SAN DIEGO (KGTV) — Eight San Diego County gyms have filed a lawsuit against state and county leaders over the public health orders due to the coronavirus pandemic.The gym owners say that restrictions on their business by California and the county have caused, "difficulty in satisfying their financial obligations, having been forced to lay off a significant number of employees" and they have "expended large sums of money in an effort to comply with Defendants’ vague orders."Gym owners say they have lost tens to hundreds of thousands of dollars, in some cases, retrofitting their businesses to be compliant with reopening measures.The Plaintiffs include Metroflex Gym in Oceanside, Ramona Fitness Center in Ramona, Boulevard Fitness in University Heights, Deadweight Strength in Grantville, Convoy Strength in Kearny Mesa, IB Fitness in Imperial Beach, and Being Fit in both Clairemont and Mira Mesa.The owners added that they have sought clarification of the orders and how they're enforced by law enforcement and the county, but have not received any clarification from officials.The lawsuit claims that public health orders labeling their businesses as nonessential without allowing them to challenge it, and mandatory closures, are not constitutional.Defendants include Gov. Gavin Newsom, all five San Diego County supervisors, and the mayors of each city where the gyms are located. Various local law enforcement and public health officials, including Wilma Wooten, Sheriff Bill Gore, and SDPD Chief David Nisleit, were also named. 1548

SAN DIEGO (KGTV) — FBI investigators are searching for a man they say robbed two Wells Fargo locations over the last two months.The man entered the Wells Fargo at 5522 Balboa Ave. just after 5 p.m. on Sept. 11 and handed the teller a note demanding money, according to FBI investigators. The man then left the bank on foot in an unknown direction.Investigators believe the same man also robbed another Wells Fargo location at 276 N. El Camino Real in Encinitas just after 3 p.m. on Oct. 6. SAN DIEGO (KGTV) - Dozens of people came out to see a country music concert at Moonshine Beach in Pacific Beach Thursday night.The concert was scheduled before the Borderline Bar and Grill shooting in Thousand Oaks Thursday night.  Brodie Stewart was opening for Colt Ford.Country Music Stewart told 10News ahead of the show he would hold a moment of silence for the victims of Borderline during his show. He also said proceeds from his merchandise sales would also be donated to victim’s families.“It’s hard to talk about because it’s so close for our friends and the country music community,” Stewart said. “It’s been devastating.”Becky Williams, a long-time country music fan, said it’s unfortunate that it was the second attack in a country music venue in just a little over a year.  The Route 91 Harvest Festival in Las Vegas in October 2017, was the deadliest attack by a lone gunman in America.  Despite the repeated attacks, Williams said that she didn’t think twice about attending the concert Thursday night.“Heck no, country music is my life,” Williams told 10News.Survivors from the Las Vegas shooting said the Borderline shooting reopened old wounds and churned up former emotions.“I still haven’t been able to really cope with it, and it brought that back up to the surface,” said Kyle Hurd, who survived the Las Vegas shooting.Others shared the same sentiment, saying it was the best place anyone part of the country music could be.“We love that we can get together and mourn together and we understand each other,” Kimberly Burroughs said. 1578

  

SAN DIEGO (KGTV) - Despite criticism, a spokesperson for the California Republican Party told ABC 10News on Tuesday that the party will continue placing unofficial ballot drop boxes around communities.They've popped up in Orange, Los Angeles, and Fresno counties, but so far none have been reported in San Diego. Several have been labeled "official", as confirmed by CA GOP spokesperson Hector Barajas. “We could've had better wording on the ballot boxes and so we changed some of the wording around already on the ballot boxes but the important thing to remember is that these ballot boxes are inside our campaign headquarters or inside of businesses or other organizations. It's not as though they're outside in front of a mailbox or outside a library or a secondhand store or another place of business,” he told ABC 10News.On Monday, California's Secretary of State and the State Attorney General sent a cease and desist to the GOP, calling the boxes illegal. Some argue that the boxes are deceptive and could lead to tampering. “These boxes are not the same as county election drop boxes that are required to meet state security standards,” said California Secretary of State Alex Padilla.Barajas told ABC 10News, “What is happening right now is the Secretary of State -- with this cease and desist -- is basically looking to engage in voter suppression [by] eliminating more options for individuals to be able to drop off their ballot.”Barajas said that "ballot harvesting" is a practice that allows a third party to collect voters' completed ballots and was legalized four years ago in a bill authored by San Diego Assemblymember Lorena Gonzalez.A tweet Tuesday from one of Gonzalez’s accounts reads, "Apparently, Republicans in our legislature think that when I wrote that a voter could designate a 'person' to turn in their ballot, they thought I meant a fraudulently labeled box. I'm terribly sorry. I will define person next time.”When asked how many boxes the GOP has placed around the state, Barajas responded, “We're not giving an exact number but we will say that we've got them statewide and with the amount of press we've gotten on this we're considering maybe even doubling or tripling our efforts.”The San Diego County Registrar of Voters reports it has already received 175,000 completed ballots. A spokesperson said Tuesday that any reports of unofficial ballot boxes would be referred to the Secretary of State. 2440
