The investigation into social media misconduct in the United State Marine Corps. has resulted in at least 55 Marines being punished, including seven courts-martial.USMC said Friday the cases stemming from a massive scandal into online misconduct "proved to be a symptom of a larger problem of bias and exclusion."The 55 Marines punished include seven special and summary courts-martial, six administrative separations, 15 non-judicial punishments, and 27 adverse administrative actions. At least 123 individuals have been investigated for incidents of misconduct involving the non-consensual distribution of explicit images, according to officials. The number of Americans newly diagnosed with the coronavirus is falling — a development experts say most likely reflects more mask-wearing but also insufficient testing — even as the disease continues to claim nearly 1,000 lives in the U.S. each day.About 43,000 new cases are being reported daily across the country, down 21% from early August, according to data compiled by Johns Hopkins University. While the U.S., India and Brazil still have the highest numbers of new cases in the world, the downward trend is encouraging.“It’s profoundly hopeful news,” said Dr. Monica Gandhi, an infectious-diseases expert at the University of California, San Francisco, who credits the American public’s growing understanding of how the virus spreads, more mask-wearing and, possibly, an increasing level of immunity.“Hopefully all those factors are coming into play to get this virus under control in this country that’s really been battered by the pandemic,” she said.But insufficient testing is probably concealing the full extent of the crisis, said Dr. Jonathan Quick, who leads the pandemic response for the Rockefeller Foundation, which has recommended the U.S. test 4 million people a day by fall.“We’re grossly under-testing in some of the places that are still having high caseloads,” Quick said, singling out Mississippi, Texas, Georgia and North Dakota as hot spots with high rates of positive test results.Even at 43,000 new cases per day, the U.S. remains far above the numbers seen during the spring, when new daily cases peaked at about 34,000, he said.“It’s a good trend, but nowhere near what we need to be,” Quick said of the recent decline.The virus is blamed for more than 5.7 million confirmed infections and about 178,000 deaths in the U.S. Worldwide, the death toll is put at more than 810,000, with about 23.7 million cases.Jeffrey Shaman, a public health expert at Columbia University, said he is skeptical enough people are immune to significantly slow the spread. It was so horrifying that people stopped touching each other,” Shaman said. More than 2,000 people arrived at the state’s hospitals showing symptoms of the virus on a single day in early July. This week, that number has been less than 1,000.In Florida, where more than 10,000 people have died, the state reported 2,600 new virus cases Tuesday. While many questions remain in Washington, like whether President Donald Trump has the votes to replace Ginsburg before the election, one thing is clear: issues will come before the Supreme Court very soon.HEALTH CARE ARGUMENTS IN NOVEMBERWhile election issues are expected, the future of the Affordable Care Act is an issue guaranteed to come up before the Supreme Court soon. A hearing is set to take place one week after the election regarding whether the law can be struck down. Essentially, Republicans from around the country believe that the only reason the Supreme Court upheld the law in 2012 was because the opinion said Congress has the power to tax. Since that time, however, Trump has removed the tax penalty for not having health insurance. The thinking from some conservatives is that since the tax penalty is gone, the entire law can be struck down now, too. WHERE THE COURT STANDS Prior to Ginsburg's death, the general thinking was that the law would still stand. It faced a challenged in 2012, but Chief Justice John Roberts sided with four liberal justices to uphold it. With Ginsburg's passing, there are only three liberal justices on the court. If Roberts joins the liberal justices it would create a 4-4 tie. "If there is a 4-4 split on the court, then no precedent is set and whatever the lower court decided stands," Professor Paul Schiff Berman with George Washington University said. That would mean parts of the Affordable Care Act can be struck down since lower courts have already ruled in that way. If Trump is able to get another nominee on the court before the hearing, it would only make the court more conservative. Berman cautioned though that other conservatives could potentially join the liberals on this case since the lawsuit's legal standing is murky. Still, the future of the Affordable Care Act is in more jeopardy today than it was last Thursday. 2020
