SAN DIEGO (CNS) - An ex-con who opened fire in the Gaslamp District two years ago, wounding an off-duty sheriff's deputy and a bystander, was sentenced Wednesday to 71 years to life in state prison.Ray Pitoau, 39, was convicted last month of two counts of assault with a firearm for the Aug. 7, 2017, shooting that injured Deputy Jason Philpot, who was walking through downtown with his two brothers following a Metallica concert at Petco Park. Also injured was bystander Vladimir Shvets, a passerby in San Diego for a convention.Pitoau was also convicted of a lesser charge of assault on the deputy's younger sibling, Joshua.Prosecutors said Philpot and his group walked past Pitoau, who got into an argument with the deputy's sibling on Island Avenue near Sixth Avenue just after 1 a.m.RELATED: Man convicted of assault with gun in Gaslamp shooting that wounded deputyPitoau testified that he pulled out a gun in self-defense because a group of men, including Jason Philpot, were advancing on him. He testified that he and the deputy both grabbed onto the gun, leading it to fire as they grappled over the weapon.Jason Philpot testified that he tried to wrap his arms around Pitoau and get the gun away, but the defendant was able to pull the trigger, wounding the deputy in the chest and right arm. One of the rounds ricocheted off the sidewalk and struck Shvets.Pitoau was arrested about a month later in Mexico.RELATED: Man convicted in Gaslamp shooting involving off-duty deputy sentencedSan Diego County Superior Court Judge Melinda J. Lasater declined to dismiss a number of allegations that added years to Pitoau's sentence due to his numerous prior convictions for crimes dating back to 1991, including burglary, assault, and being a felon in possession of ammunition.Deputy District Attorney Michael Reilly said Pitoau had demonstrated a history of re-offending each time he was released from prison and that "he knew better" than to bring a gun to the Gaslamp Quarter that day.Defense attorney Jessica Marshall said evidence at trial showed the Philpots and other members of their group had been drinking and were being aggressive, with the attorney arguing Pitoau "is not the only reason this happened."RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffJurors deadlocked on the assault counts in Pitoau's two previous trials, though one of those juries convicted Pitoau on three felony firearm possession counts. 2459

SAN DIEGO (CNS) - Health officials Wednesday reported seven more deaths in San Diego County due to influenza complications last week, bringing this flu season's death toll to 42.The seven residents were between the ages of 53 and 90 and all had additional medical issues. Only two of them had been vaccinated, according to the county Health and Human Services Agency. At this time last flu season, the county had received reports of 281 deaths due to flu complications. The county also saw a new weekly high for lab-confirmed flu cases at 545, according to the HHSA's weekly flu report. The county has recorded 5,486 confirmed flu cases so far this flu season, a far cry from the 17,397 reported at this time last flu season. County health officials touted the data in the weekly flu report as evidence that the current flu season may still be cresting."Influenza is still widespread in the region and continues to sicken San Diegans," said Dr. Wilma Wooten, the county's public health officer. "Anyone who has not yet had a flu vaccine this season should get it now."County health officials and the Centers for Disease Control and Prevention strongly advise the annual flu vaccination for everyone 6 months and older, especially demographics with a heightened risk of serious complications, such as pregnant women, people older than 65 and people with chronic conditions. Recent flu seasons have extended as late into the year as May, according to county health officials.Flu shots are available at doctors' offices, retail pharmacies, community clinics and the county's public health centers. Residents can also call 211 or visit the county's immunization program website, sdiz.com, for a list of county locations administering free vaccines. 1751

SAN DIEGO (CNS) - A new indictment unsealed Thursday against the owner/operators of San Diego-based pornographic website GirlsDoPorn.com alleges that co-owner Michael James Pratt -- who remains on the lam on federal sex trafficking charges -- also produced pornographic content involving a 16-year- old girl. Pratt was charged in a complaint last month along with three others with sex trafficking by force, fraud and coercion for allegedly filming victims under the guise of distributing the videos only to private clients, then disseminating the videos online without the victims' knowledge or consent. The new indictment adds two additional defendants and charges of production of child pornography and sex trafficking of a minor against Pratt alone, with the incidents allegedly occurring in September 2012. RELATED: San Diego porn case: Civil trial against GirlsDoPorn.com website operators beginsThe indictment also names website co-owner Matthew Isaac Wolfe; porn actor Ruben Andre Garcia; administrative assistant Valorie Moser; Amberlyn Dee Nored, allegedly one of the reference women accused of lying to victims about the nature of the work; and a sixth defendant whose name is redacted. According to the U.S. Attorney's Office, numerous young women who initially responded to ads for modeling jobs were allegedly deceived by the defendants to appear in adult films. Once the victims learned the work involved pornography, the defendants allegedly told them the videos would be distributed to private clients -- usually living overseas -- and not disseminated on the internet. To help convince the women to participate, reference women like Nored were allegedly hired to lie to the women and claim they had also filmed pornographic videos for the defendants, which were never posted on the internet. RELATED: San Diego porn site owners, employees charged with sex traffickingProsecutors allege the women were ``pressured into signing documents without reviewing them and then threatened with legal action or outing if they failed to perform.'' Others were not allowed to leave the shoots -- which were conducted at various San Diego hotels -- until the videos were completed, which sometimes involved sex acts the victims initially declined to perform, prosecutors allege. The defendants are also currently involved in a San Diego civil trial involving a lawsuit filed by 22 women who appeared in videos on the site. The allegations in that trial -- which began in mid-August -- mirror the new federal charges. In that case, the victims are seeking more than million in damages and ownership rights to the videos they appeared in.
