SAN DIEGO (CNS) - A federal lawsuit has been filed against several puppy stores in San Diego and Riverside counties, as well as an allegedly fake Missouri-based animal rescue organization accused of taking part in an illegal puppy mill operation, adding to existing litigation claiming the stores fraudulently label their dogs as rescues.The lawsuit, filed Friday in San Diego federal court on behalf of Maryland-based nonprofit PetConnect Rescue Inc., is one of several filed recently against Utah resident David Salinas, who owns several stores in the San Diego region, including two named in the lawsuit: Broadway Puppies in Escondido and Pups & Pets in Santee.Plaintiffs' attorneys say the Salinas-owned stores obtain their puppies through the similarly named Missouri-based Pet Connect Rescue Inc., which allegedly "launders" dogs from illegal puppy mills, "falsely labeling them as `rescues."'"As nurses, doctors, grocery store and delivery workers risk their lives to provide essential services, and other businesses sacrifice by shutting down to protect public health, these illegal puppy stores continue selling purebred and designer puppies for thousands of dollars each, trucked in from Missouri, and fraudulently labeled as `rescues' so the owners can continue to profit from their illegal scheme," plaintiffs' attorney Bryan Pease alleged.In prior lawsuits, customers alleged they purchased what they were told were rescue puppies from Salinas-owned stores, only to have purchased a dog that was actually from a puppy mill. The dogs were often were riddled with illnesses -- sometimes leading to death -- due to being bred in poor conditions, according to prior litigation.A preliminary injunction was previously obtained by animal-rights organizations against National City Puppy, also owned by Salinas, which was ordered to shutter earlier this year in light of similar allegations.An evidentiary hearing had been set for this Friday in San Diego state court regarding preliminary injunctions against Broadway Puppies and Pups & Pets, but that hearing has been indefinitely postponed due to the San Diego Superior Court's coronavirus-related shutdown.In the latest complaint, the plaintiffs allege the stores have remained open for business during the coronavirus pandemic despite a statewide "stay at home" order issued by Gov. Gavin Newsom to all but essential services.While pet stores are exempt from closure due to Newsom's Thursday order, the lawsuit alleges the stores' continued operation "is putting the public at risk as well as continuing to defraud consumers into believing they are supporting `rescues' during this difficult time by buying a puppy."The complaint alleges that the stores' operation during the pandemic puts the public at increased risk of the spread of multi-drug-resistant Campylobacter infections, which the Centers for Disease Control and Prevention says has been linked to puppies purchased from pet stores. 2971

(KGTV) -- California State Senator Brian Jones tested positive for coronavirus, he announced on Twitter Wednesday.Jones said he learned of his positive test result after returning to Sacramento for the end of the session.According to Jones’ Twitter, the State Senator plans to take additional tests to rule out a possible false positive.“In the meantime, he’ll be following CDC and CDPH protocols for those receiving a positive test result,” a spokesperson said.The news comes as 228 more people throughout San Diego County tested positive for the virus Wednesday.So far, more than 37,000 people in San Diego County have tested positive for COVID-19. 677

San Diego was one of more than 3,600 locations that held the global Climate Change Walkout. Hundreds of teenagers marched from San Diego High School in Downtown to the San Diego Civic Center, hoping to make an impact, three days before the United Nations Climate Change Summit. It's a fight against time. Time, they say, the planet does not have. "Climate change is the existential threat of our generation," Elea Castiglione said. The sophomore at San Deigo High School organized the walkout with her friends. She and hundreds of students hoped their actions would inspire world leaders to take aggressive steps to combat climate change. Point Loma High School senior, Kisi Apaak performed her spoken-word piece, "Madness," at the San Diego Civic Center rally. Being 17, she said she does not have an income, nor does she have the right to vote. She said spoken-word is her way to show Mother Nature that she cares."This is all I know how to do, is write and talk and get out and take action," Apaak said. Many said they were inspired by Greta Thunberg, the 16-year-old Swedish climate change activist, who has now become the face of the movement. SAN DIEGO (CNS) - A former executive for an Orange County genetics company pleaded guilty today to a federal conspiracy charge for paying kickbacks to physicians.Donald Joseph Matthews, 50, formerly the vice president of market development for Proove Biosciences, admitted in San Diego federal court to paying doctors at least .5 million to order the company's DNA tests for their patients, according to the U.S. Attorney's Office.In total, the U.S. Attorney's Office said Proove billed around million to the Medicare program for the tests -- which the company alleged could determine a patient's risk of drug addiction -- and received around million in reimbursements.Prosecutors said the company claimed the payments were compensation for participation in a clinical research program, but the money was actually "directly tied to the volume of tests that a doctor ordered and whether a doctor continued to order more tests from Proove over time.''In his plea agreement, Matthews admitted that without the financial compensation, ``most doctors were not interested in ordering Proove's tests for their patients.''Doctors who complained about not being paid were told to order more tests, according to the U.S. Attorney's Office.The company's Irvine headquarters was raided by federal authorities in 2017.``Our nation's healthcare system cannot tolerate kickbacks to physicians while criminals line their pockets with taxpayer-funded healthcare dollars, particularly in light of our nation's current struggles with the COVID- 19 pandemic,'' said Acting Special Agent in Charge Omer Meisel of the FBI's San Diego Division.Matthews is scheduled to be sentenced Oct. 26. SAN DIEGO (CNS) - A 45-year-old man got into an argument with two males at the entrance to an alley in San Diego's Valencia Park neighborhood and was shot in the back Friday evening.The shooting was reported just before 8 p.m. at the entrance to an alley at 53rd Street and Imperial Avenue, San Diego Police Department Officer Robert Heims said.The man was standing with his girlfriend when the two males walked up, argued and one male fired several shots at the victim, hitting him once in the back, Heims said. The suspects fled the scene in separate vehicles, one of them red.Paramedics took the victim to a hospital where his injury was not believed life-threatening, Heims said.Gang detectives were investigating, Heims said. 738
