SAN DIEGO (KGTV) --  A federal judge ordered that the Trump administration reinstate the Deferred Action for Childhood Arrival program, also known as DACA. The DACA program - which protects nearly 800,000 undocumented immigrants brought to the United States as children from being deported. While the decision has been made, it won't be an easy road for the people involved. The restart is delayed until August 23, to allow the government time to appeal Judge John Bates' decision.  For Dreamers like Ali Torabi, Friday's win is just the latest in the political tug of war.RELATED: San Diego Dreamers heading to the Capitol“I was preparing for, in the next four days, the complete opposite," Torabi said. He believed he might be deported. "I was actually working on my med school applications, and I was like, ‘I need to get my things together now.’”Torabi is a DACA student from Iran and a 22-year resident of San Diego.  He said Judge Bates' decision is huge for the undocumented immigrants protected by the program. But being in constant limbo can be emotionally draining. "Having this back and forth, where one day we don’t know if we’ll have any protection and were up to be potentially deported or detained, to telling us, well yea we’ll keep the protections...it’s difficult," he said. "I’m not going to lie to you, it’s emotionally difficult.”It isn't over yet. Judge Bates ruling could conflict with another decision on the program -  expected to be ruled on by a federal judge in Texas by as early as next week. The Texas Attorney General calls the program unconstitutional because it came from an executive order.“It invites future presidents to ignore the law, ignore the will of the people, and set their own policies on the second amendment, privacy rights, drug laws, or any other important issues debated in Congress," said Texas Attorney General Ken Paxton. Torabi said he has hope. But getting to the finish line, "It’s exhausting, it really takes a toll on your mental health, on your emotional health, and we’re just getting tired of it.”   2132

SAN DIEGO (KGTV) - A brother and sister who own two Rancho Bernardo nail salons were arraigned Thursday on federal charges they were part of a forced labor conspiracy. Cindy Mydung Luu and Jason Luu lured their second cousin from Vietnam to San Diego in 2014 to work long hours in their salons, Eden Nails Lounge & Spa and Majestic Nail Salon, prosecutors said. The woman arrived on a student visa and attended Grossmont College, but applied for a spouse visa after marrying Jason Luu in 2016. Prosecutors said the siblings “engaged in a scheme intended to cause the victim to believe she would suffer financial and reputational harm if she did not continue working.” The siblings own Eden Nails Lounge & Spa and Majestic Nail Salon in Rancho Bernardo.“We are very grateful that this matter came to the attention of the Human Trafficking Task Force upon the suggestion and support of two caring and vigilant nail salon customers who had befriended the victim,” said U.S. Attorney Robert Brewer. “With their assistance, Task Force officers were able to assist the victim immediately and to investigate these alleged crimes.” The U.S. Department of Labor’s Wage and Hour Division also investigated the defendants’ nail salon for minimum wage and overtime violations, according to prosecutors. The Luu’s were arrested at their home in Tierrasanta Thursday morning. They are scheduled to appear in federal court on Jan. 17. 1434

SAN DIEGO (CNS) - Three thieves, one armed with a gun, assaulted a man Monday during a pre-dawn home-invasion robbery in a Bay Terraces-area neighborhood. The victim spotted the trio of burglars inside the house in the 7100 block of Terra Cotta Road about 3:30 a.m., according to San Diego police. One of the intruders pointed a gun at the man while demanding valuables along with his cohorts, Officer Frank Cali said. During the confrontation, at least one of the robbers hit the victim with an unidentified object. After gathering property from inside the residence, the thieves fled in a stolen maroon 2011 Toyota RAV4, California license No. 6UJW830. The victim described the burglars as teenage boys or young men in their late teens or early 20s, dressed in dark clothing. No serious injuries were reported. 820

SAN DIEGO (CNS/KGTV) - A federal judge in San Diego today ordered the Trump administration to immediately start new asylum screenings for eligible reunified families, despite objections from the government that the agreement has not been finalized.Under the proposed settlement agreement – which U.S. District Judge Dana Sabraw gave unofficial preliminary approval to last month – reunited migrant families would get a second chance at applying for asylum.Attorneys for the migrant families argued that when the families were separated at the border, most children were not interviewed to determine if they had a credible fear of returning to their native country. Their parents were granted interviews, but were so distraught after being separated that they didn't clearly advocate for themselves, attorneys said.Under the settlement, reunited migrant families still in the U.S. will be allowed to remain until all family members have completed the asylum process. When Sabraw unofficially approved the settlement, both sides agreed that the asylum determination process should get underway as soon as possible.Sabraw granted preliminary approval last week, paving the way for credible fear interviews to proceed within days of a migrant confirming his or her wishes to go forward with an asylum claim. The ruling appears to apply to about 60 people who are detained and had signed paperwork agreeing to the terms of the new process. It could end up applying to many more.Another status conference on the class-action lawsuit is scheduled next month. 1576
