SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. We are grateful for the Court's comprehensive enforcement of environmental law and look forward to review of an alternative in an EIR that will allow this historic building to survive as part of a successful new project. SAN DIEGO (KGTV) -- A Hazardous Materials Team is investigating a Rancho Bernardo residence following reports of a possible fentanyl overdose death at the home Thursday morning.Crews responded at around 4 a.m. to calls of an overdose at a residence at 11300 Calenda Road located a few blocks from Westwood Elementary School.First responders discovered an unconscious 27-year-old male. The victim was declared deceased at the scene, according to San Diego County Sheriff's Office officials. Neighbors told 10News the man lived at the home with his parents.While at the scene, our 10News crew saw a woman being escorted out of the house and placed in an ambulance. It’s still unclear how she’s involved.The San Diego County Medical Examiner will identify the man and confirm his cause of death. 800

SAN DIEGO (KGTV) - A Harley-Davidson owner is hoping for leads after his motorcycle disappeared from a mall parking lot in Mission Valley.Sebastian Rudi, who works at Westfield Mission Valley, was expecting to see his newly purchased 2002 Harley after his shift ended around 10 p.m. Saturday. Instead the bike that was parked in the underground lot, feet from the ramp into the mall, was gone."A little panic ... mixture of anger and pure disappointment," said Rudi.MAP: Track crime happening in your neighborhoodThat may actually an understatement. SAN DIEGO (KGTV) - A new pilot program in San Diego hopes to break the barrier between older adults and ridesharing apps. Together, Jewish Family Service (JFS) and the Ed Brown Center are testing an outreach and education program connecting older adults with free ridesharing services so they can participate in health and wellness programs.The pilot program is part of a partnership with Lyft and the National Council on Aging (NCOA). The Ed Brown Center was one of three senior centers selected from across the country.The goal is to understand whether ridesharing can improve an older adult’s well-being by enabling them to travel to their local senior center to take part in activities such as health classes, nutrition programs, lifelong learning, and social opportunities.JFS partnered with Lyft two years ago to provide rides to seniors and individuals receiving breast cancer treatment. Called “On the Go: Navigator,” the program allows older adults to easily book rides to the grocery store, doctor’s appointments and more, without a smartphone. With this service, seniors must pay for the trip, as well as a service fee. SAN DIEGO (KGTV) - A San Diego Immigration and Customs Enforcement Agent accused of pointing a gun at a man in East County was charged Tuesday.Investigators said Agent Ed Zuchelli waved the gun at a young man who was riding a dirt bike in Lake Murray on February 16.Zuchelli is also accused of driving drunk. San Diego Police confirm he was in a government-issued vehicle at the time of the arrest.
