SAN DIEGO (KGTV) - A judge decided Friday to place a sexually violent predator in the East County community of Boulevard. Michael Joseph Martinez, 64 has multiple previous convictions including child molestation and lewd and lascivious acts upon a child under 14, according to County Supervisor Dianne Jacob’s office.The judge added Friday that the sheriff’s department will be extra vigilant and security will be heightened.The judge decided to place Martinez at the Department of State Hospitals recommended location of 2135 McCain Valley Road. The schools closest to the address include Clover Flats Elementary School and Jacumba Elementary School, according to the San Diego County Sheriff's Department.A mother of one of the victims from 25 years ago spoke at the hearing saying, “I know that you can’t change the order and I’m glad that there’s going to be very strict ordering, but I hope this doesn’t happen to another child or family.”RELATED: Dianne Jacob slams proposed placement of predatorJacob said the placement would put public safety at risk. She adds that several sexually violent predators have been placed in East County in recent years and in some cases, the convicts ended up violating the conditions of their placement.In a letter to Judge David M. SAN DIEGO (KGTV) — A new study reveals the importance of having qualified athletic trainers available at high schools. One of the experts behind the study says he is shocked at how poor a job California does at regulating athletic safety."California is either dead last or next to last in all of these ratings of high school sports safety," according to Dr. Eric Post, an Assistant Professor at San Diego State University, who helped author the study.Robbie Bowers, trainer at Rancho Bernardo High School, says only about 60 percent of California schools have a certified trainer. With several sporting events and practices occurring for each school on any given day, it's nearly impossible even for schools with a trainer to have adequate coverage for all athletes.According to Post's research, that greatly increases the risks for student athletes who suffer an injury. "At schools with low athletic trainer availability, kids with a concussion were more likely to have that concussion go unidentified and also more likely to have that concussion be mismanaged as a result." Post adds that at schools with low trainer availability, an athlete with a concussion was often not treated until 24 hours after the injury. At schools with adequate trainer availability, athletes got initial treatment within 30 minutes.Bowers has backed previous efforts to create a statewide standard and certification; however, those legislative attempts have failed to pass. SAN DIEGO (KGTV) — A North Park gym owner who defied the governor's health order and moved workouts indoors was served with a violation notice from the county, threatening ,000 daily fines. Owner Frank Kole initially complied with last month's order and moved everything outdoors, but after five days made the decision to go back inside. That's because he says the sidewalks outside his gym were littered with feces, blood stains, and trash. Kole instead instituted strict rules indoors, requiring masks and social distancing. But the county, while acknowledging the tough reality outside, still served him with the violation, saying it was the law. RELATED: North Park gym moves back in after 'disgusting' outdoor workouts"I appreciate that you previously complied with the state and local orders by moving your operations outdoors and had difficulties due to the surrounding environment," said the violation letter, signed by Public Health Officer, Dr. Wilma Wooten. "I encourage you to work with the city of San Diego to see what can be done to resolve the difficulties you previously faced." On Friday, however, Kole took everything back outside. Immediately, he and his staff discovered a syringe on the sidewalk as they were setting up equipment. The city of San Diego power washed the sidewalk on Wednesday, but Kole says it was a quick job without trash pickup. "If we weren't out there cleaning that sidewalk up everyday, that needle would still be there," Kole said. A spokeswoman for the city of San Diego says environmental crews will pick up syringes with biohazard boxes when they encounter them. In the meantime, residents can report the on the city's Get-it-done App. Kole says he will comply with the order and keep the gym outside, even if it means reduced hours and more staff time moving everything in and out everyday. "I'm a proud American and I'm a proud business owner and I will do what it takes to keep my business alive," Kole said. SAN DIEGO (KGTV) - A marijuana delivery driver was robbed at gun point and shot in North Park late Friday.According to San Diego Police Officer Robert Heims, the 21-year-old victim was making a delivery in the 2000 block of Haller Street at about 9:01 p.m. when a gunmen approached his vehicle and demanded marijuana.Related: Million dollar Fed?cartel seizureThe driver grabbed the suspect's gun and as they wrestled for the weapon the driver was shot twice in the right hand. SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial.
