Apple's latest move in China has privacy advocates and human rights groups worried.The U.S. company is moving iCloud accounts registered in mainland China to state-run Chinese servers on Wednesday along with the digital keys needed to unlock them."The changes being made to iCloud are the latest indication that China's repressive legal environment is making it difficult for Apple to uphold its commitments to user privacy and security," Amnesty International warned in a statement Tuesday.The criticism highlights the tradeoffs major international companies are making in order to do business in China, which is a huge market and vital manufacturing base for Apple.In the past, if Chinese authorities wanted to access Apple's user data, they had to go through an international legal process and comply with U.S. laws on user rights, according to Ronald Deibert, director of the University of Toronto's Citizen Lab, which studies the intersection of digital policy and human rights."They will no longer have to do so if iCloud and cryptographic keys are located in China's jurisdiction," he told CNNMoney.The company taking over Apple's Chinese iCloud operations is Guizhou-Cloud Big Data (GCBD), which is owned by the government of Guizhou province. GCBD did not respond to requests for comment.The change only affects iCloud accounts that are registered in mainland China.Apple made the move to comply with China's latest regulations on cloud services. A controversial cybersecurity law, which went into effect last June, requires companies to keep all data in the country. Beijing has said the measures are necessary to help prevent crime and terrorism, and protect Chinese citizens' privacy.The problem with Chinese cybersecurity laws, Deibert said, is that they also require companies operating in China "to turn over user data to state authorities on demand -- Apple now included."Other big U.S. tech companies have had to take similar steps -- Amazon and Microsoft also struck partnerships with Chinese companies to operate their cloud services in the country.Apple says that it did advocate against iCloud being subject to the new law, but was unsuccessful."Our choice was to offer iCloud under the new laws or discontinue offering the service," an Apple spokesman told CNN. The company decided to keep iCloud in China, because cutting it off "would result in a bad user experience and less data security and privacy for our Chinese customers," he said.Apple users typically use iCloud to store data such as music, photos and contacts.That information can be extremely sensitive. Earlier this month, Reporters Without Borders urged China-based journalists to change the country associated with their iCloud accounts -- which is an option for non-Chinese citizens, according to Apple -- or to close them down entirely.Human rights groups also highlighted the difficult ethical positions Apple could find itself in under the new iCloud arrangement in China.The company has fought for privacy rights in the Unites States. It publicly opposed a judge's order to break into the iPhone of one of the terrorists who carried out the deadly attack in San Bernardino in December 2016, calling the directive "an overreach by the US government."At the time, CEO Tim Cook said complying with the order would have required Apple to build "a backdoor to the iPhone ... something we consider too dangerous to create."Human Rights Watch questioned whether the company would take similar steps to try to protect users' iCloud information in China, where similar privacy rights don't exist."Will Apple challenge laws adopted by the Chinese government that give authorities vast access to that data, especially with respect to encrypted keys that authorities will likely demand?" asked Sophie Richardson, China director for Human Rights Watch.Apple declined to answer that question directly, but it pushed back on concerns that Chinese authorities will have easy access to iCloud users' data."Apple has not created nor were we requested to create any backdoors and Apple will continue to retain control over the encryption keys to iCloud data," the Apple spokesman said."As with other countries, we will respond to legal requests for data that we have in our possession for individual users, never bulk data," he added.Rights groups and privacy advocates are not convinced."China is an authoritarian country with a long track record of problematic human rights abuses, and extensive censorship and surveillance practices," Deibert said.Apple users in China should take "extra and possibly inconvenient precautions not to store sensitive data on Apple's iCloud," he advised.Most of those users have already accepted the new status quo, according to Apple. At the beginning of the school year, some of the kids did in-person learning for part of the week.“I was very grateful when they were able to go to school,” said the mother of six, Alexi Robinson.With COVID-19 cases spiking this winter, all six are indefinitely back to remote learning. The decision dropped a heavyweight on Robinson.“I was like, ‘Close the restaurants, close the mall, close everything. Just please let's keep the kids in school,’ because it's, it's just so hard. It's so hard and so frustrating. I just want to, just break down and cry,” said the mother.Robinson and her husband both work full-time to support their family. “I leave before they're awake for the day. My husband is gone sunup to sundown every day. He travels a lot out of town as well,” said Robinson.Robinson says her older kids have been taking on the teaching role while she and her husband work.