The U.S. Supreme Court has declined to weigh in on the battle over pension reform in the city of San Diego. The decision leaves in place a California Supreme Court decision from last year that called pension reform into question and required a lower court to come up with a remedy. It could end up costing the city billions. In 2012, San Diego voters approved Proposition B with 65 percent in-favor. The measure ended pensions for nearly all new city hires, instead switching them to 401(k) type plans. Around the time, the city faced a billion pension liability, comprising 20 percent of the budget. "It is saving us, literally, hundreds of millions of dollars," Mayor Kevin Faulconer said Monday. "That's why it's important, so we can invest dollars back into neighborhoods."The city, however, is now on the legal defensive. Back in 2012, then-mayor Jerry Sanders campaigned on behalf of the measure. Labor unions argued Sanders' involvement required the city to meet and confer with unions before changing their terms of employment. The city argued that Sanders was exercising his First Amendment right to endorse the measure, which got to the ballot via a citizens initiative. The state Public Employee Retirement Board sided with the unions. So did the California Supreme Court, which last year ordered lower courts to decide a remedy. "There is not even a breath of a suggestion in this case that any public officials First Amendment rights have been violated," said Ann Smith, the attorney representing the labor unions. In a statement, Sanders, who now heads the San Diego Regional Chamber of Commerce, called the Supreme Court's decision disappointing but not unexpected. Some of the speakers referenced how the coronavirus pandemic has provided an experiment for virtual learning.“But the virtual learning is not like being in a classroom, and we’ve learned that, I think, very strongly — in almost all cases. People thought for a long time that would be the answer but it’s — that’s not the answer. The answer is an old-fashioned one,” President Trump said.The recommendations encourage the use of masks and social distancing, as well as educating students, teachers and staff about Covid-19 symptoms. They follow guidance released earlier this year from the Centers for Disease Control and Prevention.The document lists eight recommendations for schools:Ensure all students, teachers, and staff understand the symptoms of COVID-19 and its risk factors.Require all students, teachers, and staff to self-assess their health every morning before coming to school; if they are symptomatic they should consult their physician.Encourage frequent handwashing or hand sanitizing during the school day, beginning upon entrance to the school, by ensuring that handwashing facilities are widely available throughout the school.Minimize large indoor group gatherings; hold large gatherings outdoors whenever possible.Maintain high standards of hygiene and ventilation within all classrooms, including keeping windows and doors open and running fans and AC units whenever possible.Require students, teachers, and staff to socially distance around high-risk individuals.Encourage the use of masks when social distancing is not possible.Liberally post instructions regarding hygiene and social distancing around the school.There are also recommendations for high-risk teachers and students, including giving these individuals options to stay home.“Provide high-risk students, or students who have high-risk family members, the choice to stay home and engage in distance learning,” the guidance states.The policy is a set of recommendations and not mandatory for schools to reopen. The Secret Service arrested a man near the White House on Monday, after they had been told to be on the lookout for a man who allegedly threatened to kill "all white police" there.Monday afternoon, police in Montgomery County, Maryland, alerted the US Secret Service that the man planned to go to Washington with the purpose of killing officers at the White House, according to a USSS statement. About an hour later, Secret Service officers spotted him on Pennsylvania Avenue near Lafayette Park, according to the statement. He was arrested without incident. Officials say charges are pending.The Secret Service's protective intelligence division was notified at about 2:55 p.m. ET to be on the lookout for Michael Arega of Dallas, who the Montgomery County Maryland Police Department said was heading to Washington for the purpose of killing "all white police" at the White House, according to the statement. The U.S. Census Bureau says only a tiny percentage of records are affected by data irregularities that are putting in jeopardy a year-end deadline for turning in numbers used for divvying up congressional seats. However, released internal documents show the "high complexity" problems could push the release to February 2021. The Census Bureau told a congressional committee Thursday that the anomalies are being resolved as quickly as possible. House Democrats however say documents they obtained from Census sources, despite Trump administration stonewalling, show hundreds of thousands of records are affected.Fixing the irregularities could mean missing a Dec. 31 deadline for the Census Bureau to turn reapportionment numbers in to Congress. The internal Census documents shared by House Democrats show the data issues, which include several "high complexity" problems, could delay the once-a-decade report until February. Although the documents do not specify the extent of the larger issues, they do say incorrect handling of the issues could skew the count smaller or larger in some areas. They also say the Census Bureau estimates they need an additional 20 days for data processing. The bureau says the timeline remains in flux.The Census Bureau issued a statement asserting that "these kinds of anomalies and issues are expected and are similar to the Census Bureau's experience in prior decennial censuses." The Census Bureau Director acknowledged the issues in mid-November, more details and the delayed timeline are coming out now. The timeline is getting attention because it may or may not be after President Donald Trump leaves office on January 20. Trump has expressed interest in excluding unauthorized immigrants from the Census count. There have been challenges in court and questions about whether this could legally be done, and also whether it physically can be done by coming up with a reliable number to exclude. Three lower courts have blocked the directive from Trump saying it violates federal law that says the census should could the "whole number of persons" in each state. The Supreme Court just this week heard arguments in the case. They have not issued their ruling yet. 2215
