Florida prosecutors have charged a Miami police officer they say tried to kick a suspect who was being handcuffed on the ground, in an encounter captured on video.Mario Figueroa, a two-year veteran of the force, was charged Tuesday with assault, a second-degree misdemeanor, after the cell phone video of the incident surfaced last week."Officer Mario Figueroa can have no excuse for the alleged actions seen on the initial videotape," State Attorney Katherine Fernandez Rundle said in a new release. "This community demands respect for all individuals taken into custody."Police said they were beginning the process of firing the officer. 647

Former Trump campaign chairman Paul Manafort on Monday gave up his effort to challenge special counsel Robert Mueller in civil court.Manafort has withdrawn his appeal of a judge's decision to throw out his civil lawsuit against Mueller, according to court filings."It is hereby stipulated and agreed by and between the parties that the (case) be voluntarily dismissed," the new filing said.Manafort filed the initial lawsuit in January against Mueller, the Justice Department and Deputy Attorney General Rod Rosenstein,?who appointed Mueller as special counsel. A federal judge?dismissed the case in April, saying that the civil proceedings were "not the appropriate vehicle" for Manafort to try to chip away at Mueller's authority. In her ruling, federal Judge Amy Berman Jackson told Manafort to pursue his grievances against Mueller during his criminal proceedings. Manafort then asked the federal appeals court in Washington, DC, to review her decision. The decision to drop the appeal comes one day before Manafort's criminal trial is scheduled to begin in Virginia federal court. Manafort is accused of financial crimes, including bank fraud and tax evasion, relating to his lobbying work for the government of Ukraine. He has pleaded not guilty to the charges. Jury selection begins Tuesday. The unsuccessful civil lawsuit sought, among other things, to prevent Mueller from bringing additional charges in the future, including potential charges relating to Manafort's work on the Trump campaign. Mueller is investigating Russian interference in the 2016 election, including potential coordination between the Trump campaign and Russia. President Donald Trump and Manafort have both said there was no collusion.Manafort has used similar arguments to challenge his indictments in Virginia and Washington. But federal judges overseeing both cases have upheld Mueller's authority to investigate and prosecute Manafort. One of the judges, T.S. Ellis, said prosecutors rightfully "followed the money paid by pro-Russian officials" to Manafort.Manafort is also charged in federal court in Washington with undisclosed foreign lobbying and money laundering. He pleaded not guilty to these allegations, and the case is scheduled to go to trial in mid-September.The judge overseeing that trial, Berman Jackson, revoked Manafort's bail last month and ordered him to await trial from a jail cell. He is appealing that decision, and that appeal was still active as of Monday afternoon. 2509

Football coach Derrick Clark was a convicted drug dealer when he was hired two seasons ago for New Haven Endeavour Middle School in New Haven, Michigan. Now he’s in jail facing serious sex charges.  School Superintendent Todd Robinson talked with Jim Kiertzner, investigator for Scripps station WXYZ in Detroit and said he knew Clark had some criminal past, saying “Not to the extent that you’re sharing with me now.”  Robinson would not say what his understanding of it was. “I don’t want to make any more comment about it at this time.” Robinson also would not answer if he would still hire him if he knew what he knows today.State records show Clark was convicted of drug possession and running a drug house and was on probation from 2009 to 2014. Clark now faces charges of third degree criminal sexual conduct, pandering and racketeering in Macomb County.  Police said Clark reportedly sold his girlfriend for sex with online ads dozens of times over several months and threatened her and kids to go to Child Protective Services. At least one “John,” a man who paid for sex, is cooperating with police.John Wallace, who lives next door to the school says, “That sounds to me like another Nassar case.”Other parents said they are upset.Clark was hired through a contracting firm called EDUStaff in Grand Rapids.  The company president, Clark Galloway, sent us a statement that says criminal background checks and approval are up to school districts and Clark is not the only employee they’ve supplied: 1572

For most of his career, Louis C.K. has been known as one of the most self-deprecating comics in the business. So it should not have been a total shock when the comedian released a lengthy statement of apology Friday following the New York Times story published a day before that included sexual misconduct allegations from five women.Louis C.K. did what many celebs have not, however, by admitting guilt."These stories are true," Louis C.K. said in his statement.Compared to Harvey Weinstein, who denied rape and other accusations, and Kevin Spacey, who apologized but claimed he doesn't remember assaulting actor Anthony Rapp, Louis C.K.'s mea culpa is considered by some as a step in the right direction.Still, the reaction to his admission, and his contention that he's "remorseful," has been decidedly mixed. While some found it admirable that Louis C.K. fully copped to his offenses, others took to social media to say that his statement in no way negates what he did. Some pointed out that the apology came after the revelations were made public, and Louis C.K. had lost a distribution deal for his movie, a forthcoming stand-up special with Netflix and his content was removed from HBO streaming services. For years, there was chatter about Louis C.K.'s inappropriate behavior toward women. As recently as September, the comic denied the charges to the New York Times, stating that they were "rumors."And some noted that C.K., while apologetic, didn't actually say "I'm sorry" to the women. Nowhere in his nearly 500-word statement were there the words "sorry," "apology" or "apologize."The one thing that many people think is a good thing: The comic says that while he has spent most of his career "talking and saying anything I want" he "will now step back and take a long time to listen." 1801
