SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. On that day, the initial response of our captain and crew to address all immediate safety concerns and ensure the well-being of all guests aboard, was exceptional. Hornblower has noted several inaccuracies in the NTSB report on this matter, and therefore disagrees with its determinations as to the probable cause of the allision.  Due to ongoing product defect litigation, Hornblower cannot comment further at this time. Hornblower, deeply appreciates the amazing loyalty of our customers and guests over the years, and we continue to work with care and diligence, every day, to deliver on that trust.” 2739

SAN DIEGO (KGTV) -- A car was found fully engulfed in flames on state Route 52 early Thursday morning, but authorities were unable to locate the driver.At around 4:20 a.m., California Highway Patrol officers were called to a vehicle fire on westbound SR-52, just east of Santo Road, in the Tierrasanta area.As flames raged, CHP officers broke a side window to check if anyone was inside, but no one was found.Firefighters were able to knock down the blaze in about 5 minutes.The cause of the fire is under investigation. 528

SAN DIEGO (KGTV) — A foot pursuit between police and a suspect ended in an officer-involved shooting in the Logan Heights neighborhood Monday.An officer was trying to contact a 30-year-old Hispanic male, later identified as Enrique Aguilar, at about 3:20 p.m. over what he believed to be a narcotics violation, according to San Diego Police Capt. Tom Underwood. Aguilar fled, prompting a foot pursuit in the area of 3400 National Avenue, police say.Police said during the foot pursuit, Aguilar revealed a handgun.VIDEO: Video captures officer-involved shooting in Logan HeightsPAST OIS INCIDENTS: DA releases body cam footage, reviews several officer-involved shootingsOfficers say they ordered Aguilar to drop his weapon. Police said at one point, Aguilar pointed the handgun at officers, prompting an exchange of gunfire.Aguilar was struck at least once. He suffered non-life threatening injuries and was transported to a nearby hospital.Neither officer, one a 24-year veteran and the other a 2-year veteran, was injured in the shooting. The names of the officers were not released.SDPD Press Conference:Capt. Underwood added there was another male suspect they were searching for connected to the initial narcotics violation.Both directions of the 3200-3500 blocks of National Ave. have been closed to traffic as officers investigate. Police expected the area to be shut down into the evening.Witness video showed the moment officers opened fire on Aguilar, after multiple demands to drop his weapon. Capt. SAN DIEGO (KGTV) - A European carrier is hoping to transform the way Southern California travels between major cities.FlixBus will start offering service to 10 Southern California cities, including in San Diego, beginning May 31. The service, which has operated within Europe since 2013, is hoping to carve out a presence with discounted ticket prices and some high-tech additions.For a limited time, travelers can snag fares from Los Angeles to Las Vegas for as low as on select dates throughout June, according to the service's website. SAN DIEGO (KGTV) - A family wants the Governor of California to keep the man who murdered three San Diego State professors behind bars. Frederick Davidson was sent to prison in 1997 for three consecutive life sentences without parole after he gunned down his three engineering professors Chen Liang, Preston Lowry, and Constantinos Lyrintzis.The San Diego County District Attorney’s Office recently notified the victims’ families that Davidson applied for executive clemency.“Just asking for clemency?  Out of what?  On what grounds?” asked a distraught Esther Alonso, Lyrintzis’ sister-in-law.  Lyrintzis was married to her sister, Deana Alonso, and the couple had a young daughter.A District Attorney’s Office spokesman said the DA’s office already filed a letter opposing Davidson’s request.Alonso told 10News she could not believe Davidson would request clemency.  Alonso said the family agreed to not seek the death penalty in 1997 if Davidson agreed to plead guilty and go to prison for life without parole.“How can they tell them 20 years later that the deaths of their husbands and their fathers…that this guy has more rights than they do?” asked Alonso, a professor at Southwestern College. “I don’t understand a system where that is even possible.”Alonso created a Change.org petition directed at Governor Jerry Brown asking him to deny Davidson’s request.The DA’s spokesman said their office opposed more than 50 clemency requests last year and none of those requests were granted.  The spokesman added there is no deadline for Governor Brown to respond or send it to a hearing. 1627
