INDIANAPOLIS -- Former Subway pitchman and convicted child predator Jared Fogle is continuing his quest to be released from prison early – most recently by asking a federal judge allow him to withdraw his guilty plea.Fogle pleaded guilty in 2015 to federal charges of conspiracy to distribute/receive child pornography and of traveling to engage in illicit sexual conduct with a minor. He also agreed, as part of his plea, to pay 0,000 each to fourteen unnamed juvenile victims as restitution.Judge Tanya Walton-Pratt sentenced Fogle to serve more than 15 years in prison on the charges. Fogle has been serving that sentence at the federal penitentiary in Englewood, Colorado.Since his sentencing, however, Fogle has filed dozens of motions seeking to have his sentence either reduced or thrown out altogether.Last month, Fogle, who is now representing himself in the case, argued that Pratt “has bias” against him because she was the mother of two teenage daughters at the time of his sentencing. That claim was easily disproven, though: Pratt has only one daughter, and said daughter was 24 at the time Fogle pleaded guilty.Fogle’s most consistent claim – which he has repeated in multiple filings and is now pursuing in two separate cases (Fogle v. Walton-Pratt et al and Fogle v. USA) – is that he was wrongfully allowed to plead guilty to a conspiracy charge in the case. Fogle contends that no such charge exists under federal law.Fogle’s claim appears to stem from a reading of the statute under which he was sentenced – 18 U.S. Code § 2252(a)(2) – that overlooks or ignores a latter passage that states, “Whoever violates, or attempts or conspires to violate, paragraph (1), (2), or (3) of subsection (a) shall be fined under this title and imprisoned not less than 5 years and not more than 20 years…”Fogle, as noted in the plea agreement he signed, is accused of conspiring to violate paragraph (2) of subsection (a).In a filing to the court on March 5, Fogle excerpts section (a) of the statute, while omitting section (b) entirely.In another filing under his “conspiracy” argument, Fogle included portions of letters between former FBI Director J. Edgar Hoover and former Republican U.S. Rep. Karl M. Le Compte dated 1946 – along with a portion of the Communist Control Act of 1954.Fogle also included portions of a transcript from the 2016 United States v. Frank Edwin Pate case in which he appears to have underlined sections containing language about “aiding and abetting.” Pate – who is incarcerated at the same prison as Fogle on a 2015 conviction for wire and mail fraud – was ultimately unsuccessful in that case.Although Fogle asks the court to “take judicial notice” of the facts presented in his filing, he does not make clear what, if anything, he believes the information presented within has to do with his case – nor is it immediately apparent.A previous attempt by Fogle to appeal his sentence in the 7th Circuit Court of Appeals in Chicago was rejected by the court, which dismissed Fogle’s arguments in June 2016 as “unpersuasive.”In addition to Judge Pratt, Fogle’s request on Monday for immediate release and a hearing on the constitutionality of the charges he pleaded guilty to was also addressed to the warden of the Englewood Federal Correctional Institute and to President Donald Trump. It was not made clear in the filing what, if anything, he hoped President Trump could do for him. 3436

In the wake of recent fatal pedestrian crashes, a law firm commissioned a study that reveals the most dangerous intersections for pedestrians in San Diego.In 2016, there were 103 pedestrian fatalities in San Diego County. Between 2010 and 2016, a total of 430 people were killed and nearly 8,000 injured in pedestrian crashes.According to the law firm Estey and Bomberger, the most dangerous intersection in San Diego lies in Hillcrest at the intersection of First Avenue and University Avenue.The below map shows the cities with the highest numbers of dangerous intersections in California. It all started at 20 years old on stage at the NFL draft when my dream came true, and now here I am about to turn 30 in a few months with a decision I feel is the biggest of my life so far. I will be retiring from the game of football today. I am so grateful for the opportunity that Mr. Kraft and Coach Belichick gave to me when drafting my silliness in 2010. My life experiences over the last 9 years have been amazing both on and off the field. The people I have meet, the relationships I have built, the championships I have been apart of, I just want to thank the whole New England Patriots organization for every opportunity I have been giving and learning the great values of life that I can apply to mine. Thank you to all of Pats Nation around the world for the incredible support since I have been apart of this 1st class organization. Thank you for everyone accepting who I am and the dedication I have put into my work to be the best player I could be. But now its time to move forward and move forward with a big smile knowing that the New England Patriots Organization, Pats Nation, and all my fans will be truly a big part of my heart for rest of my life. INDIANAPOLIS -- An Indianapolis lawyer is accused of flashing a bus carrying a girls' basketball team on two separate occasions while driving. Norwell High School girls’ basketball coach Eric Thornton said he was driving the girls to a tournament in June when a man pulled up beside their bus on I-70 near the airport and exposed himself. “He knew it was a school bus,” said Thornton. “(He) knew it was high school aged females on the bus.”The man, who police have identified as Raymond Fairchild, then exited the highway before the team could get the license plate on his Honda CRV. “The girls were horrified and just very disturbed,” said Thornton. In an attempt to identify the alleged flasher, Thornton posted a photo taken moments before the incident on social media. That post made its way to Union City where a second girls’ basketball team reported a similar incident last February – from what appeared to be the same man. “Once we found out that he’d done it before it was obvious this was a pattern,” said Thornton. It didn’t take long before someone on Facebook recognized that man as Fairchild and contacted investigators. The 71-year-old is listed as having a law office in downtown Indianapolis. “He should never be allowed to practice law again in my opinion,” said Thornton. “He should be put away for a time.”Fairchild now faces six counts of public nudity and indecency charges. His first court appearance is set for October 26. “It’s a crime against innocent, na?ve girls who just saw abnormal behavior and had no idea what would happen next,” said Thornton. “He needs to be severely punished for his behavior.”  1669

INDIANAPOLIS — After battling the potentially deadly coronavirus, some COVID-19 patients have reported lingering health issues. Everything from mental health issues to difficulty sleeping to cognitive problems.Doctors at Indiana University Health say there are several lasting effects from the novel coronavirus. Some of these symptoms have lasted up to six months after recovering from the virus.Dr. Sikandar Khan said 60% of patients have complained of a low quality of life, in his estimation.“Their stamina is not the same,” he said. “They get easily fatigued and they have a lot of pain in their body.”IU Health established their ICU Survivor Center in May in response to COVID-19, noticing there was a wide variety of lingering effects in their patients.“Even months out from surviving and going through rehab, patients are still dealing with a lot of rehabilitating symptoms,” Khan said. “And so for them, recovery is not just discharging from the hospital and feeling great again, but it is months if not years of recovery.”Patients who are older, he said, with more medical problems will often have longer recoveries. But that’s not always the case with every patient.“We were quite taken aback that even our young patients — our youngest being 22-years of age that we have already seen in our ICU Survivor Center — even those patients were having a lot of difficulty adjusting back to life after COVID,” Khan said.As we learn more about this virus every day, he encourages anyone feeling any lasting symptoms to seek help.