“I couldn't do it without them, but then I don't want them to suffer either. They get reprimanded by their teachers, you know, if they're late or if they leave for a second or whatever else and so it's hard,” said Robinson.Riker, a freshman in high school, and Halle, a sixth-grader, said they’re struggling in their own classes just to help their siblings.“You just can't focus,” said Riker. “Like sometimes, you're on remote by yourself, and you still can't focus. But you know with the kids around, it's noisy. It's just hard. It's really hard.”They said being both a teacher and a student is taking a serious mental toll.“Because they're so little, they don't understand when we need to work,” said Halle.“I’m used to being kind of like the oldest, and you know, the babysitter, but this is like a whole other level, just like stress and it’s just getting, just difficult,” said Riker.It’s especially tough because the two youngest children are in special education for speech therapy.“It’s harder for them to stay caught up without that extra help of the live teachers, so they could they all could potentially fall behind,” said Alexi.Falling behind is a concern for families across the country. Teachers like Lindsay Datko are fighting to help.“If they miss those developmental windows, it will take them years to overcome habits that were poorly formed for the average student. So, we will see the effects of this for years to come if we don't act now,” Datko explained.Datko is tutoring students who are doing remote learning, and she’s been working with local leaders for months to give families a chance to choose whether in person or remote learning works best for their students.“The whole spectrum is struggling, and we can do something. I know that there are teachers who are truly fearful for different reasons, and we respect that. We are pushing for the choice," she said.Datko said there are countless teachers willing to go back to school in her district, and she hopes leaders will acknowledge those educators and families wanting to go back to school.The Robinsons are hoping the new year will bring them the choice to send their children to school.“I know that they do a lot better in school,” said Alexi. “I hope that we can get through it.” 3336

An explosion from an electronic cigarette has killed a man in St. Petersburg, Florida, according to authorities who are investigating the circumstances surrounding his death.Tallmadge D'Elia, 38, was found dead this month after a fire alarm went off at his home and officers arrived on the scene, according to his autopsy report. Officials found him with a wound to his top lip area and areas of burns to his body. His death has been ruled accidental.The cause of death is identified as a projectile wound to the head, Bill Pellan, director of investigations at the Pinellas County Medical Examiner's Office, said Tuesday.The projectile was from a section of an e-cigarette. The autopsy noted that the e-cigarette was manufactured by Smok-E Mountain and was a "mod" type device.E-cigarettes are battery-operated devices that produce an aerosol by heating a liquid, usually containing nicotine, flavorings and other chemicals, according to the US Centers for Disease Control and Prevention. Users inhale the aerosol.More than one in every 10 adults has tried an e-cigarette even just one time, according to the CDC. E-cigarettes can come in many shapes and sizes; some are made to look like regular cigarettes, while others are larger devices such as tank systems or "mods."The exact causes of e-cigarette explosion incidents sometimes are unclear, but evidence suggests that battery-related issues may lead to explosions, according to the US Food and Drug Administration.E-cigarettes that are similar in size and shape to traditional cigarettes come with a smaller wattage unit and therefore may not have the power to fail as dramatically, said Thomas Kiklas, chief financial officer of the Tobacco Vapor Electronic Cigarette Association.Larger vaporizers -- such as the device found in the St. Petersburg case -- come with much larger and more powerful batteries."The two major causes of dramatic failures with the larger units are overcharging of the battery and then the shorting of the battery," Kiklas said."Lithium ion batteries fail in other devices as well, but in a laptop, it's on your lap," he said. "In this case, with an e-vapor product, it's close to the face."Though such incidents are rare, this isn't the first time a spontaneous e-cigarette explosion has raised concerns.There were 195 separate e-cigarette fire and explosion incidents in the United States reported by the media between 2009 and 2016, according to data released last year by the US Fire Administration.For example, in 2015, an e-cigarette exploded in a man's face in Naples, Florida, burning his face, chest, hands and lungs. In 2016, an e-cigarette exploded in a New York man's pants pocket. He suffered third-degree burns.Also that year, a 14-year-old girl had mild to moderate burns after an e-cigarette exploded in the pocket of a person nearby while on a Harry Potter ride at Universal Studios in Orlando, Florida.None of those cases was fatal.Kiklas said there are two steps e-cigarette users can take to avoid the risk of an explosion."We've put the caution out before," Kiklas said."Make sure that you use the charger that comes with the battery, and make sure the charger has a shutoff device, an automatic shutoff device, so it's not overcharged. That's typically the biggest issue which causes batteries to fail," he said.
