(CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. McDavid faces 50 years to life behind bars, and Lovejoy could be sentenced to 25 years to life.After court, the jury foreperson, Erin Reed,  told reporters the defense version of the shooting "seemed too far-fetched." 2224

VISTA, Calif. (CNS) - A suspected unlicensed and intoxicated driver who allegedly struck and killed a Fallbrook woman while she was walking with her husband, then fled the scene and sold the involved vehicle, pleaded not guilty Tuesday to charges that include gross vehicular manslaughter while intoxicated.Pascual Cristobal Pascual, 34, of Fallbrook, is accused in the Dec. 10 death of 60-year-old Symone Conley, who was struck by a pickup truck that veered out of a traffic lane on Gird Road near Laketree Drive and jumped a curb, according to the California Highway Patrol.Conley died at the scene.Following the deadly impact, the motorist pulled over and remained in the area for a short time before driving off, the CHP reported.Deputy District Attorney David Uyar said Pascual purchased alcohol about 15 minutes prior to the deadly crash and purchased more alcohol during the weekend following the crash.Pascual was arrested three days after Conley's death, but not before he allegedly sold the vehicle involved in the crash."Not only has he demonstrated his willingness to flee and evade justice, but also to attempt to destroy evidence in the process," Uyar said.Investigators identified Pascual as the alleged hit-and-run driver based on physical evidence at the scene of the traffic fatality, statements from the victim's husband and "numerous calls and leads," CHP public-affairs Officer Mark Latulippe said.At his arraignment, San Diego Superior Court Judge Amalia L. Virginia Gov. Ralph Northam has declared a state of emergency in Charlottesville this weekend as the city braces for demonstrations on the one-year anniversary of deadly white supremacist rallies.While the group who organized last year's "Unite The Right" rally will be marching in Washington, DC this weekend, the city of Charlottesville is bracing for large crowds according to the city website.Violence broke out at the first "Unite The Right" on Aug. 11 and 12 last year in Charlottesville as white supremacists and counter-protests clashed. One counter-protester was killed when a white nationalist rammed his car into a crowd. VISTA, Calif. (KGTV) -- Jury selection is expected to take all week in the trial of former NFL tight end Kellen Winslow II. The San Diego football star and son of Chargers Hall of Famer Kellen Winslow Senior pleaded not guilty to charges that he raped two homeless women in Encinitas last year. He's also charged with raping an unconscious seventeen-year-old girl back when Winslow was nineteen. Prosecutors say he was out of custody on million bail in connection with the felony case when he got in trouble again. Prosecutors say he fondled himself in front of a 77- year-old woman at a Carlsbad gym, asked her if she liked it, and groped her while she was in a hot tub at the same gym.Jan Ronis is a San Diego defense attorney not affiliated with the case, but watching it closely. "From what I've seen at the preliminary examination, everyone that testified seemed to have a lot of credibility. These were older women, you would extend the greatest credibility to that kind of witness," said Ronis. Winslow played ten seasons with the NFL. His defense team is reportedly planning to call two psychiatrists to testify. It's unclear if CTE, or Chronic traumatic encephalopathy will play a role in that defense. Ronis says it might not make a difference. "You can still be responsible for your conduct , criminally responsible, after having sustained a traumatic brain injury or something of that nature. It's different than say, your mental health issue was such that rendered you incapable of understanding the nature of your conduct that you couldn't understand the difference between right and wrong, " said Ronis.
