventilation and filtration experts to determine the maximum efficiency our units can handle. MERV 8+ filters were installed in all of our units, which achieves MERV 11 efficiency. Additionally, we purchased and installed HEPA filters in our classrooms, common areas, and offices. We have CO2 sensors in our newer buildings that monitor indoor air quality and we are purchasing more for other spaces.To ensure the continuity of teaching and learning, the District is allowing teachers who are in a high-risk group, or who have a household member in a high-risk group, to teach from home for the remainder of the second quarter, which ends on January 22, 2021.We have also informed teachers who have childcare needs due to COVID-19 that they may also work from home during this same time period. The District has made every effort to work with our teachers to keep them safe and to address their concerns about returning to work. The District is continuing to evaluate potential staffing shortages and has been actively recruiting teachers and substitute teachers to address this issue.The District is aware that the San Dieguito Faculty Association filed a petition for a peremptory writ of mandate on Friday that seeks to prevent the District from providing in-person instruction to students in January. (KGTV) - City leaders voted Wednesday night to support the federal lawsuit against California's sanctuary laws. The Escondido City Council voted 4-1in favor of backing the litigation. In response to the discussion, immigrant communities in Escondido believe their leaders are out of touch."What's being discussed inside chambers is not representative of the values in my community,” said Lilian Serrano.Escondido Mayor Sam Abed, on the other hand, believes coordination with local authorities and ICE is critical to keeping Escondido safe. Federal health officials reported Thursday an additional 109 cases of cyclospora infection in an ongoing outbreak linked to McDonald's salads that began in May.The total number of laboratory-confirmed illnesses from this outbreak is now 395, according to a?statement from the US Food and Drug Administration. At least 16 of the sick individuals have been hospitalized.The cyclospora parasite causes intestinal illness in people who consumed contaminated food or water. Symptoms can begin a week or more after consuming the parasite. They include diarrhea and frequent, sometimes explosive bowel movements, according to the Centers for Disease Control and Prevention. Those who are infected might also experience loss of appetite, weight loss, stomach cramps or pain, nausea, gas and fatigue. Vomiting, headache, fever, body aches and flu-like symptoms can also occur.The illness can last a few days to a few months, and patients might feel better but then get worse again. Cyclosporiasis can be treated with antibiotics.Illnesses have been reported in 15 states: Connecticut, Florida, Iowa, Illinois, Indiana, Kentucky, Michigan, Minnesota, Montana, Nebraska, Ohio, South Dakota, Tennessee, Virginia and Wisconsin. However, the patients in Connecticut, Michigan, Tennessee and Virginia bought their salads in Illinois while traveling, and the Florida patient bought the salad in Kentucky.The FDA said an unused package of a Fresh Express salad mix of romaine lettuce and carrots that had been distributed to McDonald's tested positive for the presence of Cyclospora though it was past its July 19 expiration date."Epidemiologic evidence indicates that salads purchased from McDonald's restaurants are one likely source of these infections. The investigation is ongoing, and FDA is working to determine the sources of the ingredients that were in common to the salads served at McDonald's," the CDC said in an outbreak update posted on its website Thursday.McDonald's said in a?statement on July 13 that it had removed the salad mix from it's impacted restaurants and replaced it with a different supplier.In a?recall statement?on the Fresh Express website, the company said it had launched a "precautionary recall" of the institutional food service product on July 27 of a "limited number of cases."The statement said, "Fresh Express follows rigid food safety requirements and preventive controls throughout our supply chain that are carefully designed to mitigate against potential health risks."The company's salad mix recall was connected with a?public health alert issued Monday by the US Department of Agriculture's Food Safety and Inspection Service advising consumers that certain salad and wrap products might be contaminated with cyclospora. ESCONDIDO, Calif. (KGTV) -- San Diego County’s largest ice-skating facility is closing for good.Officials with Ice-Plex Escondido announced Thursday that the facility, located on 555 N. Tulip St., is shutting down effective immediately.Since 1995, Ice-Plex was a destination for San Diegans looking for a place to ice skate or play hockey. The facility, with its two Olympic-sized ice rinks, offered classes and public ice skating sessions that ran 7 days a week.In a statement on their website, Ice-Plex officials said, “This was not an easy decision. Our hockey and skating communities have been strong partners to us throughout the years, and we have worked hard over the last few months to find an alternative way to keep the facility open. Unfortunately, that solution has not emerged.”Officials said the facility has been operating “at a substantial loss” in the past few years, and they’ve struggled to maintain the equipment and other systems needed to keep the facility running.The pandemic-related closure also affected the facility’s ability to stay afloat, and despite numerous efforts, officials could not find ways to keep the Ice-Plex open.“We close our doors with a heavy heart and would like to extend our deepest thanks to our athletes, customers, staff and volunteers, who have been responsible for creating a welcome and competitive environment at Ice-Plex. ESCONDIDO, Calif. (KGTV) -- Neighbors in an Escondido neighborhood are worried after they say dozens of tires were slashed overnight Saturday.The incidents reportedly happened on 4th Avenue and 2nd Avenue between Date and Elm Streets.Residents on 4th Avenue reported waking up Sunday morning to find that at least 11 vehicles had their tires slashed.Similarly, residents on 2nd avenue reported that nearly 30 vehicles had slashed tires.Police said they have been made aware of the incidents but it’s unclear if they have a suspect or will be investigating.Imagine waking up and finding your tires slashed, then finding out it happened to DOZENS more on your block.
