CAMPO, Calif. (KGTV) -- Border Patrol Sunday rescued a Mexican national with serious injuries they say was left behind by a criminal smuggling organization. The San Diego County Sheriff’s Department notified the agency around 4 a.m. December 1 about a distress call of a man in a rural area near Lake Morena Reservoir. The 34-year-old man was suffering from a serious leg injury, Border Patrol says. (KGTV) - Community members gathered outside Carlsbad Police Department on Friday, demanding change following a controversial encounter last week between an African American man and Carlsbad officers.“There was zero attempt for de-escalation,” said Yusef Miller with North County Civil Liberties Coalition. “We're asking that all citizens stand with us in solidarity to fight this police brutality," another activist told reporters.The Carlsbad Police Department previously released video which juxtaposed three camera angles of the confrontation with the Marcel Cox-Harshaw -- two from officer body cameras and one from a witness. The footage can be viewed here.The witness' phone shows officers using a Taser on Harshaw and pressing his head into the pavement. The two other videos from police body cameras show officers meeting medics who were called out to a report of a man face down on the side walk. Police say that while medics were evaluating him, he became agitated, yelled profanities and began walking quickly toward them.The department says that officers feared for the medics' safety, so they reached out and told him to stop, but he continued to yell as they tried to cuff him.Officers report that they then used a Taser to try to subdue him after he continued to yell, struggle, turn and pull away.Police report that they then restrained him by holding his head and body to the ground and asking him to calm down while cuffing him, but they say that he refused. The department goes on to say that they put a porous, breathable spit mask bag over his head to protect themselves from coming into contact with droplets from his nose and mouth.Activists dispute the department's account of the night.“They approached him from behind. They grabbed his wrist. They didn't introduce themselves. He wasn't harming anyone. He wasn't armed to our knowledge,” added Miller.Harshaw was taken to the hospital and later released and then cited for resisting arrest. Police believe that drugs or alcohol may have played a role.Police report that a number of factors were considered by officers to use force, including, in part, "The apparent immediacy and severity of the threat to officers or others - Mr. Harshaw charged unarmed fire personnel while yelling profanities."Police also reveal that a Taser can be used, in part, when, "The subject is violent or is physically resisting. (AP) — NASCAR has cleared Kyle Larson to return in 2021, ending his long suspension for using a racial slur while playing a video racing game. “NASCAR continues to prioritize diversity and inclusion across our sport,” the sanctioning body said in an official statement. “Kyle Larson has fulfilled the requirements set by NASCAR and has taken several voluntary measures, to better educate himself so that he can use his platform to help bridge the divide in our country," NASCAR said in a press release. "Larson’s indefinite suspension has been lifted. Under the terms of his reinstatement, he will be cleared to return to all NASCAR racing activities effective January 1, 2021.”Larson was suspended in April after he used the n-word while playing an online racing game in which viewers could follow along. (KGTV) — Three people were treated for gunshot wounds and one person was taken into custody in Carlsbad following a shooting Saturday morning.Carlsbad Police responded to calls of shots fired at the Pacific View Apartment Homes complex in the 5100 block of Whitman Way just before 6 a.m.Officers arrived to find a man and woman with gunshot wounds in a courtyard area of the complex. Both were treated by Carlsbad Fire crews and taken to a nearby hospital.MAP: Crime happening in your neighborhoodPolice later located another man with a gunshot wound in the apartment complex. He too was taken to a nearby hospital for treatment.Carlsbad detectives were on the scene Saturday investigating the shooting. They believe the three knew each other and the shooting was not a random act.Police said one person is in custody but did not say whether that person was one of the three who were shot. California health officials are warning residents not to eat oysters from British Columbia, Canada, following a norovirus outbreak.About 100 people got sick in California after they consumed the raw oysters, health officials said."As of April 27, approximately 100 individuals have reported illness after they consumed raw British Columbian oysters sold by restaurants and retailers throughout the state," the California Department of Public Health said."Laboratory testing has confirmed norovirus infection in several patients from both California and Canada. Although the number of reported new illnesses has decreased during the last week, the investigation is ongoing."Canada has reported 172 cases of gastrointestinal illness linked to consumption of raw oysters."Avoid eating raw and undercooked shellfish, including oysters, to reduce your risk of illness," said Dr. Karen Smith, a public health officer in California."If you do eat shellfish, cook it until it reaches an internal temperature of at least 145°F. Quick steaming isn't sufficient to kill norovirus."Norovirus is spread through the ingestion of infectious virions, which grow in the small intestine before being expelled in feces. Infection usually occurs when someone eats food or drinks liquids that have been contaminated, touches surfaces or objects that are contaminated and then puts their hands in their mouth, or has contact with someone who has been infected, such as by sharing food.Norovirus causes inflammation of the stomach, the intestines or both.
